{"id":209483,"date":"2024-11-19T18:40:07","date_gmt":"2024-11-20T00:40:07","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=209483"},"modified":"2026-02-23T08:30:34","modified_gmt":"2026-02-23T14:30:34","slug":"what-trump-can-and-cant-do-to-protect-2a-rights","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/what-trump-can-and-cant-do-to-protect-2a-rights\/","title":{"rendered":"What Trump Can and Can&#8217;t Do to Protect 2A Rights"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>Washington Gun Law President William Kirk, in his latest video, discussed what Donald Trump\u2019s potential return to the presidency in January 2025 could mean for Second Amendment rights. <\/p>\n\n\n\n<p>Kirk outlined what changes Trump could implement immediately, what might take longer, and what is unlikely to occur during his next administration.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"What He Can and Can&#039;t Do to Protect Your Second Amendment Rights\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ZJKcOImaurQ?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>\u201cThere are some things that can fix right away, but there are other things that are going to be kind of like turning around an aircraft carrier,\u201d Kirk explained.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-immediate-changes-under-trump\">Immediate Changes Under Trump<\/h2>\n\n\n\n<p>Kirk highlighted actions Trump could take as soon as he steps back into the Oval Office. \u201cNumber one, [Trump] could fire Steve Dettelbach. I believe he will fire Steve Dettelbach,\u201d Kirk said, referring to the current ATF director. <\/p>\n\n\n\n<p>He criticized Dettelbach\u2019s role in implementing controversial regulations, such as the <a href=\"https:\/\/gunsamerica.com\/digest\/huge-news-down-goes-atfs-pistol-brace-rule\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"what-trump-can-and-cant-do-to-protect-2a-rights\" title=\"What Trump Can and Can't Do to Protect 2A Rights\"  data-wpil-monitor-id=\"3657\">pistol brace rule<\/a> and zero-tolerance policies on Federal Firearms Licensees.<\/p>\n\n\n\n<p>Kirk also pointed to the White House Office of Gun Violence Prevention, created under President Biden, as another target for immediate elimination. <\/p>\n\n\n\n<p>\u201cIts head is on the chopping block\u2026 do we really need the White House Office of Gun Violence Prevention?\u201d he asked.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-legislative-realities-for-trump-s-agenda\">Legislative Realities for Trump\u2019s Agenda<\/h2>\n\n\n\n<p>Discussing <a href=\"https:\/\/gunsamerica.com\/digest\/national-concealed-carry-reciprocity-unnecessary\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"what-trump-can-and-cant-do-to-protect-2a-rights\" title=\"What Trump Can and Can't Do to Protect 2A Rights\"  data-wpil-monitor-id=\"3658\">national concealed carry reciprocity<\/a> and constitutional carry, Kirk expressed skepticism about the immediate success of such legislation. <\/p>\n\n\n\n<p>He referenced<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/9534\" target=\"_blank\" class=\"clickTracking\" campaign=\"what-trump-can-and-cant-do-to-protect-2a-rights\" title=\"What Trump Can and Can't Do to Protect 2A Rights\"> House Resolution 9534<\/a>, sponsored by Representative Thomas Massie, but noted the political challenges ahead. \u201cThe likelihood that this is going to pass out of both chambers in its current format, I think, is pretty remote,\u201d Kirk said.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/kimbers-stainless-ii-1911-one-classy-shooter\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"what-trump-can-and-cant-do-to-protect-2a-rights\" title=\"What Trump Can and Can't Do to Protect 2A Rights\">Kimber\u2019s Stainless II 1911: One Classy Shooter<\/a><\/strong><\/p>\n\n\n\n<p>Kirk explained that even with slim majorities in Congress, pushing through comprehensive Second Amendment legislation under Trump would require time and compromise. <\/p>\n\n\n\n<p>\u201cIf a version of this bill could be worked and passed out of both the House and the Senate, there is no doubt in my mind that President Trump would sign it,\u201d he added.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-key-appointments-in-a-trump-administration\">Key Appointments in a Trump Administration<\/h2>\n\n\n\n<p>Kirk emphasized the critical role Trump\u2019s <a href=\"https:\/\/www.politico.com\/news\/2024\/11\/19\/senate-republicans-matt-gaetz-attorney-general-00190332\" target=\"_blank\" class=\"clickTracking\" campaign=\"what-trump-can-and-cant-do-to-protect-2a-rights\" title=\"What Trump Can and Can't Do to Protect 2A Rights\">Attorney General<\/a> (Matt Gaetz) and ATF director appointments could play in shaping gun policy. <\/p>\n\n\n\n<p>\u201cWhat we simply need is a director of the ATF that\u2019s going to start interpreting the bipartisan Safer Communities Act much differently,\u201d he said.<\/p>\n\n\n\n<p>He also speculated on potential legal actions a Trump-appointed Attorney General might take, such as withdrawing DOJ rules on firearms or challenging restrictive state gun laws. <\/p>\n\n\n\n<p>Kirk admitted these moves would be challenging but not legally impossible. <\/p>\n\n\n\n<p>\u201cCould the Attorney General\u2019s office actually sue the states to overturn those laws? It would be a unique move but one that would not be legally impossible,\u201d he said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-looking-ahead-with-trump\">Looking Ahead with Trump<\/h2>\n\n\n\n<p>Kirk cautioned gun owners against expecting an overnight transformation under Trump. \u201cNo, it\u2019s not like the sun is going to rise again on January 20, 2025, and we\u2019re not going to have anything to worry about,\u201d he said. <\/p>\n\n\n\n<p>He added that state-level gun control efforts would likely intensify in response to a Trump presidency.<\/p>\n\n\n\n<p>Still, Kirk expressed optimism about Trump\u2019s potential to reset federal gun policies. <\/p>\n\n\n\n<p>\u201cClearly, the appointment of the Attorney General and an ATF director\u2026 would significantly change the entire playing field upon which the ATF operates,\u201d he said.<\/p>\n\n\n\n<p>Kirk concluded by urging viewers to stay informed. \u201cPart of being the
