Michelle Lujan Grisham\u2019s State of the State address. At the top of her agenda, like the Biden administration, is punishing the firearm industry with unconstitutional gun control measures.<\/p>\n\n\n\n<p>Gov. Lujan Grisham is vowing to go further than she did last year when she infamously made an emergency order denying Second Amendment rights in parts of Albuquerque and Bernalillo County. She\u2019s got a limited window, as the state\u2019s legislative session is short.<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">All New Mexicans deserve to be safe in their communities, which is why we&#39;re requiring a 14-day waiting period for the purchase of firearms, banning assault weapons, and raising the purchase age to 21 for all firearms. \ud83e\uddf5[10\/13] <a href=\"https:\/\/t.co\/HpClloAzlC\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Grisham revealed her \u201c<a href=\"https:\/\/www.nssf.org\/articles\/new-mexicos-governor-reveals-empirical-ambitions-constitutional-contempt\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>imperial ambitions<\/strong><\/a>.\u201d She created a Constitutional crisis after publishing a 30-day emergency public health order banning the carrying of firearms in Bernalillo County on public property. The governor\u2019s edict ordered the state\u2019s Regulation and Licensing Division to conduct monthly inspections of licensed firearm retailers to ensure compliance with all sales and storage laws despite there being no New Mexico statute, nor any state regulations, granting the state authority over compliance or storage requirements.<\/p>\n\n\n\n<p>National and state bipartisan backlash was swift,&nbsp;<strong><a href=\"https:\/\/apnews.com\/article\/albuquerque-guns-governor-concealed-carry-firearms-reject-ec5e8d57abc15687dd1b39d8cc197d96\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\">forcefully<\/a><\/strong>&nbsp;and&nbsp;<strong><a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/new-mexico-governor-grishams-gun-ban-draws-bipartisan-backlash-rcna104500\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\">roundly criticized<\/a><\/strong>&nbsp;the governor\u2019s overreach. A judge placed a temporary restraining order on the concealed and public carry provisions of the public health order and Gov. Lujan Grisham was forced to recalibrate. She hasn\u2019t learned.<\/p>\n\n\n\n<p>During her State of the State address, she&nbsp;<a href=\"https:\/\/nmpoliticalreport.com\/nmleg\/lujan-talks-public-safety-economy-and-more-during-state-of-the-state\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>spoke out of both sides of her mouth<\/strong><\/a>.<\/p>\n\n\n\n<p>\u201cNo responsible gun owner should be punished or prevented from exercising their rights \u2013 and no child should ever be put in danger by a weapon of war, especially one wielded by a person who can\u2019t pass a background check, or can\u2019t wait two weeks to get a firearm,\u201d Gov. Lujan Grisham said. She&nbsp;<strong><a href=\"https:\/\/sourcenm.com\/2024\/01\/17\/n-m-gov-prioritizes-new-gun-law-proposals\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\">added<\/a>,<\/strong>&nbsp;\u201cPreventing gun violence is the most important work we\u2019re going to do.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-industry-attacks-ahead\">Industry Attacks Ahead<\/h2>\n\n\n\n<p>The New Mexico legislature session this year is just 30 legislative days. In a short session like this, the legislative business must be focused on budget issues. That is, of course, unless you\u2019re the governor who gets to add her own \u201crelated or germane\u201d pet issues.<\/p>\n\n\n\n<p>Her so-called \u201cgun safety\u201d\u00a0<a href=\"https:\/\/sourcenm.com\/2024\/01\/17\/n-m-gov-prioritizes-new-gun-law-proposals\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>wish list is long<\/strong><\/a>. She wants to ban commonly-owned Modern Sporting Rifles (MSRs), or \u201cweapons of war\u201d as the governor misleadingly calls them. NSSF released updated data showing there are over\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/nssf-releases-most-recent-firearm-production-figures-2024\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>28 million<\/strong><\/a>\u00a0MSRs in circulation since 1990, used daily for lawful purposes. The governor also wants to impose a 14-day waiting period on all firearm purchases before the owner \u2013 who has passed an FBI National Instant Criminal Background Check System (NICS) verification \u2013 can take their firearm home. <\/p>\n\n\n\n<p>She also wants to enact age-based gun bans by raising the minimum age to purchase all firearms up to 21, meaning adults over 18 could no longer purchase shotguns or rifles. Gov. Lujan Grisham also wants to expand prohibited spaces where law-abiding and licensed gun owners could carry their firearms, to exclude public playgrounds and parks, as well as impose other restrictions. An additional 11 percent excise tax on all firearms, accessories and ammunition is on deck to feed a \u201cgun violence victims reparation fund.\u201d That\u2019s a government imposed \u201csin tax\u201d blaming the firearm industry for the criminal misuse of firearms that would only increase the cost to law-abiding gun purchasers, assuming the industry doesn\u2019t abandon the New Mexico market entirely to avoid crushing liability.<\/p>\n\n\n\n<p>All those restrictions are not followed by criminals who commit violent crimes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-crushing-the-firearm-industry\">Crushing the Firearm Industry<\/h2>\n\n\n\n<p>In addition to all of those restrictions, Gov. Lujan Grisham\u2019s most consequential proposal would sound the&nbsp;<a href=\"https:\/\/www.thetruthaboutguns.com\/more-gun-control-in-the-not-so-land-of-enchantment\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>death knell for the firearm industry<\/strong><\/a>&nbsp;in the Land of Enchantment.&nbsp;<strong><a href=\"https:\/\/www.breitbart.com\/2nd-amendment\/2024\/01\/13\/new-mexico-gov-grisham-pushes-lawsuits-gun-makers-2-week-waiting-period-firearm-purchases\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\">House Bill 114<\/a><\/strong>, introduced by New Mexico state Representative and House Judiciary Chair Christine Chandler, targets the already heavily-regulated firearm industry by opening the floodgates for potential litigation intended to make it impossible to remain in business in New Mexico.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.nmlegis.gov\/Legislation\/Legislation?Chamber=H&amp;LegType=B&amp;LegNo=114&amp;year=24\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>HB 114<\/strong><\/a>&nbsp;is the governor\u2019s attempt to pass a firearm industry liability law that directly conflicts with the federal Protection of Lawful Commerce in Arms Act (PLCAA), which prevents frivolous lawsuits against the firearm industry from the damages caused by the criminal acts of remote third parties. The New Mexico industry liability proposal would make it nearly impossible for firearm manufacturers or retailers to stay in business.<\/p>\n\n\n\n<p>The governor\u2019s anti-industry liability proposal creates the unique crime of \u201cfalsely advertising\u201d a firearm product, which is not the same as \u201can unconscionable or unfair trade practice\u201d that is already law in the state. This could be applied to an industry member claiming a firearm is effective for home defense, despite evidence of\u00a0<a href=\"https:\/\/reason.com\/2022\/09\/09\/the-largest-ever-survey-of-american-gun-owners-finds-that-defensive-use-of-firearms-is-common\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\"><strong>millions of incidents<\/strong><\/a>\u00a0of annual defensive gun use and the U.S. Supreme Court\u2019s holding in\u00a0<em>Heller<\/em>\u00a0that the Second Amendment protects the right to keep a firearm in one\u2019s home for self-defense.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-sk-customs-unleashes-michelangelo-in-renaissance-firearm-series\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/sk-customs-unleashes-michelangelo-in-renaissance-firearm-series\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov. Trying to Eliminate Firearm Industry Under the Guise of Budget\">SK Customs Unleashes \u2018Michelangelo\u2019 in Renaissance Firearm Series<\/a><\/h2>\n\n\n\n<p>Additionally, HB 114 creates a \u201charming the public\u201d civil violation applicable only to the firearms industry, establishes duplicative state requirements for practices and protocols that firearm industry members already have in place and authorizes the New Mexico Attorney General or a district attorney to bring an action against any member of the firearm industry by alleging violations (or potential violations) of these new, vague provisions of law. This includes allowing any person \u201clikely to be harmed\u201d by the actions of a firearm industry member to request equitable relief from a court.<\/p>\n\n\n\n<p>If there were any doubts about whether Gov. Lujan Grisham was acting in bad faith to completely demolish the firearm industry, HB 114 puts them to rest and confirms beyond question her anti-Second Amendment goals.<\/p>\n\n\n\n<p>With less than 30 legislative days remaining, the work on the governor\u2019s gun control agenda has already begun. The firearm industry in New Mexico must stay vigilant and speak out against Gov. Lujan Grisham\u2019s unconstitutional aims. Her proposals would not increase public safety and instead would only embolden criminals bent on ignoring laws from the get-go.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:24px\"><strong><em>*** <a href=\"https:\/\/gunsamerica.com\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-mexico-gov-trying-to-eliminate-firearm-industry-under-the-guise-of-budget\" title=\"New Mexico Gov.
