That\u2019s not an exaggeration. <\/p>\n\n\n\n<p>In <em><a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/virginia\/vaedce\/1:2023cv01338\/543329\/242\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"anti-gunners-silence-2a-literally\" title=\"Anti-Gunners Want to Silence the 2A\u2014Literally\">Lowy v. Daniel Defense<\/a><\/em>, activists are suing major industry players like Daniel Defense, Magpul, and Vista Outdoor\u2014not for breaking laws, but for sharing pro-2A posts on social media.<\/p>\n\n\n\n<p>Their claim? Patriotic images and military-themed marketing \u201ccaused\u201d a shooting.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Gun-Control Activists Are Doing This to Silence Gun Companies\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/1PXyMtAcCtc?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">Anti-gunners are trying to actively silence gun makers.  <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Joseph Greenlee, Director of Litigation Counsel for NRA-ILA, isn\u2019t buying it. Speaking with <em>America\u2019s 1st Freedom<\/em> Editor-in-Chief Frank Miniter, Greenlee breaks down how this isn\u2019t just a case about firearms\u2014it\u2019s a full-blown attack on First Amendment rights.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThis is really a free speech case,\u201d Greenlee said. \u201cAll these manufacturers are doing is posting pictures of Americans enjoying their Second Amendment rights.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p>Think moms and daughters in hunting blinds, flags draped next to rifles, or groups training in tactical gear. There\u2019s no proof the shooter even saw these posts.<\/p>\n\n\n\n<p>Still, the plaintiffs want the courts to ignore the facts\u2014and the law. Congress already passed the Protection of Lawful Commerce in Arms Act (PLCAA) back in 2005 to stop this kind of abusive litigation. <\/p>\n\n\n\n<p>PLCAA blocks <a href=\"https:\/\/gunsamerica.com\/digest\/connecticut-ag-files-lawsuit-against-four-ghost-gun-companies\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"anti-gunners-silence-2a-literally\" title=\"Anti-Gunners Want to Silence the 2A\u2014Literally\" data-wpil-monitor-id=\"653\">lawsuits against gun companies<\/a> for the criminal misuse of their products by third parties. But there\u2019s a loophole\u2014known as the \u201cpredicate exception\u201d\u2014that anti-gunners are desperately trying to exploit. If they can claim a gun maker broke a law in their marketing, they think they can drag them into court anyway.<\/p>\n\n\n\n<p>But here\u2019s the kicker: the social media posts cited in the lawsuit aren\u2019t ads. They don\u2019t promote violence. They don\u2019t even link to products. Yet, anti-gunners want to use them to bankrupt lawful businesses.<\/p>\n\n\n\n<p>This isn\u2019t just hypothetical. In California, lawmakers already passed legislation banning any gun-related advertising that might be \u201cattractive to minors.\u201d <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-new-shadow-2-carry-nra-2025\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/cz-new-shadow-2-carry-nra-2025\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"anti-gunners-silence-2a-literally\" title=\"Anti-Gunners Want to Silence the 2A\u2014Literally\">New Shadow 2 Carry \u2014 NRA 2025<\/a><\/h2>\n\n\n\n<p>That could mean outlawing bright colors, youth shooting camp promotions, or even just posts showing young people enjoying safe, supervised shooting sports.<\/p>\n\n\n\n<p>So what happens if this lawsuit succeeds?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Say goodbye to seeing new product announcements online.<\/li>\n\n\n\n<li>Forget about social media posts promoting training courses or competitions.<\/li>\n\n\n\n<li>And watch gun makers get sued into oblivion for exercising basic First Amendment rights.<\/li>\n<\/ul>\n\n\n\n<p>The good news: the case is on appeal, and the manufacturers already won at the district court level. The Supreme Court is also considering a similar challenge in<a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/smith-wesson-brands-inc-v-estados-unidos-mexicanos\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"anti-gunners-silence-2a-literally\" title=\"Anti-Gunners Want to Silence the 2A\u2014Literally\"> <em>Smith &amp; Wesson v.
