JB Pritzker signed the Firearm Industry Responsibility Act (FIRA) into law.<\/p>\n\n\n\n<p>This legislation, enacted at the <a href=\"https:\/\/www.gunsamerica.com\/digest\/watch-kamala-harris-tells-young-anti-2a-activists-they-are-critical-five-times-in-10-seconds\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-slapped-with-lawsuit-over-law-attacking-1a-rights\" title=\"Illinois Slapped with Lawsuit Over Law Attacking 1A Rights\">&#8220;Gun Sense University&#8221; conference<\/a> on Saturday, aims to hold gun manufacturers accountable for &#8220;unsafe marketing practices.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-pritzker-s-comment\">Pritzker&#8217;s Comment<\/h2>\n\n\n\n<p>&#8220;Today, I proudly signed the Firearm Industry Responsibility Act (FIRA) into law \u2014 finally holding gun manufacturers accountable for endangering the public safety and health of our people,&#8221;&nbsp;said Governor JB Pritzker in a <a href=\"https:\/\/gov.illinois.gov\/news\/press-release.26881.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-slapped-with-lawsuit-over-law-attacking-1a-rights\" title=\"Illinois Slapped with Lawsuit Over Law Attacking 1A Rights\">press release.<\/a> <\/p>\n\n\n\n<p>&#8220;We hold opioid manufacturers accountable. Vaping companies accountable. Predatory lenders accountable. Gun manufacturers shouldn&#8217;t get to hide from the law\u2014and now, they won&#8217;t be able to,&#8221; he continued.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-fira-works\">How FIRA Works<\/h2>\n\n\n\n<p>Attorney General Kwame Raoul echoed this sentiment, emphasizing that no industry should evade consequences for &#8220;unlawful, unfair or deceptive conduct.&#8221; <\/p>\n\n\n\n<p><strong>WATCH: <a href=\"https:\/\/www.gunsamerica.com\/digest\/watch-kamala-harris-tells-young-anti-2a-activists-they-are-critical-five-times-in-10-seconds\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-slapped-with-lawsuit-over-law-attacking-1a-rights\" title=\"Illinois Slapped with Lawsuit Over Law Attacking 1A Rights\">Kamala Harris Tells Young Anti-2A Activists They Are \u2018Critical\u2019 Five Times in 10 Seconds<\/a><\/strong><\/p>\n\n\n\n<p>He added that FIRA would enhance his office&#8217;s ability to protect the public using the Consumer Fraud and Deceptive Business Practices Act.<\/p>\n\n\n\n<p>FIRA, known formally as <a href=\"https:\/\/legiscan.com\/IL\/text\/HB0218\/id\/2813128\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-slapped-with-lawsuit-over-law-attacking-1a-rights\" title=\"Illinois Slapped with Lawsuit Over Law Attacking 1A Rights\">HB 218,<\/a> focuses on preventing gun manufacturers from employing &#8220;dangerous marketing techniques.&#8221; This includes advertising that supports unlawful &#8220;militia activity&#8221; and targeting ads with cartoons or stuffed animals at children under 18.<\/p>\n\n\n\n<p>Earlier this year, Gov. The National Shooting Sports Foundation, the firearm industry trade association swiftly filed a legal challenge, arguing that the new law infringes upon their First Amendment rights.<\/p>\n\n\n\n<p>Lawrence G. Keane, NSSF\u2019s Senior Vice President and General Counsel, voiced strong opposition, labeling the law as unconstitutional and criticizing its impact on legal firearm manufacturers and retailers.<\/p>\n\n\n\n<p>\u201cThe flawed logic of this unconstitutional law is second only to the contempt for which the authors and Governor Pritzker hold for the Constitutionally-protected right of the citizens of his state to keep and bear arms,\u201d said Keane. \u201cThis law bans commercial free speech, which is protected by the First Amendment.&#8221;<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/illinois-supreme-court-upholds-black-rifle-ban-saf-federal-challenge-continues\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"illinois-slapped-with-lawsuit-over-law-attacking-1a-rights\" title=\"Illinois Slapped with Lawsuit Over Law Attacking 1A Rights\">Illinois Supreme Court Upholds Black Rifle Ban; SAF Federal Challenge Continues<\/a><\/strong><\/p>\n\n\n\n<p>Among his criticisms is the law&#8217;s alleged ambiguity in defining what constitutes &#8220;intent to appeal to minors&#8221; in advertising and the shifting of responsibility for illegal actions from criminals to businesses.<\/p>\n\n\n\n<p>The firearm industry highlights its collaboration with the ATF and the Justice Department to prevent illegal purchases. They argue that while they are doing their part, this new law unfairly places the burden of criminal actions on them.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-irony-of-the-firearm-industry-responsibility-act\">The Irony of  the Firearm Industry Responsibility Act <\/h2>\n\n\n\n<p>&#8220;The irony is that the firearm industry works hand-in-hand with the ATF and Justice Department to prevent illegal straw purchases of firearms while the governor signs laws that set criminals free on the streets to prey on the innocent citizens of Illinois,&#8221; said Keane.<\/p>\n\n\n\n<p>&#8220;Just like Governor Pritzker\u2019s signature on a law banning cash bail, this law empowers criminals and punishes those who obey the law. We are confident that this unconstitutional law will not survive,&#8221; he added. <\/p>\n\n\n\n<p>This law is now in effect, with the ensuing legal battles and its long-term impact on Illinois gun legislation yet to unfold.
