Raoul<\/a><\/em>, is one of the top federal challenges to the law. The plaintiffs already won at the district level, but the state is now trying to reverse that ruling in the Seventh Circuit Court of Appeals. What\u2019s catching everyone\u2019s attention isn\u2019t just that Illinois is defending a controversial law\u2014but <em>how<\/em> they\u2019re doing it.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"The Most Offensive Argument Used to Disarm You\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/kGCJ-aSuTYM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>William Kirk, president of <a href=\"https:\/\/gunsamerica.com\/digest\/washington-senator-pass-firearms-test-first\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-argues-it-knows-what-your-life-is-worth\" title=\"Illinois Argues It Knows What Your Life Is Worth\"  data-wpil-monitor-id=\"605\">Washington Gun Law<\/a>, pulled no punches in his breakdown of the state&#8217;s legal strategy. <\/p>\n\n\n\n<p>\u201cIllinois wants to assign a value to your life,\u201d he says. \u201cThey\u2019re arguing that only the state can decide what type of firearm you get to use in order to defend it.\u201d<\/p>\n\n\n\n<p>Let that sink in.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-state-s-four-point-plan-to-disarm-you\">The State&#8217;s Four-Point Plan to Disarm You<\/h2>\n\n\n\n<p>According to Illinois\u2019 own filing, they\u2019re claiming:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Only firearms \u201cin common use\u201d for self-defense are protected by the Second Amendment.<\/li>\n\n\n\n<li>Firearms \u201cmore appropriate\u201d for military use\u2014like AR-15s\u2014aren\u2019t protected at all.<\/li>\n\n\n\n<li>Any accessories or features deemed \u201cunnecessary\u201d by the state are fair game to ban.<\/li>\n\n\n\n<li>The state alone gets to make those determinations for you.<\/li>\n<\/ol>\n\n\n\n<p>Illinois\u2019 brief reads like it was written by someone who\u2019s never touched a firearm but has spent hours googling scary-sounding terms. It says the <a href=\"https:\/\/gunsamerica.com\/search?keyword=ar-15\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-argues-it-knows-what-your-life-is-worth\" title=\"Illinois Argues It Knows What Your Life Is Worth\">AR-15<\/a> is basically an M16\u2014ignoring the very real fact that one is semi-automatic and the other is a select-fire military weapon. That\u2019s right\u2014they want to limit your capacity based on a number that can\u2019t possibly predict the next violent encounter in your life. <\/p>\n\n\n\n<p>And when it comes to overpenetration concerns? Illinois says AR-15s are \u201cunsuitable\u201d for home defense because of the potential risk of bullets going through walls. Translation: your neighbor\u2019s drywall has more rights than you do.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-most-offensive-argument-yet\">The Most Offensive Argument Yet<\/h2>\n\n\n\n<p>But the real gut punch comes with the idea that <em>the state<\/em> gets to decide what your life is worth\u2014and what tools you&#8217;re allowed to use to preserve it.<\/p>\n\n\n\n<p>\u201cBy claiming certain weapons are \u2018overkill\u2019 for civilian self-defense,\u201d says Kirk, \u201cIllinois is arrogantly declaring that they\u2014not you\u2014know what you should be allowed to use in a life-or-death situation.\u201d<\/p>\n\n\n\n<p>That\u2019s the most offensive part of the entire brief. Illinois is not just banning hardware. It\u2019s banning your autonomy, your judgment, and your right to make the most personal decision imaginable\u2014how to defend your life and your loved ones.<\/p>\n\n\n\n<p>This isn\u2019t just a legal skirmish in one state. It\u2019s a blueprint for what anti-gun states across the country may attempt next.
