In a big ruling this week, a U.S. District Court declared New Jersey\u2019s ban on AR-15 rifles unconstitutional while upholding the state\u2019s restriction on “large-capacity” magazines (LCMs). <\/p>\n\n\n\n

AR-15 Ban Overturned<\/strong><\/h2>\n\n\n\n

The court found New Jersey\u2019s ban on ARs violates the Second Amendment. The plaintiffs, including the Association of New Jersey Rifle and Pistol Clubs, argued the ban infringed on their right to bear arms for self-defense. <\/p>\n\n\n\n

The court agreed, citing that AR-15 rifles are commonly owned — the court noted there were roughly 24 million in circulation — and used for lawful purposes, including home defense.<\/p>\n\n\n\n

In his 69-page opinion<\/a>, Judge Peter G. Sheridan stated, \u201cPlaintiffs have shown that AR-15s are well-adapted for self-defense,\u201d later adding that “the AR-15 Provision of the Assault Firearms Law is unconstitutional for the Colt AR-15 for use for self-defense in the home.”<\/p>\n\n\n\n

This decision follows the precedent set by the Supreme Court in District of Columbia v. Heller<\/em>, which recognized an individual\u2019s right to possess firearms for lawful purposes such as self-defense.<\/p>\n\n\n\n

Firearms Policy Coalition (FPC), a plaintiff in the case, praised the decision on X.com<\/a>. <\/p>\n\n\n\n

\u201cBans on so-called \u2018assault weapons\u2019 are immoral and unconstitutional. FPC will continue to fight forward until all of these bans are eliminated throughout the United States,\u201d said FPC President Brandon Combs. <\/p>\n\n\n\n

The FPC has filed a notice of appeal to the Third Circuit to address legal deficiencies in the Court\u2019s opinion and seek the full relief requested. <\/p>\n\n\n\n

New Jersey, meanwhile, is expected to file its own appeal.<\/p>\n\n\n\n

Magazine Limits Upheld<\/strong><\/h2>\n\n\n\n

However, the court upheld New Jersey\u2019s law restricting LCMs to ten rounds, citing public safety concerns. <\/p>\n\n\n\n

The plaintiffs challenged this restriction, arguing it was an undue burden on their Second Amendment rights. <\/p>\n\n\n\n

The court, however, found the law constitutional, stating it strikes a balance between individual rights and reducing the potential harm in mass shootings.<\/p>\n\n\n\n

The ruling noted, \u201cState may regulate the permissible capacity of the large capacity magazines.\u201d<\/p>\n\n\n\n

Background of the Case<\/strong><\/h2>\n\n\n\n

This decision stems from consolidated cases challenging New Jersey\u2019s Assault Firearms Law. The plaintiffs argued that both the AR ban and the LCM restriction were unconstitutional. <\/p>\n\n\n\n

The court heard arguments in April 2024 and considered historical context, the Second Amendment\u2019s scope, and public safety data.<\/p>\n\n\n\n
