Tamori Morgan<\/em><\/a>, where the court found that prohibiting the possession of machine guns violates the Second Amendment.<\/p>\n\n\n\n<p>William Kirk, President of <a href=\"https:\/\/www.washingtongunlaw.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-machine-gun-ban-declared-unconstitutional\" title=\"Federal Machine Gun Ban Declared Unconstitutional!\">Washington Gun Law<\/a>, broke down the ruling with palpable excitement. <\/p>\n\n\n\n<p>&#8220;We got a huge, and I mean a huge, ruling out of the United States District Court for the District of Kansas today,&#8221; said Kirk on Friday.  &#8220;They have found 18 United States Code, Section 922, Subsection O\u2014the prohibition against machine guns\u2014unconstitutional. Not making it up.&#8221;<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"The Huge Ruling That Says Machine Gun Bans Are Unconstitutional\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/dAY3jAmgGcM?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">Kirk breaks down the details.  <\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>The case involved Tamori Morgan, who was charged with possessing two automatic weapons: a 300 Blackout with a full-auto setting and a Glock equipped with a &#8220;switch.&#8221; <\/p>\n\n\n\n<p>The government argued that the 2A does not cover such firearms, citing the language in <em>Heller<\/em> that suggests machine guns are dangerous and unusual and thus could be restricted.<\/p>\n\n\n\n<p>Kirk explained that the court took a different approach, refusing to exclude modern weapons from 2A protections. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-california-must-issue-permits-to-non-residents\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/california-must-issue-permits-to-non-residents\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-machine-gun-ban-declared-unconstitutional\" title=\"Federal Machine Gun Ban Declared Unconstitutional!\">California Must Issue Permits to Non-Residents!<\/a><br \/><\/h2>\n\n\n\n<p>&#8220;The court here, however\u2014yeah, they did not fall into that trap,&#8221; he emphasized.<\/p>\n\n\n\n<p>Kirk also pointed out the significance of the <em>United States v. Miller<\/em> case, often cited to uphold bans on so-called &#8220;dangerous and unusual&#8221; weapons.<\/p>\n\n\n\n<p>He said:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>But the court very correctly points out, in relying upon <em>Miller<\/em>, &#8220;In <em>Miller<\/em>, the Supreme Court rejected a challenge to the National Firearm Act&#8217;s prohibition against carrying an unregistered sawed-off shotgun across state lines. Interestingly, over half of the opinion in <em>Miller<\/em> was devoted to explaining how in the years preceding and immediately following the enactment of the Second Amendment, one of the lawful purposes for which law-abiding citizens possess modern, for that era, firearms was for service in the militia. The court surveyed several laws from that era that not only permitted but essentially required law-abiding citizens to provide for their own use modern military-style small arms. Against that backdrop, the court concluded that a sawed-off shotgun was not the type of weapon that would be useful for military service.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p>The court also concluded that the mere possession of a machine gun, without any criminal intent or use, falls under the protection of the 2A. <\/p>\n\n\n\n<p>Kirk highlighted the court&#8217;s recognition that over 740,000 legally registered machine guns exist in the United States, noting, &#8220;If a mere 200,000 stun guns constitute &#8216;in common use&#8217; under <em>Caetano<\/em>, how much does over 740,000 lawfully registered machine guns constitute under the common use test?&#8221;<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">A machine gun possession charge was dismissed by a district court in Kansas yesterday on Second Amendment grounds. <br \/><br \/>The court found that machine guns are clearly bearable arms, and in this case at least, the government failed to show a historical tradition to justify their ban. <a href=\"https:\/\/t.co\/tCou5USFmE\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-machine-gun-ban-declared-unconstitutional\" title=\"Federal Machine Gun Ban Declared Unconstitutional!\">pic.twitter.com\/tCou5USFmE<\/a><\/p>&mdash; Kostas Moros (@MorosKostas) <a href=\"https:\/\/twitter.com\/MorosKostas\/status\/1826656903436623901?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-machine-gun-ban-declared-unconstitutional\" title=\"Federal Machine Gun Ban Declared Unconstitutional!\">August 22, 2024<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n\n\n\n<p>This ruling, however, is just the beginning. <\/p>\n\n\n\n<p>&#8220;This is a huge ruling, but it\u2019s not the end,&#8221; Kirk warned. &#8220;The appeal is probably being written as we speak.&#8221;<\/p>\n\n\n\n<p>No doubt it is.  But for now, this is a massive win for gun rights advocates.
