The Second Amendment Foundation (SAF), joined by its partners, is making headlines with a petition to the U.S. Supreme Court. They’re seeking a review of Illinois’ ban<\/a> on modern semi-auto firearms and “large-capacity magazines” in the pivotal case of Harrel v. Raoul<\/a><\/em>.<\/p>\n\n\n\n

Attorneys David Thompson, Peter Patterson, and Will Bergstrom of Cooper & Kirk, PLLC, along with David Sigale of Wheaton, IL, are spearheading the legal challenge. <\/p>\n\n\n\n

The group, which includes the Illinois State Rifle Association, Firearms Policy Coalition, Inc., C4 Gun Store, LLC, Marengo Guns, Inc., and private citizen Dane Harrel, initially filed the federal complaint in January 2023.<\/p>\n\n\n\n

SAF’s founder and Executive Vice President, Alan M. Gottlieb, declared the Illinois gun and magazine bans unconstitutional. He referenced the landmark Heller<\/em> and Bruen<\/em> decisions, which protect firearms that are in common use. <\/p>\n\n\n\n

“It is indisputable that modern semiautomatic rifles and magazines holding more than ten cartridges are in common use by tens of millions of U.S. citizens,” Gottlieb stated, emphasizing that such a ban is, according to the high court’s own words, ‘off the table.'”<\/p>\n\n\n\n

Adam Kraut, SAF’s Executive Director, outlined the crucial questions at the heart of the case. These focus on whether the Constitution allows the government to prohibit citizens from using semi-automatic firearms and commonly-owned magazines for self-defense.<\/p>\n\n\n\n

With similar cases pending in other jurisdictions, Kraut stressed the importance of the Supreme Court’s acceptance of this case for review.<\/p>\n\n\n\n

The petition aims to correct what SAF perceives as lower courts’ disregard for the Supreme Court’s directives on the 2A. <\/p>\n\n\n\n

Gottlieb and Kraut are determined to advance firearms freedom through strategic litigation, and this case could set significant precedents for gun rights in America.<\/p>\n\n\n\n
