of selling firearms. This clarification determines who needs to acquire a license and conduct background checks.<\/p>\n\n\n\n<p>The aim? <\/p>\n\n\n\n<p>To align with the<a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2938\/text\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-doj-updates-definition-of-engaged-in-the-business-as-a-firearms-dealer\" title=\"BREAKING: DOJ to Update Definition of 'Engaged in the Business' as a Firearms Dealer\"> Bipartisan Safer Communities Act <\/a>(BSCA) from June 25, 2022, which broadens the firearms dealer definition. <\/p>\n\n\n\n<p>The BSCA covers those who, in regular trade, aim mainly to profit from repeated firearms sales.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-president-biden-s-directive\"><strong>President Biden&#8217;s Directive<\/strong><\/h2>\n\n\n\n<p>On March 14, President Biden&#8217;s Executive Order 14092 tasked the Attorney General with clarifying this definition. <\/p>\n\n\n\n<p>This proposed rule intends to modify the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regulations, aligning with the BSCA and shedding light on what exactly necessitates a license.<\/p>\n\n\n\n<p>Attorney General Merrick B. Garland emphasized Congress&#8217;s intentions.<\/p>\n\n\n\n<p>&nbsp;\u201cThe Bipartisan Safer Communities Act was passed by Congress to reduce gun violence, including by expanding the background checks that keep guns out of the hands of criminals,&#8221; he said in a <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-proposes-new-regulation-update-definition-engaged-business-firearms\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-doj-updates-definition-of-engaged-in-the-business-as-a-firearms-dealer\" title=\"BREAKING: DOJ to Update Definition of 'Engaged in the Business' as a Firearms Dealer\">statement<\/a>. <\/p>\n\n\n\n<p><strong>SEE ALSO:<a href=\"https:\/\/www.gunsamerica.com\/digest\/fbi-agents-kill-another-veteran-in-pre-dawn-raid-family-demands-answers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-doj-updates-definition-of-engaged-in-the-business-as-a-firearms-dealer\" title=\"BREAKING: DOJ to Update Definition of 'Engaged in the Business' as a Firearms Dealer\"> FBI Agents Kill Another Veteran in Pre-Dawn Raid, Family Demands Answers<\/a><\/strong><\/p>\n\n\n\n<p>\u201cThis proposed rule implements Congress\u2019s mandate to expand the definition of who must obtain a license and conduct a background check before selling firearms,&#8221; Garland continued. <\/p>\n\n\n\n<p>ATF Director Steven Dettelbach expressed concern about the rise of unregistered firearms sellers.<\/p>\n\n\n\n<p>\u201cAn increasing number of individuals engaged in the business of selling firearms for profit have chosen not to register as federal firearms licensees, as required by law,\u201d said Dettelbach. <\/p>\n\n\n\n<p>\u201cInstead, they have sought to make money through the off-book, illicit sale of firearms. These activities undermine the law, endanger public safety, create significant burdens on law enforcement, and are unfair to the many licensed dealers who make considerable efforts to follow the law,&#8221; he added. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-the-new-rule-seeks-to-clarify-engaged-in-the-business\"><strong>How The New Rule Seeks To Clarify &#8220;Engaged in The Business<\/strong>&#8220;<\/h2>\n\n\n\n<p>The NPRM specifically proposes to clarify when a person is \u201cengaged in the business\u201d as a dealer in firearms at wholesale or retail by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Clarifying the definition of \u201cdealer\u201d and defining the terms \u201cpurchase\u201d and \u201csale\u201d as they apply to dealers;<\/li>\n\n\n\n<li>Clarifying when a person would not be engaged in the business of dealing in firearms as an auctioneer, or when purchasing firearms for, and selling firearms from, a personal collection;<\/li>\n\n\n\n<li>Setting forth conduct that is presumed to constitute \u201cengaging in the business\u201d of dealing in firearms, and presumed to demonstrate the intent to \u201cpredominantly earn a profit\u201d from the sale or disposition of firearms, absent reliable evidence to the contrary;<\/li>\n\n\n\n<li>Clarifying that the intent to \u201cpredominantly earn a profit\u201d does not require the person to have received pecuniary gain and that intent does not have to be shown when a person purchases or sells a firearm for criminal or terrorism purposes;<\/li>\n\n\n\n<li>Adding a single definition for the term \u201cpersonal collection, personal collection of firearms, or personal firearms collection\u201d and adding a definition for the term \u201cresponsible person\u201d;<\/li>\n\n\n\n<li>Addressing how former licensees, and responsible persons acting on behalf of former licensees, may lawfully liquidate business inventory upon revocation or other termination of their license; and<\/li>\n\n\n\n<li>Clarifying that licensees must follow the verification and recordkeeping procedures in 27 CFR&nbsp;<a href=\"https:\/\/regulations.atf.gov\/478-94\/2023-01001#478-94\" target=\"_blank\" class=\"clickTracking\" campaign=\"breaking-doj-updates-definition-of-engaged-in-the-business-as-a-firearms-dealer\" title=\"BREAKING: DOJ to Update Definition of 'Engaged in the Business' as a Firearms Dealer\">478.94<\/a>&nbsp;and Subpart H, rather than using an ATF Form 4473 when firearms are transferred to other licensees, including transfers by a licensed sole proprietor to that person\u2019s personal collection.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-public-participation\"><strong>Public Participation<\/strong><\/h2>\n\n\n\n<p>Once officially published in the Federal Register, the public can give feedback on the proposal for 90 days.
