Baxter<\/a><\/em>. After Keshon Baxter was pulled over in Iowa, law enforcement discovered marijuana and a firearm in his vehicle. <\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Is DOJ About to Abandon Another Federal Gun Law?\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/4bnJdHIwKkc?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">Should the DOJ abandon the federal gun ban for pot smokers? <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Baxter was then charged under 18 U.S.C. \u00a7 922(g)(3), which prohibits unlawful drug users from possessing firearms. Baxter fought back, arguing that this federal law was unconstitutional as applied to him.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-federal-judge-agrees-w-biden-s-doj-no-guns-for-pot-smokers\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/federal-judge-agrees-w-bidens-doj-no-guns-for-pot-smokers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-doj-abandon-federal-gun-ban-against-pot-smokers\" title=\"Should DOJ Abandon Federal Gun Ban Against Pot Smokers?\">Federal Judge Agrees w\/ Biden\u2019s DOJ: No Guns for Pot Smokers<\/a><\/h2>\n\n\n\n<p>While Baxter initially lost at trial, the Eighth Circuit Court of Appeals agreed with part of his challenge. The court found that there were no clear historical analogues justifying a ban on cannabis users possessing firearms. <\/p>\n\n\n\n<p>As a result, the court ruled that applying the law to Baxter violated the Second Amendment.<\/p>\n\n\n\n<p>Now the clock is ticking. The Department of Justice \u2014 led by Solicitor General John Sauer \u2014 asked for an extension until <strong>May 4th<\/strong> to decide whether it will ask the Supreme Court to review the ruling. <\/p>\n\n\n\n<p>If the DOJ <em>does not<\/em> appeal, it could signal a massive shift: for the first time, federal authorities might abandon enforcement of this controversial provision, at least when it comes to marijuana users.<\/p>\n\n\n\n<p>This move would not be without precedent. The DOJ already declined to appeal in the <em>Range v. Attorney General<\/em> case, which challenged the federal firearm ban on non-violent felons. <\/p>\n\n\n\n<p>Add in the fact that the Fifth, Eighth, and Tenth Circuits have issued similar rulings protecting <a href=\"https:\/\/gunsamerica.com\/digest\/federal-judge-says-gun-ownership-a-right-for-cannabis-users\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"should-doj-abandon-federal-gun-ban-against-pot-smokers\" title=\"Should DOJ Abandon Federal Gun Ban Against Pot Smokers?\" data-wpil-monitor-id=\"657\">cannabis users\u2019 gun<\/a> rights, <\/p>\n\n\n\n<p>There\u2019s simply no historical foundation to justify permanently stripping gun rights from someone who occasionally uses cannabis.<\/p>\n\n\n\n<p>If the DOJ drops its defense of the gun ban for pot smokers, it would be another major rollback of Biden-era gun policies \u2014 and a big win for Second Amendment advocates nationwide. <\/p>\n\n\n\n<p>Stay tuned, because by <strong>May
