Kenyatte Hassell (District 78) pre-filed HB23 this week, which aims to tighten regulations on so-called &#8220;assault weapons&#8221; in Alabama. <\/p>\n\n\n\n<p>The bill mandates individuals to obtain a permit to carry or purchase these firearms. It also introduces strict penalties for those who refuse to comply&#8230; You can become a <em>felon<\/em>!  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-key-provisions-of-hb23\"><strong>Key Provisions of HB23<\/strong><\/h2>\n\n\n\n<p>The bill defines an &#8220;assault weapon&#8221; as any semi-automatic rifle, pistol, or shotgun with specific features, such as the capacity to accept detachable magazines or a pistol grip and\/or folding stock.   <\/p>\n\n\n\n<p>It excludes antique firearms, inoperable firearms, and manually operated firearms.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-permit-requirements\"><strong>Permit Requirements<\/strong>!<\/h2>\n\n\n\n<p>Under <a href=\"https:\/\/alison.legislature.state.al.us\/files\/pdf\/SearchableInstruments\/2025RS\/HB23-int.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"assault-weapons-permits-in-alabama\" title=\"'Assault Weapons' Permits in Alabama?!\">HB23<\/a>, individuals must secure a permit to legally carry an assault weapon in a vehicle or on their person. <em>Surprise<\/em>! They also need a permit to purchase or acquire such weapons.<\/p>\n\n\n\n<p><strong>GOA: <a href=\"https:\/\/www.gunsamerica.com\/digest\/goa-she-hates-guns-more-than-you-think\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"assault-weapons-permits-in-alabama\" title=\"'Assault Weapons' Permits in Alabama?!\">She Hates Guns More Than You Think!<\/a><\/strong><\/p>\n\n\n\n<p>The bill grants a 90-day grace period for those acquiring assault weapons through inheritance to apply for a permit.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-application-process\"><strong>Application Process<\/strong><\/h2>\n\n\n\n<p>Applicants must apply to the sheriff in their county of residence for an assault weapon permit. The sheriff has the discretion to issue or renew the permit, following procedures similar to those for concealed carry permits. <\/p>\n\n\n\n<p>Fees and fund distribution for assault weapon permits will align with those for concealed carry permits.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-no-papers-big-problem\">No Papers, Big Problem! <\/h2>\n\n\n\n<p>Violating the permit requirements constitutes a Class C felony.  In other words, get caught without a permit and lose your 2A rights forever! <\/p>\n\n\n\n<p>Exceptions apply to law enforcement officers, military personnel, federal firearm license holders, and individuals on their own property, residence, or fixed place of business.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-effective-date\"><strong>Effective Date<\/strong><\/h2>\n\n\n\n<p>If passed, HB23 will become effective on October 1, 2025.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-rep-hassell-s-rationale\">Rep. Hassell&#8217;s Rationale <\/h2>\n\n\n\n<p>The Montgomery-based Democrat had this to say about HB23 in a recent interview with <a href=\"https:\/\/www.wsfa.com\/2024\/07\/31\/alabama-bill-would-require-permits-assault-weapons\/?outputType=amp\" target=\"_blank\" class=\"clickTracking\" campaign=\"assault-weapons-permits-in-alabama\" title=\"'Assault Weapons' Permits in Alabama?!\"><em>WBRC<\/em><\/a>. <\/p>\n\n\n\n<p>\u201cIf you\u2019re a law-abiding citizen, you can go get your permit and have this weapon,\u201d he said. <\/p>\n\n\n\n<p>\u201cI\u2019m not trying to take weapons away from everybody,&#8221; he continued. &#8220;It\u2019s just that some of these weapons get in the wrong hands and it\u2019s so wide open and free now that it\u2019s causing a lot of problems.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-conclusion\">Conclusion <\/h2>\n\n\n\n<p>Alabama is a Constitutional Carry <a href=\"https:\/\/www.gunsamerica.com\/digest\/alabama-ohio-become-22nd-23rd-state-to-enact-constitutional-carry\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"assault-weapons-permits-in-alabama\" title=\"'Assault Weapons' Permits in Alabama?!\">state<\/a>.  Law-abiding citizens don&#8217;t need a permit to carry firearms on their person.  It goes without saying but HB23 flies directly in the face of current law.  <\/p>\n\n\n\n<p>It&#8217;s doubtful that this bill will gain any traction in the heart of Dixie.  But I guess we&#8217;ll have to wait and see.
