After the Fourth Circuit Court of Appeals <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2024\/08\/06\/maryland-assault-weapons-ban-upheld\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fourth-circuit-upholds-marylands-awb\" title=\"Fourth Circuit Upholds Maryland's AWB\">upheld<\/a> Maryland&#8217;s &#8220;assault weapons&#8221; ban, SAF announced plans to take the fight to the Supreme Court. <\/p>\n\n\n\n<p>In <em>Bianchi v. Wilkinson<\/em>, SAF challenged this prohibition, rightly insisting it&#8217;s unconstitutional.<\/p>\n\n\n\n<p>SAF Executive Director Adam Kraut made it clear: \u201cWe will be filing a petition for certiorari at the Supreme Court, as this case presents an excellent vehicle for the Court to settle this debate once and for all.&#8221;<\/p>\n\n\n\n<p>The court&#8217;s 65-page <a href=\"https:\/\/www.ca4.uscourts.gov\/opinions\/211255.P.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"fourth-circuit-upholds-marylands-awb\" title=\"Fourth Circuit Upholds Maryland's AWB\">opinion<\/a> claimed certain black rifles aren&#8217;t protected by the Second Amendment because they&#8217;re &#8220;military-style weapons designed for sustained combat operations that are ill-suited and disproportionate to the need for self-defense.&#8221;<\/p>\n\n\n\n<p>Chief Judge Diaz, along with five other judges, supported this view.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-springfield-armory-s-new-1911-ds-prodigy-4-25-comp\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/springfield-armory1911-ds-prodigy-425-comp\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fourth-circuit-upholds-marylands-awb\" title=\"Fourth Circuit Upholds Maryland's AWB\">Springfield Armory\u2019s New 1911 DS Prodigy 4.25 Comp!<\/a><\/h2>\n\n\n\n<p>However, Judge Richardson, in a dissenting opinion joined by four other judges, fired back.<\/p>\n\n\n\n<p>\u201cThe Second Amendment is not a second-class right subject to the whimsical discretion of federal judges,&#8221; he wrote. &#8220;Its mandate is absolute and, applied here, unequivocal\u2026In holding otherwise, the majority grants states historically unprecedented leeway to trammel the constitutional liberties of their citizens.\u201d<\/p>\n\n\n\n<p>SAF isn&#8217;t alone in this battle. Joining them are the Citizens Committee for the Right to Keep and Bear Arms, Field Traders, LLC., the Firearms Policy Coalition, and three private citizens: David Snope, Micah Schaefer, and Dominic Bianchi, after whom the case is named.<\/p>\n\n\n\n<p>Alan M. Gottlieb, SAF founder and Executive Vice President, emphasized the flawed reasoning.<\/p>\n\n\n\n<p>\u201cThe court relied heavily on the distinction between \u2018military style\u2019 arms and those appropriate for self-defense use,&#8221; he explained. &#8220;This distinction runs completely contrary to the mandates of <em>Heller<\/em> and <em>Bruen<\/em>, and now sets the stage for another petition for SCOTUS review of the case.\u201d<\/p>\n\n\n\n<p>The fight continues as SAF prepares to take its case to the highest court in the land.
