Judge Vacates ATF 'Final Rule' On Unfinished Frames, Receivers\">a ruling<\/a> by a federal judge in Texas against Joe Biden\u2019s ATF by vacating the agency\u2019s \u201cfinal rule\u201d which treated unfinished frames and receivers the same as if they are functional firearms.<\/p>\n\n\n\n<p>SAF was <a href=\"https:\/\/www.saf.org\/saf-defense-distributed-allowed-to-intervene-in-vanderstok-case\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fed-judge-vacates-atf-final-rule-on-unfinished-frames-receivers\" title=\"Fed. Judge Vacates ATF 'Final Rule' On Unfinished Frames, Receivers\">allowed to intervene<\/a> in the case last December. The case is known as <em>VanDerStok v. Garland<\/em>.<\/p>\n\n\n\n<p>U.S. District Judge Reed O\u2019Connor handed down the decision Friday, noting in his 38-page ruling that, \u201cA part that has yet to be completed or converted to function as frame or receiver is not a frame or receiver. Judge Vacates ATF 'Final Rule' On Unfinished Frames, Receivers\">Lawmakers Want to Tax AR Lowers to Close \u2018Loophole,\u2019 Use Revenue to Fund Gun Control<\/a><\/h2>\n\n\n\n<p>Elsewhere, Judge O\u2019Connor puts ATF on the spot by rejecting the government\u2019s argument that it has previously taken action against a firearm component, thus it has regulatory authority over firearm parts. But the judge observes, \u201cIf these administrative records show, as Defendants contend, that ATF has previously regulated components that are not yet frames or receivers but could readily be converted into such items, then the historical practice does nothing more than confirm that the agency has, perhaps in multiple specific instances over several decades, exceeded the lawful bounds of its statutory jurisdiction. That the agency may have historically acted ultra vires does not convince the Court it should be permitted to continue the practice.\u201d<\/p>\n\n\n\n<p>\u201cWe are delighted with Judge O\u2019Connor\u2019s ruling, and it certainly underscores why we intervened in this case,\u201d said SAF founder and Executive Vice President Alan M.
