Speaking on Washington Gun Law (WGL) Youtube <a href=\"https:\/\/www.youtube.com\/@WashingtonGunLaw\" target=\"_blank\" class=\"clickTracking\" campaign=\"proof-that-the-atf-has-no-problem-killing-you\" title=\"Proof that the ATF Has No Problem Killing You\">channel<\/a> Kirk dissected the fatal ATF raid at Malinowski&#8217;s home in Arkansas.<\/p>\n\n\n\n<p>Kirk opened his talk by questioning the ATF&#8217;s approach.  Specifically, the WGL aptly framed it this way,  &#8220;The manner in which the ATF chose to execute the warrant, and in turn execute Mr. Malinowski, leaves all of us wondering \u2013 is this proof that the ATF will sometimes, just kill you?&#8221;<\/p>\n\n\n\n<p>Kirk described Malinowski&#8217;s involvement in selling firearms without background checks as &#8220;questionable activity&#8221; that likely provided probable cause for arrest. However, Kirk stressed the significance of how the ATF conducted the raid.<\/p>\n\n\n\n<p>&#8220;This is an organization which has really been let off the leash the last few years,&#8221; Kirk commented, pointing out the troubling implications of such unchecked power.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-some-gun-laws-are-stupid\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/jocko-some-gun-laws-are-stupid\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"proof-that-the-atf-has-no-problem-killing-you\" title=\"Proof that the ATF Has No Problem Killing You\">Some Gun Laws Are Stupid<\/a><\/h2>\n\n\n\n<p>He revealed that the ATF&#8217;s investigation, which began in December 2023, linked firearms sold by Malinowski to three crime scenes. Yet, Kirk highlighted the absence of violent crimes listed in the probable cause affidavit as a point of concern.<\/p>\n\n\n\n<p>Detailing the ATF&#8217;s tactics, Kirk described how they followed Malinowski&#8217;s daily routines closely, observing his firearm sales at gun shows and using informants to purchase arms illegally. Despite this extensive surveillance, Kirk criticized the decision to raid Malinowski&#8217;s home at 6:00 AM instead of arresting him during his regular activities.<\/p>\n\n\n\n<p>&#8220;The entire purpose of search warrants is to accumulate evidence of a crime, and of arrest warrants is to safely take individuals into custody,&#8221; Kirk explained. He lamented the lost opportunity to arrest Malinowski with minimal risk, questioning the ATF&#8217;s valuation of life.<\/p>\n\n\n\n<p>&#8220;Rather than pulling Mr. Malinowski over on a routine traffic stop, they chose to raid his house,&#8221; Kirk said. Malinowski, believing his home was being invaded, armed himself.  ATF agents subsequently engaged Malinowski.<\/p>\n\n\n\n<p>Highlighting the tragic outcome, Kirk said, &#8220;What happened to Mr. Malinowski? He warned against the over-policing of regulatory agencies like the ATF, asking, &#8220;What will the IRS do if its allowed to <a href=\"https:\/\/www.gunsamerica.com\/digest\/irs-to-hire-87000-agents-firearm-deadly-force-if-necessary\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"proof-that-the-atf-has-no-problem-killing-you\" title=\"Proof that the ATF Has No Problem Killing You\">arm all of their agents<\/a>?&#8221;<\/p>\n\n\n\n<p>In a chilling conclusion, Kirk accused the ATF&#8217;s leadership of being &#8220;rotten to the core,&#8221; showing a blatant disregard for human life. He assured viewers that this is not the end of the story and hinted at possible litigation by Malinowski surviving family members.  <\/p>\n\n\n\n<p>The episode ended with Kirk urging viewers to stay informed and educated about their rights.
