The Court ruled 7-2 that some kits are close enough to functioning firearms to fall under federal oversight. VanDerStok<\/a><\/em>, centered around the ATF\u2019s 2022 <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/definition-frame-or-receiver\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">rule<\/a> that expanded the definition of a &#8220;firearm&#8221; to include some unfinished frames, receivers, and gun kits that could be \u201creadily converted\u201d into working <a href=\"https:\/\/gunsamerica.com\/firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">firearms<\/a>.<\/p>\n\n\n\n<p>These are often referred to as \u201cghost guns\u201d by legacy media because they can be built at home and lack serial numbers, making them difficult to trace.<\/p>\n\n\n\n<p>The Fifth Circuit previously <a href=\"https:\/\/gunsamerica.com\/digest\/fifth-circuit-strikes-down-atfs-final-rule-on-firearm-receivers-as-illegal\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">sided<\/a> with the plaintiffs\u2014manufacturers and private gun owners\u2014finding that the ATF had overstepped its statutory authority. <\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">We are disappointed with the Supreme Court\u2019s misguided decision but recognize this is only one battle in a multi-generational war over the scope of government and pre-existing right to keep and bear arms. <a href=\"https:\/\/t.co\/BEjVgoyO2O\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">https:\/\/t.co\/BEjVgoyO2O<\/a><\/p>&mdash; Firearms Policy Coalition (@gunpolicy) <a href=\"https:\/\/twitter.com\/gunpolicy\/status\/1904929746296668276?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">March 26, 2025<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-springfield-armory-shakes-up-the-trp-lineup\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-armory-shakes-up-the-trp-lineup\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">Springfield Armory Shakes Up The TRP Lineup<\/a><\/h2>\n\n\n\n<p>But the <a href=\"https:\/\/gunsamerica.com\/digest\/supreme-court-takes-up-marijuana-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\"  data-wpil-monitor-id=\"1083\">Supreme Court<\/a> reversed that decision, saying that because some kits are so close to functioning firearms, the ATF can regulate them.<\/p>\n\n\n\n<p>Justice Gorsuch, writing for the majority, said that kits like <a href=\"https:\/\/polymer80.us.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\">Polymer80\u2019s<\/a> \u201cBuy Build Shoot\u201d set can be completed in about 20 minutes with common tools, and therefore qualify as \u201cweapons\u201d under the Gun Control Act. <\/p>\n\n\n\n<p>The Court emphasized that the ATF rule was not unconstitutional \u201con its face,\u201d meaning it could still be challenged in future cases on an as-applied basis.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-bigger-problem-the-gray-area\"><strong>The Bigger Problem? The Gray Area<\/strong><\/h2>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Supreme Court rules on ghost guns case\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/wUUac4bBpXg?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>While the ruling confirms that some kits are fair game for regulation, it leaves manufacturers and <a href=\"https:\/\/gunsamerica.com\/digest\/everytown-gun-control-wants-to-train-gun-owners\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\" data-wpil-monitor-id=\"1080\">gun owners<\/a> guessing where the line is drawn. <\/p>\n\n\n\n<p>Justice Gorsuch acknowledged the &#8220;gray area&#8221; created by the ruling, noting that not every kit or unfinished part will meet the threshold of \u201creadily convertible.\u201d That legal uncertainty opens the door to more litigation\u2014and potential overreach by the ATF.<\/p>\n\n\n\n<p>Justice Thomas dissented, warning that the ruling invites abuse by executive agencies and erodes the rule of law. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-washington-gun-law-s-take-somewhere-between-a-blow-and-a-shrug\"><strong>Washington Gun Law&#8217;s Take: Somewhere Between a Blow and a Shrug<\/strong><\/h2>\n\n\n\n<p>William Kirk of<a href=\"https:\/\/www.washingtongunlaw.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-upholds-atf-rule-on-ghost-guns\" title=\"Supreme Court Upholds ATF Rule on 'Ghost Guns'\"> Washington Gun Law<\/a> described the decision as \u201csomewhere in the middle.\u201d He stressed that the plaintiffs faced a steep challenge because they brought a <em>facial<\/em> challenge\u2014arguing the rule was invalid in all circumstances. <\/p>\n\n\n\n<p>Since the Supreme Court found that <em>some<\/em> kits clearly qualify as firearms, that challenge was bound to fail.<\/p>\n\n\n\n<p>Kirk warned, however, that the ruling puts gun owners and manufacturers in a \u201cmassive gray area,\u201d giving the ATF wide latitude to decide what counts as a firearm. He likened it to \u201ctaking the leash off a dog in a crowded park.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-bottom-line\"><strong>Bottom Line:<\/strong><\/h2>\n\n\n\n<p>The ATF won this round, but the Supreme Court left a lot unsaid. Manufacturers still don&#8217;t know where the line is between a legal hunk of polymer and a \u201cfirearm\u201d under federal law. <\/p>\n\n\n\n<p>That uncertainty\u2014and the power it gives federal
