Huizenga, 'I buy ammo.  Am I on a List Somehow?'\">grilled<\/a><\/strong>&nbsp;the Treasury\u2019s Undersecretary for Terrorism and Financial Intelligence Brian Nelson and Director of the Financial Crimes Enforcement Network (FinCEN) Director Andrea Gacki in a hearing titled \u201cOversight of the Financial Crimes Enforcement Network (FinCEN) and the Office of Terrorism and Financial Intelligence (TFI).\u201d Several Members of Congress were pointed in their questions regarding admissions by the Treasury Department that it did, in fact, spy on law-abiding citizens\u2019 private financial transactions and internet search terms without their knowledge or suspicion of illegal activity.<\/p>\n\n\n\n<p>In other words, Treasury admitted they violated the Fourth Amendment rights against illegal search and seizure when they solicited transaction and internet search histories from corporate banks, which willingly complied. Bank of America has been&nbsp;<strong><a href=\"https:\/\/thehill.com\/homenews\/house\/4313936-jordan-subpoenas-bank-of-america-continuing-probe-into-bank-info-sharing-with-fbi\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"rep-huizenga-i-buy-ammo-am-i-on-a-list-somehow\" title=\"Rep. Huizenga, 'I buy ammo.  Am I on a List Somehow?'\">served a subpoena<\/a><\/strong>&nbsp;over private transaction histories, including firearm and ammunition purchases, without a warrant.<\/p>\n\n\n\n<p>Such an admission by the Treasury Department and corporate banks that willingly assisted is concerning that the federal government is violating Constitutional rights to put Americans on watchlists for exercising their rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-congress-wants-to-know\">Congress Wants to Know<\/h2>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"707\" src=\"https:\/\/www.gunsamerica.com\/digest\/wp-content\/uploads\/2024\/02\/U.S.-Rep.-Bill-Huizenga-R-Mich-1024x707.jpg\" alt=\"U.S. Rep. Bill Huizenga (R-Mich.) explained that the Treasury Department\u2019s admission it illegally spied on private accounts smacks of the ill-fated and illegal&nbsp;<a href=\"https:\/\/www3.nssf.org\/share\/factsheets\/PDF\/OperationChokePoint.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"rep-huizenga-i-buy-ammo-am-i-on-a-list-somehow\" title=\"Rep. Am I on a List Somehow?'\"><strong>Operation Choke Point<\/strong><\/a>, the Obama administration campaign to use the Department of Justice (DOJ) and the Federal Deposit Insurance Corporation (FDIC) to discriminate against firearm-related business by starving them of financial services.<\/p>\n\n\n\n<p>Only now, that effort is targeting the private financial transactions of Americans.<\/p>\n\n\n\n<p>\u201cThat doesn\u2019t matter what the what the name is,\u201d\u00a0<a href=\"https:\/\/youtu.be\/HAlGmDhq-tI?t=7171\" target=\"_blank\" class=\"clickTracking\" campaign=\"rep-huizenga-i-buy-ammo-am-i-on-a-list-somehow\" title=\"Rep. Huizenga directly addressed FinCEN\u2019s spying by surveilling Americans who purchase firearms and ammunition or shopped at Cabela\u2019s or Dick\u2019s Sporting Goods.<\/p>\n\n\n\n<p>\u201cI shop at Cabela\u2019s. I buy ammo. Am I on a list somehow?\u201d Rep. Huizenga asked. \u201cThat\u2026 that\u2019s what a lot of people, including myself, are asking when we\u2019ve heard this. Your agency was created to protect Americans and our national security, not to spy on them.\u201d<\/p>\n\n\n\n<p>Director Gacki responded only that her department would schedule a briefing with Rep. Huizenga\u2019s staff.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-guns-and-bibles\">Guns and Bibles<\/h2>\n\n\n\n<p>Rep. Ann Wagner (R-Mo.)&nbsp;<strong><a href=\"https:\/\/youtu.be\/HAlGmDhq-tI?t=7671\" target=\"_blank\" class=\"clickTracking\" campaign=\"rep-huizenga-i-buy-ammo-am-i-on-a-list-somehow\" title=\"Rep. Huizenga, 'I buy ammo.  Am I on a List Somehow?'\">pressed further<\/a><\/strong>, wanting to know where the Treasury Department\u2019s FinCEN drew the legal authority to justify a search of individual bank customer records. Director Gacki tried to say FinCEN has the authority from the Bank Secrecy Act, but Rep. Wagner said that law doesn\u2019t apply.<\/p>\n\n\n\n<p>\u201cBut that ma\u2019am it is for terrorism and money laundering, not legal purchases made by a United States citizen,\u201d Rep. Wagner said. \u201cAbsent a warrant, Ms. Gacki, my constituents\u2026 should not have their legal purchases \u2026. becoming the knowledge of federal regulators like FinCEN, or any warrants issued by a judge, any subpoenas issued by a court or any legal opinion provided by your general counsel about legal requirements under which banks would be required to provide this type of information, ma\u2019am.\u201d<\/p>\n\n\n\n<p>Director Gacki parried by saying FinCEN\u2019s searches began under the Trump administration but didn\u2019t say that it was a search that President Donald Trump himself knew of. She explained that those key term searches, including \u201cTrump\u201d or \u201cMAGA\u201d or purchase histories of firearms, ammunition and even Bibles, continued with the Biden administration. Just one week ago, Treasury Secretary Yellen&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/treasury-secretarys-evasive-answers-remind-of-need-for-second-amendment-privacy\/?utm_source=grupdate\" target=\"_blank\" class=\"clickTracking\" campaign=\"rep-huizenga-i-buy-ammo-am-i-on-a-list-somehow\" title=\"Rep. Huizenga, 'I buy ammo.  Am I on a List Somehow?'\"><strong>refused to tell<\/strong>&nbsp;<strong>Congress<\/strong><\/a>&nbsp;that FinCEN did, in fact, spy on Americans\u2019 private financial transactions and key search terms.<\/p>\n\n\n\n<p>\u201cBible? Gun violence? Those are our gun purchases,\u201d Rep. Wager asked of the breadth of the FinCEN\u2019s surveillance. \u201cYou know, I\u2019m trying to understand here, these are legal purchases. These have nothing to do with terrorism, or money laundering or anything that would come under data, privacy and such. You know, were there warrants issued by a judge or a court that required them to provide this information?\u201d<\/p>\n\n\n\n<p>Director Gacki didn\u2019t answer, instead referring Rep. Wagner to the DOJ. Rep. Wagner said the American public deserves transparency on this issue.<\/p>\n\n\n\n<p>\u201cAnd I want FinCEN and Treasury to come forward before this committee, before our members, before the people of the United States of America and explain how it is that that the federal government and Treasury and arms of treasury are asking for information from banks about legal purchases that may be politically-triggered, that may be triggered by the fact that they\u2019re purchasing a firearm, or religiously-triggered by the purchase of a Bible.\u201d she said. \u201cI am not happy with any of the answers that I\u2019ve received.
