Voters have been subjected to admonitions that former President Donald Trump is a \u201c<strong><a href=\"https:\/\/www.facebook.com\/photo.php?fbid=965805141572590&amp;id=100044293396335&amp;set=a.469444884541954\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">threat to democracy<\/a><\/strong>.\u201d There have been warnings that this election could be the&nbsp;<strong><a href=\"https:\/\/lincolnproject.us\/if-democracy-is-on-the-ballot-then-2024-could-be-the-last-free-election\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">last free election<\/a><\/strong>&nbsp;and&nbsp;<strong><a href=\"https:\/\/nypost.com\/2024\/06\/11\/media\/rachel-maddow-worried-trump-will-send-her-to-camps-if-elected\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">accusations<\/a><\/strong>&nbsp;that the military could be weaponized against political foes.<\/p>\n\n\n\n<p>The notions are laughable but show the depths to which political opponents will go to inject fear to drive votes. There\u2019s one threat that\u2019s very real, however. And one that voters have had a significant effect on in previous elections.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Harris v Trump: highlights of the US presidential election debate\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/2ec4Oa2L1fo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\"><em><strong>Who are you going to vote for?<\/strong><\/em><\/figcaption><\/figure>\n\n\n\n<p>That\u2019s the composition of the U.S. Supreme Court.<\/p>\n\n\n\n<p>U.S. Rep. Ilhan Omar (D-Minn.) is out reminding voters in her district \u2013 and across the nation \u2013 that should she and her fellow Democrats have their way, the Supreme Court could look radically different. That\u2019s a threat voters shouldn\u2019t dismiss and one in which they can have a direct impact when it comes to preserving Second Amendment rights and the ability for the firearm industry to thrive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-target-scotus\">Target: SCOTUS<\/h2>\n\n\n\n<p>Rep. Omar is telling voters that casting ballots for her, her fellow radical extremist \u201cSquad\u201d and other supportive Democrats will deliver a Court that\u2019s nothing more than a rubber stamp for extremist policies. She\u2019s telling voters, \u201cSCOTUS reform is on the ballot in November,\u201d according to a&nbsp;<strong><a href=\"https:\/\/www.foxnews.com\/politics\/squad-member-calls-radically-changing-supreme-court-scotus-reform-ballot-november\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">Fox News report<\/a><\/strong>. \u201cWe need to radically reform the broken Supreme Court,\u201d she posted to social media. Her posts included promises of \u201cexpanding the number of Justices,\u201d \u201ca binding, enforceable code of ethics,\u201d and \u201cimposing term limits.\u201d<\/p>\n\n\n\n<p>A couple of reminders. While election rhetoric is clogging up televisions, emails and social media, it wasn\u2019t long ago that lawmakers in the U.S. House of Representatives and U.S. Senate were&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/anti-gun-politicians-disparage-scotus-as-second-amendment-cases-election-looms\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">dead serious about upending the structure<\/a><\/strong>&nbsp;of the Supreme Court. The reason? The Court wouldn\u2019t blithely kowtow to their unconstitutional agenda. Since the lawmakers couldn\u2019t make an end-run around the Court, their plan is to \u201creimagine\u201d it not as a co-equal branch of government but one that is subservient to their whims. The constitutional doctrine of \u201cseparation of powers\u201d is at risk.<\/p>\n\n\n\n<p>It was only this past spring when Chief Justice John Roberts&nbsp;<strong><a href=\"https:\/\/apnews.com\/article\/supreme-court-alito-flag-roberts-senate-dc879158dd42050a9a52c850abfb90b9\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">refused to entertain<\/a><\/strong>&nbsp;Senate Democrats pearl-clutching over flags flown at Justice Samuel Alito\u2019s residences. It\u2019s not just flags, though. Democrats targeting SCOTUS are genuinely angry over a series of decisions by the nation\u2019s highest court, some decisions that include Second Amendment rights, like the pivotal&nbsp;<em>New<\/em><em> York State <a href=\"https:\/\/gunsamerica.com\/digest\/springfield-armory-new-saint-victor-rifles-and-pistols\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\"  data-wpil-monitor-id=\"3784\">Rifle &amp; Pistol<\/a> Association v<\/em>. Bruen&nbsp;decision.<\/p>\n\n\n\n<p>Before President Joe Biden was unceremoniously pushed out of the presidential race in favor of Vice President Kamala Harris, he&nbsp;<strong><a href=\"https:\/\/www.foxnews.com\/politics\/biden-tells-black-voters-put-progressives-supreme-court-second-term\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">told<\/a><\/strong>&nbsp;a Philadelphia audience, \u201cThe next president, they\u2019re going to be able to appoint a couple justices, and I\u2019ll be damned \u2014 if in fact we\u2019re able to change some of the justices when they retire and put in really progressive judges like we\u2019ve always had, tell me that won\u2019t change your life.\u201d<\/p>\n\n\n\n<p>President Biden\u2019s promise was to appoint progressive jurors to the Supreme Court and since <a href=\"https:\/\/gunsamerica.com\/digest\/vice-president-harris-wants-soviet-style-price-fixing-what-could-she-do-to-guns\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\"  data-wpil-monitor-id=\"3785\">Vice President Harris<\/a> can\u2019t think of anything she\u2019d do different than the Biden administration, it\u2019s safe to assume her potential nominees would be cut from the same cloth.<\/p>\n\n\n\n<p>These aren\u2019t idle threats. Democrats introduced&nbsp;<strong><a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/democrats-introduce-bill-expand-supreme-court-9-13-justices-n1264132\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">legislation in 2021<\/a><\/strong>&nbsp;to expand the Court to 13 justices from nine, an open challenge to the Court\u2019s 6-3 conservative majority. Sen. Sheldon Whitehouse (D-R.I.) and Rep. Jamie Raskin (D-Md.)&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/scotus-court-packing-on-the-ballot-in-november\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">told media<\/a><\/strong>&nbsp;that wasn\u2019t wishful thinking. That was the plan should they take control of both chambers of Congress and The White House.&nbsp;Sen. Whitehouse introduced a bill last year that mirrors the Biden-Harris plan to upset the courts. It would limit Supreme Court terms to 18 years. The legislation calls for presidents to nominate a new justice to the Supreme Court every two years and appoint one of those nominated jurors with the advice and consent of the Senate. Only the nine most-recently appointed justices would sit for appellate cases.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-s-at-stake\">What\u2019s at Stake<\/h2>\n\n\n\n<p>That plan to restructure the Supreme Court could have significant impacts on the firearm industry and Second Amendment rights. The Supreme Court just recently agreed to hear&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/nssf-praises-scotus-decision-to-review-lawsuit-against-firearm-manufacturers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\"><em>Estados Unidos Mexicanos v. Smith &amp; Wesson Brands, Inc., et al.<\/em><\/a><\/strong>, the $10 billion frivolous lawsuit by Mexico against U.S. firearm manufacturers that threatens the survival of the firearm industry, Second Amendment rights and the sovereignty of U.S. law within our own borders. There are other significant cases in the wings too, including&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/nssf-reacts-to-scotus-denial-of-illinois-msr-ban-challenge\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"future-of-scotus-and-2a-on-2024-ballot\" title=\"Future of SCOTUS and 2A on 2024 Ballot!\">challenges to state bans<\/a><\/strong>&nbsp;on Modern Sporting Rifles (MSRs) and standard-capacity magazines.<\/p>\n\n\n\n<p>A Supreme Court that\u2019s threatened of its independence by lawmakers\u2019 political special interests would be devastating. That\u2019s why SCOTUS is on the ballot Nov. 5, along with control of Congress and The White House. Voters have already had significant impacts on the Court\u2019s composition, when President Barack Obama nominated now-U.S. Attorney General Merrick Garland the Supreme Court. Senate Majority Leader Mitch McConnell (R-Ky.) followed Senate tradition and declined to move the nomination forward with the election between former President Trump and former Senator and Secretary of State Hillary Clinton fast approaching.<\/p>\n\n\n\n<p>President Trump won that election. The vacancy on the Court was filled by Justice Neil Gorsuch. Other vacancies during his term were filled by originalist Justices Brett Kavanaugh and Amy Coney Barrett. President Biden nominated Garland to serve as U.S. Attorney General. He was confirmed by the U.S. Senate. Garland has used his perch to weaponize the Department of Justice, including the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) against the firearm industry.&nbsp;His open hostility toward the industry demonstrates clearly how he would have ruled on Second Amendment cases like&nbsp;<em>Bruen<\/em>&nbsp;had he joined the Supreme Court.<\/p>\n\n\n\n<p>Voters must take the threat to the independence of the Supreme Court seriously once again. No hyperbole. No exaggeration. The proof is there in the types of justices President Trump would nominate. A Republican majority in the Senate is critical for confirmations. A conservative majority in both chambers of Congress puts Rep. Omar\u2019s radical Court restructuring agenda to rest. Voters can\u2019t afford to risk their rights.
