The decision came with a close 5-4 vote.<\/p>\n\n\n\n<p>Previously, the Fifth Circuit believed the rule might be unconstitutional. But the Supreme Court&#8217;s recent decision means the rule can be enforced for now. The case is still ongoing in the courts.<\/p>\n\n\n\n<p>The Second Amendment Foundation (SAF) has joined the case, named <a href=\"https:\/\/www.firearmspolicy.org\/vanderstok\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-lets-bidens-frame-receiver-rule-stand\" title=\"Supreme Court Let's Biden's Frame, Receiver Rule Stand...\"><em>VanDerStok v. Garland<\/em>,<\/a> as a plaintiff. This stay will continue until the case&#8217;s final resolution. If the case moves to the Supreme Court and they agree to hear it, the stay remains.<\/p>\n\n\n\n<p>Adam Kraut, SAF Executive Director, shared his disappointment but remains hopeful. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-saf-responds\">SAF Responds <\/h2>\n\n\n\n<p>\u201cWhile we are disappointed that the Government\u2019s final rule remains in effect pending the outcome of our appeal,\u201d said Kraut, \u201cwe remain optimistic that we will ultimately prevail. We believe the district court\u2019s rationale, striking down the final rule, was legally sound and we look forward to defending our position on appeal.\u201d<\/p>\n\n\n\n<p>Alan M. Gottlieb, SAF&#8217;s Executive Vice President, clarified the situation. <\/p>\n\n\n\n<p>\u201cThe Supreme Court, in issuing its ruling, did not address the merits of the case,\u201d Gottlieb noted. \u201cThey only said the stay will remain in effect pending the appeal now before the Fifth Circuit, and disposition of a<a href=\"https:\/\/www.uscourts.gov\/about-federal-courts\/educational-resources\/about-educational-outreach\/activity-resources\/supreme-1#:~:text=Writs%20of%20Certiorari&amp;text=The%20primary%20means%20to%20petition,of%20the%20case%20for%20review.\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-lets-bidens-frame-receiver-rule-stand\" title=\"Supreme Court Let's Biden's Frame, Receiver Rule Stand...\"> writ of certiorari<\/a>, if such a writ is timely sought.&nbsp;<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/a-silly-argument-the-second-amendment-insurrectionist-purpose\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-lets-bidens-frame-receiver-rule-stand\" title=\"Supreme Court Let's Biden's Frame, Receiver Rule Stand...\">A Silly Argument: The Second Amendment Insurrectionist Purpose<\/a><\/strong><\/p>\n\n\n\n<p>\u201cNow that the Fifth Circuit can actually rule on the merits of this case,\u201d Gottlieb added, \u201cwe expect a very favorable ruling.\u201d<\/p>\n\n\n\n<p>Oral arguments in the case are scheduled for Thursday, Sept. 7. Kraut said this signals the case \u201cis going to move quickly.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-history-of-frame-or-receiver-rule\">History of Frame or Receiver Rule<\/h2>\n\n\n\n<p>In April of 2022, Biden&#8217;s Attorney General signed a new rule that <a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/definition-frame-or-receiver#:~:text=Summary-,On%20April%2011%2C%202022%2C%20the%20Attorney%20General%20signed%20ATF%20final,clearly%20convey%20what%20is%20a\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-lets-bidens-frame-receiver-rule-stand\" title=\"Supreme Court Let's Biden's Frame, Receiver Rule Stand...\">reclassified certain unfinished firearm parts and kits<\/a> as &#8220;firearms.&#8221; <\/p>\n\n\n\n<p>The rule now requires manufacturers and sellers of homemade firearms \u201ckits\u201d to obtain a federal firearms license and conduct background checks on all sales, among other regulations.<\/p>\n\n\n\n<p>It also requires gun dealers to serialize all firearms they obtain, redefine the term \u201cframe or receiver\u201d to incorporate split-receiver firearms like the AR-15, and force gun dealers to retain all gun sale records and turn them over to the ATF when they go out of business.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-everytown-response\">Everytown Response<\/h2>\n\n\n\n<p>Everytown for Gun Safety and Moms Demand Action praised the Supreme Court&#8217;s decision to uphold the Biden rule.<\/p>\n\n\n\n<p>John Feinblatt, President of Everytown, emphasized that such products should be regulated.  <\/p>\n\n\n\n<p>\u201cAmericans across the country will be safer thanks to the Supreme Court\u2019s decision today to keep ATF\u2019s life-saving ghost guns rule in effect while the appeals process plays out,\u201d said Feinblatt.<\/p>\n\n\n\n<p>\u201cWhen a weapon looks like a gun, shoots like a gun, and kills like a gun, there\u2019s no doubt it should be regulated like a gun,&#8221;
