He had no time to react before being hit in the head with the intruder\u2019s gun.<\/p>\n\n\n\n<p>\u201cHe hit me in the head,\u201d Smith said. \u201cI yelled out \u2018he is robbing me!\u2019 thinking my neighbors would hear me.\u201d<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/fox59.com\/news\/indycrime\/indy-homeowner-says-he-fought-off-intruder-killed-him-with-his-own-gun\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"homeowner-wrestles-intruder-for-gun-before-fatal-gunfight\" title=\"Homeowner Wrestles Intruder For Gun Before Fatal Gunfight\u00a0\"><em>Fox 59<\/em><\/a>, Smith fought back, wrestling his attacker for the gun. During the fight, the two smashed into a glass table.<\/p>\n\n\n\n<p>\u201cIt was like a movie,\u201d Smith said. \u201cMe and him wrestling over the gun.\u201d<\/p>\n\n\n\n<p>According to <a href=\"https:\/\/fox59.com\/news\/indycrime\/indy-homeowner-says-he-fought-off-intruder-killed-him-with-his-own-gun\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"homeowner-wrestles-intruder-for-gun-before-fatal-gunfight\" title=\"Homeowner Wrestles Intruder For Gun Before Fatal Gunfight\u00a0\"><em>Fox 59<\/em><\/a>, Smith \u201cshot the intruder with the suspect\u2019s own gun.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-scary-encounter-turns-fatal\">Scary Encounter Turns Fatal<\/h2>\n\n\n\n<p>The suspect, 22-year-old Damon Swanigan Jr, was in the doorway of the home when the bullet hit him with a fatal shot.\u00a0<\/p>\n\n\n\n<p>\u201cAt this time,\u201d Smith said, \u201cI started hearing what felt like thousands of shots.\u201d<\/p>\n\n\n\n<p>Using first the intruder\u2019s gun and then his own, Smith exchanged gunfire with suspects outside. <\/p>\n\n\n\n<p>\u201cI didn\u2019t even think them or me,\u201d Smith said. \u201cI was just basically trying to survive myself man.\u201d<\/p>\n\n\n\n<p>Eventually, the suspects on the street drove away, leaving the home with broken glass from doors and car windows.&nbsp;<\/p>\n\n\n\n<p>Smith explained he was frustrated with the behavior of the suspects. <\/p>\n\n\n\n<p>\u201cThe first thing I noticed was the kid had on brand new Jordans,\u201d Smith said. \u201cYou&#8217;re trying to rob me but you got brand new Jordans on man? I just don&#8217;t get it.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-a-good-state-for-it\">A Good State For It<\/h2>\n\n\n\n<p>Police detained Smith and questioned him overnight.  But Smith was released the next day.\u00a0<\/p>\n\n\n\n<p>Investigators are still looking for Swanigan&#8217;s accomplices.   <\/p>\n\n\n\n<p><a href=\"https:\/\/www.wrtv.com\/news\/local-news\/crime\/i-shot-him-with-his-own-gun-homeowner-reflects-on-shooting-inside-home-during-home-invasion\" target=\"_blank\" class=\"clickTracking\" citizens to defend themselves, including the use of lethal force, if necessary, to prevent a forcible felony. <\/p>\n\n\n\n<p>Under this law, residents who engage in self-defense, even when it results in a fatality, are not automatically subject to criminal charges.<\/p>\n\n\n\n<p>In contrast, other states often have more stringent requirements for self-defense claims. <\/p>\n\n\n\n<p>These may include the need for proof that the resident feared for their life or stipulations that the victim must first attempt to escape the situation before resorting to self-defense.<\/p>\n\n\n\n<p>On that fateful day, Brent Smith was thrust into a perilous situation but stood his ground, effectively using his right to self-defense. <\/p>\n\n\n\n<p>His actions, driven by the necessity to protect himself
