<\/p>\n\n\n\n<p>To keep &#8220;public safety measures&#8221; intact during the appeals process. <\/p>\n\n\n\n<p>\u201cIn the past half-century, large-capacity magazines have been used in about three-quarters of gun massacres with 10 or more deaths and in 100 percent of gun massacres with 15 or more deaths,\u201d&nbsp;said Attorney General Bonta in a <a href=\"https:\/\/oag.ca.gov\/news\/press-releases\/attorney-general-bonta-files-motion-stay-dangerous-district-court-decision\" target=\"_blank\" class=\"clickTracking\" campaign=\"bonta-files-motion-to-stay-decision-overturning-californias-mag-ban\" title=\"Bonta Files Motion to Stay Decision Overturning California\u2019s Mag Ban\">press release <\/a>obtained by GunsAmerica. <\/p>\n\n\n\n<p>\u201cWe will continue to fight&nbsp;for California\u2019s authority to keep our communities safe from weapon enhancements that cause mass casualties,&#8221; he added. <\/p>\n\n\n\n<p>Contrary to this, U.S. District Judge Roger Benitez ruled against the magazine limit. <\/p>\n\n\n\n<p>Benitez claims there\u2019s no American precedent for ammo capacity limits, pointing out the utility of detachable magazines in addressing the challenge of reloading<\/p>\n\n\n\n<p>In his decision, Benitez wrote \u201cthere is no American tradition of limiting ammunition capacity.\u201d <\/p>\n\n\n\n<p>\u201cThere have been, and there will be, times where many more than 10 rounds are needed to stop attackers,\u201d Benitez added. \u201cYet, under this statute, the State says \u2018too bad.\u2019\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-ryan-busse-strikes-again-democratic-candidate-for-montana-governor\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/ryan-busse-strikes-again-democratic-candidate-for-montana-governor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bonta-files-motion-to-stay-decision-overturning-californias-mag-ban\" title=\"Bonta Files Motion to Stay Decision Overturning California\u2019s Mag Ban\">Ryan Busse Strikes Again: Democratic Candidate For Montana Governor?<\/a><\/h2>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"California law banning gun magazines of more than 10 rounds struck down by federal judge\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/weXWUWedjus?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><figcaption class=\"wp-element-caption\">Local media coverage via <em>CBS 13<\/em>.<\/figcaption><\/figure>\n\n\n\n<p>Bonta countered, arguing that magazines exceeding 10 rounds aren&#8217;t essential for personal defense.<\/p>\n\n\n\n<p>Interestingly, this isn&#8217;t the first time Benitez has contested California&#8217;s law. <\/p>\n\n\n\n<p>He did the<a href=\"https:\/\/www.gunsamerica.com\/digest\/magazines-flooding-california-ruling\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"bonta-files-motion-to-stay-decision-overturning-californias-mag-ban\" title=\"Bonta Files Motion to Stay Decision Overturning California\u2019s Mag Ban\"> same in 2019<\/a>, but an appellate court reversed his decision. However, the U.S. Supreme Court&#8217;s recent shift in interpreting gun laws vis a vis the <em>Bruen<\/em> <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"bonta-files-motion-to-stay-decision-overturning-californias-mag-ban\" title=\"Bonta Files Motion to Stay Decision Overturning California\u2019s Mag Ban\">decision<\/a> has reignited the debate.<\/p>\n\n\n\n<p>This Supreme Court stance focuses more on the historical tradition of gun regulations. <\/p>\n\n\n\n<p>As a result, California&#8217;s gun laws face three major challenges in court. The upcoming hearings will also address the state&#8217;s bans on so-called &#8220;assault weapons&#8221; and ammunition purchase limits.<\/p>\n\n\n\n<p>While Bonta defends safety and tradition, Chuck Michel, president of the California Rifle and Pistol Association, applauds Benitez&#8217;s &#8220;in-depth approach.&#8221; <\/p>\n\n\n\n<p>Michel believes that time is running out for laws he deems unconstitutional.<\/p>\n\n\n\n<p>\u201cSure, the state will appeal, but the clock is ticking on laws that violate the Constitution,\u201d Michel told local news affiliate <a href=\"https:\/\/www.kcra.com\/article\/california-law-banning-high-capacity-gun-magazines-struck-by-judge\/45272018#\" target=\"_blank\" class=\"clickTracking\" campaign=\"bonta-files-motion-to-stay-decision-overturning-californias-mag-ban\" title=\"Bonta Files Motion to Stay Decision Overturning California\u2019s Mag Ban\"><em>KCRA<\/em><\/a>.<\/p>\n\n\n\n<p>The case continues to evolve, with Californians awaiting a conclusive decision.
