VanDerStok<\/a><\/em>, challenges the ATF\u2019s new \u201cFinal Rule\u201d that treats gun parts kits like fully assembled firearms.<\/p>\n\n\n\n<p>CCRKBA isn&#8217;t going it alone. They&#8217;ve teamed up with several big-name groups, including the Western States Sheriffs\u2019 Association, California Rifle and Pistol Association, and the National Association of Chiefs of Police. <\/p>\n\n\n\n<p>Top lawyers C.D. Michel from California and Dan M. ATF changed the definitions in its \u2018Final Rule,\u2019 essentially by administrative fiat on the grounds this is necessary for what it considers to be reasons of public policy. However, ATF knows, or at least should know, that public policy is determined by Congress, not ATF. This has become a problem with ATF under the Biden-Harris administration, as the agency has unilaterally tried to stretch its rule making authority.<\/p>\n\n\n\n<p>\u201cThe agency contends it needs to change the rules because it needs to trace firearms,\u201d he continued, \u201cbut as we note in our brief, there is no effective tracing by serial number now of guns purchased by criminals, and there hasn\u2019t been since the 1980s, because criminals don\u2019t get their guns by purchasing them from licensed dealers under their own names. The ATF knows this, yet they are attempting to expand their authority by dancing around Congress. We\u2019re confident the Supreme Court will not allow that to happen.\u201d<\/p>\n\n\n\n<p>Andrew Gottlieb, CCRKBA\u2019s Managing Director, was happy to see support from law enforcement. <\/p>\n\n\n\n<p>\u201cWe are especially happy that three law enforcement groups joined our amicus,\u201d said Andrew Gottlieb. \u201cTheir participation underscores the commitment law enforcement professionals have to the Second Amendment.\u201d<\/p>\n\n\n\n<p>This case is shaping up to be a major showdown with big implications for the future.
