That allegation might play well to gun control groups and politicians but is devoid of any legal foundation. The crime of an illegal straw purchase is committed by the individual lying on the form, a crime that NSSF has been actively warning the public against committing.<\/p>\n\n\n\n<div class=\"wp-block-yoast-seo-table-of-contents yoast-table-of-contents\"><h2>Table of contents<\/h2><ul><li><a href=\"#h-know-the-difference\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" data-level=\"2\">Know the Difference<\/a><\/li><li><a href=\"#h-it-s-the-crime-stupid\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" data-level=\"2\">It\u2019s the Crime, Stupid\u2026<\/a><\/li><li><a href=\"#h-mayor-cut-police-demands-lawsuit\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" data-level=\"2\">Mayor Cut Police, Demands Lawsuit<\/a><\/li><\/ul><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-know-the-difference\"><strong>Know the Difference<\/strong><\/h2>\n\n\n\n<p>City officials are attempting to confuse and mislead the public between what is a&nbsp;<em>legal sale<\/em>&nbsp;and&nbsp;<em>illegal purchase<\/em>&nbsp;of a firearm. Every firearm sold at retail by a licensed dealer requires the purchaser to complete an ATF Form 4473, which includes the buyer\u2019s signature attesting they are the actual purchaser (the true intended recipient) of the firearm. That purchaser\u2019s information is then verified by the FBI\u2019s National Instant Criminal Background Check System (NICS). Except in Pennsylvania, this is verified by the Pennsylvania Instant Criminal Background Check System (PICS) because the state is a point-of-contact (POC) state that conducts their own background checks through the Commonwealth\u2019s state police.<\/p>\n\n\n\n<p>This happens for every firearm sold at retail. Pennsylvania also requires universal background checks for all handgun transfers including those between private parties.<\/p>\n\n\n\n<p>The firearm industry has partnered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and Department of Justice (DOJ) for more than 20 years in the \u201c<strong><a href=\"https:\/\/www.nssfrealsolutions.org\/programs\/dont-lie\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">Don\u2019t Lie for the Other Guy<sup>TM<\/sup><\/a><\/strong>\u201d public awareness campaign. These efforts include blanketing cities selected by the ATF with advertising reminding the public that lying on a Form 4473 and committing the crime of an illegal straw purchase of a firearm carries up to a 15-year prison sentence and a $250,000 fine.<\/p>\n\n\n\n<p>NSSF just hosted one of these month-long public awareness campaigns in Philadelphia in June of 2022. It was the sixth time since at least 2009 that NSSF, along with ATF and DOJ, brought the campaign to a Pennsylvania city and the second time it was held in Philadelphia.<\/p>\n\n\n\n<p>The City of Philadelphia\u2019s Law Department is basing their lawsuit on the shakiest of foundations. City officials argue that multiple sales of firearms are suspect, which isn\u2019t true. Individuals can purchase multiple firearms at the same time. That has never been illegal in Pennsylvania. The same procedures apply if someone buys just one firearm a year or if they purchase multiple firearms at once. Fill out the Form 4473, sign it, run the PICS check.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-it-s-the-crime-stupid\"><strong>It\u2019s the Crime, Stupid\u2026<\/strong><\/h2>\n\n\n\n<p>City officials also argue that firearm retailers should know that \u201cgun-related crimes are a directly foreseeable consequence\u201d of their sales. That\u2019s ludicrous. Background checks for firearm sales topped&nbsp;<a href=\"https:\/\/www.washingtonexaminer.com\/news\/washington-secrets\/no-pause-in-gun-sales-record-48-million-over-4-years\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>over 1 million per month for four years running<\/strong><\/a>, in part because Americans are refusing to be victims of crime. That\u2019s the case in Philadelphia where Brenda Adams is among a group of women training with \u201cTerry\u2019s Angels\u201d to learn to safely and effectively use a legally-owned firearm because crime is out of control.<\/p>\n\n\n\n<p>\u201cCarjackings, murder, it scared me,\u201d Adams said in a&nbsp;<a href=\"https:\/\/www.cbsnews.com\/philadelphia\/news\/exclusive-spike-in-women-seeking-license-to-carry-permits-comes-as-philadelphia-gun-violence-continues-to-rise\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CBS News report<\/strong><\/a>. \u201cI\u2019ve been living in Philadelphia almost 64 years and I\u2019ve never seen anything like this. That\u2019s why I carry a gun.\u201d<\/p>\n\n\n\n<p>Adams isn\u2019t wrong to be worried. So far in 2023, there have been\u00a0<a href=\"https:\/\/www.phillypolice.com\/crime-maps-stats\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>255 homicides<\/strong><\/a>\u00a0in the city. There were 516 in 2022. In 2023, there have been\u00a0<a href=\"https:\/\/www.inquirer.com\/news\/shootings-2023-philadelphia-gun-violence-crime-data-20230703.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>over 900<\/strong><\/a>\u00a0shooting victims. Those are staggering figures but don\u2019t expect city officials to hold criminals to account.<\/p>\n\n\n\n<p><strong>SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/voters-rejecting-gun-control-politicians-who-shout-crime\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\">Voters Rejecting Gun Control Politicians Who Shout \u2018Crime Isn\u2019t A Problem\u2019<\/a><\/strong><\/p>\n\n\n\n<p>George Soros-backed District Attorney Larry Krasner\u2019s response to Philadelphia\u2019s rampant crime was to lash out for more gun control, not criminal control.<\/p>\n\n\n\n<p>\u201cFinally, I just want to say this: it is disgusting, the lack of proper gun legislation that we have in the Commonwealth of Pennsylvania,\u201d DA Krasner&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/philadelphia-da-larry-krasner-shows-why-he-typifies-soft-on-crime-pro-gun-control-prosecutors\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a><\/strong>&nbsp;at a press conference immediately following the tragic shootings and before facts were gathered. This is despite the fact the Brady gun control report card gives Pennsylvania a Top 10 spot in America for states with the strictest gun control laws. Everytown for Gun Safety ranks it at Number 15 and Giffords\u2019 gun control gives it the same \u2013 15 out of the 50 states with an added \u201cB-\u201d for good measure.<\/p>\n\n\n\n<p>DA Krasner\u2019s posturing is ironic. State legislators \u2013 elected by voters \u2013 successfully voted to impeach him last year for his abysmal record of keeping the public safe and holding criminals to account for their crimes. The Pennsylvania Senate failed to convict him, which would have required a two-thirds vote.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-mayor-cut-police-demands-lawsuit\"><strong>Mayor Cut Police, Demands Lawsuit<\/strong><\/h2>\n\n\n\n<p>Philadelphia\u2019s Mayor Jim Kenney isn\u2019t any better. He oversaw the Sheriff\u2019s Office that&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/philadelphia-cant-control-their-own-guns-but-want-to-control-yours\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">\u201clost\u201d<\/a><\/strong>&nbsp;more than 200 firearms but makes&nbsp;<strong><a href=\"https:\/\/www.foxnews.com\/media\/philadelphia-mayor-dont-back-gun-control-dont-back-blue\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">outlandish claims<\/a><\/strong>&nbsp;like, \u201cYou can say you back the blue but if you don\u2019t back gun control and gun availability, you don\u2019t back the blue.\u201d<\/p>\n\n\n\n<p>This is the same Mayor Kenney that allowed a&nbsp;<a href=\"https:\/\/www.okayplayer.com\/news\/philadelphia-city-council-removes-33-million-from-police-department-budget.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>cut of $33 million<\/strong><\/a>&nbsp;to kowtow to the \u201cdefund the police\u201d efforts that decimated the city\u2019s police force. He\u2019s the same mayor who responded to criminals murdering two Philadelphia police officers by&nbsp;<strong><a href=\"https:\/\/www.cbsnews.com\/philadelphia\/news\/philadelphia-mayor-jim-kenney-says-hell-be-happy-when-hes-not-mayor\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">telling media<\/a><\/strong>, \u201cI\u2019m waiting for something bad to happen all the time. So I\u2019ll be happy when I\u2019m not here, when I\u2019m not mayor, and I can enjoy some stuff.\u201d<\/p>\n\n\n\n<p>Harry Hurley, a columnist for WPG Radio&nbsp;<strong><a href=\"https:\/\/wpgtalkradio.com\/philadelphia-you-have-mayor-kenney-da-krasner-to-thank\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">published a column<\/a><\/strong>&nbsp;last year headlined, \u201cPhiladelphia, You Have Mayor Kenney &amp; DA Krasner To Thank \u2026\u201d In it, he wrote, \u201cWhen you create a lawless environment, this is exactly the result that you should expect.\u201d<\/p>\n\n\n\n<p>Mayor Kenney&nbsp;<a href=\"https:\/\/www.cbsnews.com\/philadelphia\/news\/philadelphia-mass-shooting-kingsessing-kenney-gun-dealers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>proclaimed that he would sue<\/strong><\/a>&nbsp;firearm retailers. He\u2019s made good on his threat. It seems he thinks it is more expedient to blame a business that didn\u2019t commit a crime than the criminal that does. The problem is Mayor Kenney and his city hall lawyers are glossing over the fact that individuals commit the crime of straw \u201cpurchase.\u201d It isn\u2019t an illegal \u201csale.\u201d The business isn\u2019t to blame for the criminal lying on the form and illegally transferring a firearm to a prohibited individual. Tracing a firearm from a crime scene back to a retailer&nbsp;<strong><a href=\"https:\/\/www.atf.gov\/resource-center\/docs\/ycgii-report-2000-introductionpdf-1\/download\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">doesn\u2019t demonstrate<\/a><\/strong>&nbsp;that retailer ran afoul of the law. It is why Congress wisely passed legislation that bars trace data from being admitted as evidence \u2013 because it isn\u2019t evidence. Over&nbsp;<strong><a href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/suficspi16.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"philly-sues-firearm-retailers-instead-of-locking-up-criminals\" title=\"Philly Sues Firearm Retailers Instead of Locking Up Criminals\" target=\"_blank\" rel=\"noreferrer noopener\">90 percent<\/a><\/strong>&nbsp;of federal convicts in prison for committing a crime admit they obtained that firearm through illicit means. That\u2019s through the black market, theft or trading on a street corner.<\/p>\n\n\n\n<p>Philadelphia is more interested in doing the bidding of gun control supporters and clogging the courts with baseless lawsuits. Instead, they should join the work that NSSF, the ATF and DOJ are doing to prevent illegal straw purchases and lock up the criminals that commit these crimes.<\/p>\n\n\n\n<p><strong>Larry
