That\u2019s the criminal charge. We can\u2019t try this case in a vacuum. It is a high-profile case.\u201d<\/p>\n\n\n\n<p>The motion was denied Tuesday during a virtual hearing by State District Court Judge Mary Marlowe. Judge Marlowe stated that the defense failed to demonstrate \u201cactual and substantial prejudice\u201d that would warrant a dismissal of such charges.<\/p>\n\n\n\n<p>Further, Marlowe explained, \u201cThis is at the preliminary stage. For you to say you&#8217;ve basically tainted a jury &#8212; we&#8217;re not even there yet.&#8221;<\/p>\n\n\n\n<p>Additionally, the Judge claimed the jurisdictional issues were resolved with the change in prosecutors.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-additional-charges-against-rust-armorer\">Additional Charges against &#8220;Rust&#8221; Armorer<\/h2>\n\n\n\n<p>Along with the Manslaughter charges, Gutierrez faces an additional charge of tampering with evidence.
