Washington, D.C., is the center of gravity when it comes to policymaking in the United States. Big debates, big legislation and big policy agendas are decided that have sweeping authority across the United States.<\/p>\n\n\n\n<p>For some, it can be excruciatingly slow. That\u2019s what the Framers intended. Congress was never meant to be quick on decision-making. Instead, the process of drafting laws, enacting legislation and setting policy was intended to be deliberative. The idea was that lawmakers should put thought into the lasting impacts their passionate rhetoric might invite.<\/p>\n\n\n\n<p>This Congress won\u2019t be any different, especially when it comes to firearm policies. Congress is narrowly split in both chambers. That means meaningful legislation will likely not gain the support needed. That can be frustrating for pro-gun legislation but helpful when it comes to blocking gun control.<\/p>\n\n\n\n<p>That\u2019s why gun control proponents have shifted their focus to 50 new targets.<\/p>\n\n\n\n<p>State legislatures move much more quickly than Congress. While federal lawmakers have two calendar years to advance their bills, state legislatures \u2013 in some cases \u2013 have just two months. That means things move quickly and this year shows why gun control is moving their efforts to the states instead of Congress.<\/p>\n\n\n\n<p>Just 10 states hold year-round legislative sessions. The rest are a mad dash for state policy agendas. This year might be the best evidence of how gun control advocates are shifting their focus to getting their agenda items across the finish line.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-hardware-bans\">Hardware Bans<\/h2>\n\n\n\n<p>Gun control lawmakers in Colorado are continuing to press ahead with&nbsp;<strong><a href=\"https:\/\/leg.colorado.gov\/bills\/sb25-003\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Senate Bill 3<\/a><\/strong>, their attempt to ban semiautomatic firearms that can accept detachable magazines. That bill has taken on a&nbsp;<a href=\"https:\/\/coloradosun.com\/2025\/03\/11\/senate-bill-3-tweaks-colorado-gun-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\"><strong>series of alterations<\/strong><\/a>&nbsp;and has morphed into a bill that would essentially require a permit-to-purchase through a county sheriff. That\u2019s problematic for them because it contains subjective criteria that the U.S. Supreme Court rejected in the&nbsp;<em>Bruen<\/em>&nbsp;decision.<\/p>\n\n\n\n<p>Colorado isn\u2019t alone in trying to ban guns. New Mexico has&nbsp;<strong><a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?Chamber=S&amp;LegType=B&amp;LegNo=279&amp;year=25\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Senate Bill 279<\/a><\/strong>&nbsp;that also considers banning semiautomatic firearms that can accept a detachable magazine.&nbsp;<strong><a href=\"https:\/\/www.koat.com\/article\/gosafe-act-circulating-in-the-roundhouse-to-tackle-gun-safety-koat-politics-santa-fe\/63693678\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Opponents say<\/a><\/strong>&nbsp;that this is \u201cthe most wide, sweeping, overreaching legislative proposal we\u2019ve seen nationwide.\u201d The bill has passed one state Senate committee and is being considered in another. There are just days left in the session.<\/p>\n\n\n\n<p>Rhode Island is another state looking to outright ban <a href=\"https:\/\/gunsamerica.com\/digest\/sw-mp15-sport-ii\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Modern Sporting Rifles<\/a> (MSRs).&nbsp;<strong><a href=\"https:\/\/legiscan.com\/RI\/bill\/H5436\/2025\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">House Bill 5436<\/a><\/strong>&nbsp;would ban the possession, manufacture, sale and purchase of MSRs. Rhode Island lawmakers have made previous attempts at passing similar legislation. This year,&nbsp;<strong><a href=\"https:\/\/www.guns.com\/news\/2025\/02\/12\/new-state-joins-race-to-be-the-11th-to-enact-an-assault-weapon-ban\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Gov. Dan McKee<\/a><\/strong>&nbsp;added money to his state\u2019s budget proposal to bolster the effort. Local firearm retailers told media this law&nbsp;<strong><a href=\"https:\/\/www.msn.com\/en-us\/news\/world\/ri-gun-shop-owner-warns-new-assault-weapons-bill-could-put-him-out-of-business\/ar-AA1zWxuX?ocid=hpdhp17\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">would be their end<\/a><\/strong>&nbsp;of their business. NSSF is fighting all of these measures.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-targeting-industry\">Targeting Industry<\/h2>\n\n\n\n<p>At least two states are considering laws that would attempt to circumvent the Protection of Law Commerce in Arms Act (PLCAA). Both Connecticut and New Mexico are debating bills to expose the industry to lawsuits for violent acts committed by criminals that have no association with firearm manufacturers. Connecticut is considering\u00a0<strong><a href=\"https:\/\/legiscan.com\/CT\/bill\/HB07042\/2025#:~:text=Connecticut%20House%20Bill%207042&amp;text=To%20permit%20the%20filing%20of,control%20over%20firearm%20industry%20products.\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">HB 7042<\/a><\/strong>, a bill to permit crime victims, the state attorney general and even municipalities to bring lawsuits against <a href=\"https:\/\/gunsamerica.com\/firearms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">firearm manufacturers<\/a> when they don\u2019t impose \u201creasonable controls,\u201d without defining what that term means.<\/p>\n\n\n\n<p>New Mexico\u2019s&nbsp;<strong><a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?chamber=S&amp;legtype=B&amp;legno=318&amp;year=25\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">SB 318<\/a><\/strong>&nbsp;is similar. These bills would open Pandora\u2019s box to politically-motivated lawsuits designed to bankrupt the firearm industry via legal fees alone. These are the same municipal lawsuits that were brought against the industry in the late 1990s and early 2000s that gave rise to the bipartisan PLCAA, with which Congress stepped in and put an end to lawfare \u2013 or using the courts to advance agendas that the legislatures expressly rejected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-the-sig-p938-sig-s-forgotten-gem\">SEE ALSO: <a href=\"https:\/\/gunsamerica.com\/digest\/the-sig-p938-sigs-forgotten-gem\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">The SIG P938 \u2013 SIG\u2019s Forgotten Gem<\/a><\/h2>\n\n\n\n<p>That\u2019s not all. Connecticut and Delaware lawmakers are considering legislation to track the credit card purchases of law-abiding gun and ammunition purchasers, following the Orwellian lead of California, New York and Colorado. Connecticut is considering it&nbsp;<strong><a href=\"https:\/\/legiscan.com\/CT\/bill\/HB07037\/2025\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">HB 7037<\/a><\/strong>&nbsp;and Delaware is considering&nbsp;<strong><a href=\"https:\/\/legis.delaware.gov\/json\/BillDetail\/GenerateHtmlDocument?legislationId=141875&amp;legislationTypeId=1&amp;docTypeId=2&amp;legislationName=HB45\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">House Bill 45<\/a><\/strong>, which was heard in House Judiciary Committee. The bills would require credit card companies and payment processors to assign a firearm and ammunition-specific Merchant Category Code (MCC) to violate the purchase privacy of those who lawfully exercise their Second Amendment rights.<\/p>\n\n\n\n<p>Currently, 19 states have laws prohibiting the use of a firearm-specific MCC and legislation was introduced in Congress to ban their use to track law-abiding gun and <a href=\"https:\/\/gunsamerica.com\/ammo\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">ammunition<\/a> purchasers. Delaware\u2019s bill contains a provision that authorizes the Department of Justice to bring civil actions against those who violate the proposed law and a $10,000 fine. NSSF opposes these onerous bills.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-federalism-explained\">Federalism Explained<\/h2>\n\n\n\n<p>None of this is by accident. In fact, this is what the Framers intended.&nbsp;<strong><a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/intro.7-3\/ALDE_00000032\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\">Federalism<\/a><\/strong>&nbsp;is the concept that\u2019s embodied in the U.S. Constitution. It is a power-sharing agreement between the states and the federal government. The idea was that the federal government should be limited in its power while each state exercises its own authority within its own borders.<\/p>\n\n\n\n<p>Federalism also gave rise to the idea that the states are the \u201claboratories of democracy.\u201d That was a phrase popularized by U.S. Supreme Court Justice Louis Brandeis when he dissented in the 1932&nbsp;<strong><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/285\/262\" target=\"_blank\" class=\"clickTracking\" campaign=\"gun-controls-focus-shifts-to-state-capitals\" title=\"Gun Control\u2019s Focus Shifts to State Capitals\"><em>New State Ice Co. v. Liebman<\/em><\/a><\/strong>&nbsp;decision, when he wrote, \u201ca state may, if its citizens choose, serve as a laboratory; and try novel social and economic experiments without risk to the rest of the country.\u201d<\/p>\n\n\n\n<p>Just like science, these experiments in democratic rule often begin in state legislatures. Those that are successful are repeated and inform federal policy. Those that fail, well\u2026 fail. That experimental failure is limited to just that state instead of the whole country.<\/p>\n\n\n\n<p>Right now, there are a whole crop of gun control experiments being planted in state capitals. They have potential to gain root and not just harm the firearm industry and the rights of law-abiding citizens in those states but potentially grow into federal policy. That\u2019s why NSSF is busy not just in Congress but also in the states.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a href=\"https:\/\/gunsamerica.com\"
