Gavin Newsom\u2019s policy instincts match his hair gel. Both are applied liberally.<\/p>\n\n\n\n<p>Take his latest notion. He is\u00a0<strong><a href=\"https:\/\/www.gov.ca.gov\/2023\/06\/08\/28th-amendment\/#:~:text=Governor%20Newsom%20Proposes%20Historic%2028th,End%20America' target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"s%20Gun%20Violence%20Crisis&amp;text=SACRAMENTO%20%E2%80%93%20Today%20Governor%20Gavin%20Newsom,gun%20safety%20measures%20into%20law\">proposing<\/a><\/strong>\u00a0a 28<sup>th<\/sup>\u00a0Amendment to the U.S. Constitution. He\u2019s not proposing to protect rights granted by our Creator, rather he\u2019s looking to turn those rights into government-approved privileges.<\/p>\n\n\n\n<div class=\"wp-block-yoast-seo-table-of-contents yoast-table-of-contents\"><h2>Table of contents<\/h2><ul><li><a href=\"#h-his-proposal-for-the-28th-amendment-would-be\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Murderers \u2013\u00a0Meh?<\/a><\/li><li><a href=\"#h-founding-fathers-knew-1\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\" data-level=\"2\">Founding Fathers Knew<\/a><\/li><\/ul><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-his-proposal-for-the-28th-amendment-would-be\">His proposal for the 28<sup>th<\/sup>\u00a0Amendment would be:<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Raising the federal minimum age to purchase a firearm from 18 to 21;<\/li>\n\n\n\n<li>Mandating universal background checks to prevent truly dangerous people from purchasing a gun that could be used in a crime;<\/li>\n\n\n\n<li>Instituting&nbsp;a reasonable waiting period for all gun purchases; and<\/li>\n\n\n\n<li>Barring civilian purchase of assault weapons that serve no other purpose than to kill as many people as possible in a short amount of time \u2013 weapons of war our nation\u2019s founders never foresaw.<\/li>\n<\/ul>\n\n\n\n<p>Don\u2019t worry. Gov. Newsom says these proposals leave the Second Amendment unchanged and respect America\u2019s gun-owning tradition. If you believe that, I\u2019ve got a Golden Gate Bridge to sell you. These ideas are already law in California which means Gov. Newsom wants to export his failing policies to the rest of the nation. He doesn\u2019t get it that no one else wants them or that he just admitted his gun control ideas are unconstitutional under the Second Amendment. Otherwise, why would he need a 28<sup>th<\/sup>?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-make-america-california\">Make America California?<\/h2>\n\n\n\n<p>Gov. Newsom\u2019s proposal reveals his autocratic, \u201cbig government\u201d tendencies. The&nbsp;<a href=\"https:\/\/www.archives.gov\/founding-docs\/declaration-transcript\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>Declaration of Independence<\/strong><\/a>&nbsp;professed that unalienable rights are endowed by our Creator. The Constitution\u2019s&nbsp;<a href=\"https:\/\/www.archives.gov\/founding-docs\/bill-of-rights-transcript\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>Bill of Rights<\/strong><\/a>&nbsp;\u2013 the first 10 Amendments \u2013 reminds the government that those rights belong to the \u201cpeople,\u201d not the government. Gov. Newsom wants to flip that on its head.<\/p>\n\n\n\n<p>He claims his proposed 28<sup>th<\/sup>&nbsp;Amendment wouldn\u2019t interfere with Second Amendment rights but that\u2019s just not true. Gov. Newsom would relegate the Second Amendment to a second-class right by barring adults at 18, who are fully vested in all their other Constitutional rights, from fully exercising and expressing their Second Amendment rights. Gov. Newsom\u2019s proposed 28<sup>th<\/sup>&nbsp;Amendment wouldn\u2019t respect the Second Amendment. It would trample all over it.<\/p>\n\n\n\n<p>It would further invite government intrusion into the exercise of a fundamental right by instituting\u00a0<a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2021\/04\/NSSF-factsheet-UBC.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>universal background checks<\/strong><\/a>. The only way that works is if the federal government is able to create a national gun owner database. That was the conclusion of The Obama administration\u2019s Justice Department. A\u00a0<strong><a href=\"https:\/\/www.nssf.org\/nijgunpolicymemo1-4-2013\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\">2013 National Institutes for Justice report<\/a><\/strong>\u00a0states universal background checks are dependent on gun registration. That would put every gun owner on a watchlist just for exercising their rights. The proposal would also say that rights aren\u2019t actually rights without a \u201creasonable\u201d\u00a0<a href=\"https:\/\/www.nssf.org\/wp-content\/uploads\/2021\/04\/NSSF-factsheet-Waiting-Periods.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>waiting period<\/strong><\/a>. No other right is exposed to that qualification. Individuals aren\u2019t told they can only assemble if they\u2019ve waited three days. No one is told they can attend their church only once every seven days. No one needs the government\u2019s permission before they write a letter to the editor of their local newspaper. That\u2019s ludicrous.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-guns-bad-murderers-meh-1\">Guns = Bad. Murderers \u2013\u00a0<em>Meh<\/em>?<\/h2>\n\n\n\n<p>Gov. Newsom\u2019s proposed amendment would suggest that criminals are absolved of responsibility for their crimes. His proposal blames crime on the gun, not the criminal. He classifies Modern Sporting Rifles (MSRs) inaccurately as \u201cassault weapons\u201d and defines them as serving no other purpose than to murder. As we have seen, not even the Director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/atf-director-dettelbach-answers-house-appropriations-committee-questions-over-agency-funding\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>able to define<\/strong><\/a>&nbsp;what they mean by an \u201cassault weapon,\u201d which is simply an invented antigun trope to&nbsp;<a href=\"https:\/\/reason.com\/2018\/05\/14\/assault-weapons-explained\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>mislead the public<\/strong><\/a>.<\/p>\n\n\n\n<p>There are\u00a0<a href=\"https:\/\/www.nssf.org\/articles\/commonly-owned-nssf-announces-over-24-million-msrs-in-circulation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>24.4 million MSRs<\/strong><\/a>\u00a0in circulation today. The overwhelming majority of these firearms are locked safely in gun safes across the nation not because they suddenly sprout to life and murder innocent people. Murders happen because deranged individuals with no respect for the law or life unlawfully take the lives of the innocent. The\u00a0<a href=\"https:\/\/www.breitbart.com\/politics\/2022\/10\/11\/fbi-more-people-beaten-death-fists-feet-than-killed-rifles\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>FBI\u2019s Uniform Crime Reports<\/strong><\/a>\u00a0show, that as horrific as these incidents are, they are still the minority of murders. Murders committed with knives, fists and clubs far outpace those committed with all types of rifles, not just MSRs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-founding-fathers-knew-1\">Founding Fathers Knew<\/h2>\n\n\n\n<p>Gov. Newsom showed his policy ignorance further when he wrote that the nation\u2019s founders wouldn\u2019t have foreseen the development of today\u2019s MSR. The founders knew they couldn\u2019t predict the future. They&nbsp;<a href=\"https:\/\/reason.com\/volokh\/2023\/05\/26\/the-founders-were-well-aware-of-continuing-advances-in-arms-technology\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>understood technology changes<\/strong><\/a>&nbsp;and that\u2019s why they didn\u2019t write the Second Amendment to protect flintlock, muzzleloader rifles. They didn\u2019t restrict bearing arms to only the number of patch-and-ball that could be carried in a canvas bag.<\/p>\n\n\n\n<p>The founders wrote \u201carms\u201d to include all arms. Just as the First Amendment\u2019s freedom of the press isn\u2019t limited to quill pens or manual printing presses that were the cutting-edge technology of the day but to all forms of mass media. The same is with arms. There were\u00a0<a href=\"https:\/\/www.wickedlocal.com\/story\/archive\/2018\/03\/31\/founding-fathers-knew-about-semi\/12855323007\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>repeating and multi-shot guns<\/strong><\/a>\u00a0at the time the Second Amendment was drafted. The founders knew that every now and then, there would be ideas pushed by politicians more intent on furthering their own political career than protecting the Constitutional rights of all Americans. That\u2019s why&nbsp;<a href=\"https:\/\/www.archives.gov\/founding-docs\/constitution-transcript\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\"><strong>Article<\/strong>&nbsp;<strong>V<\/strong><\/a>&nbsp;of the U.S. Constitution exists. Gov. Newsom can encourage lawmakers in California to vote for a Constitutional Convention of the States. He\u2019ll just need to get 33 other states to agree on it. Given that&nbsp;<strong><a href=\"https:\/\/www.usconcealedcarry.com\/resources\/terminology\/types-of-concealed-carry-licensurepermitting-policies\/unrestricted\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-comes-clean-with-28th-amendment-suggestion\" title=\"Gov. Newsom Comes Clean with 28th Amendment Suggestion\">over half the states<\/a><\/strong>&nbsp;have passed Constitutional carry laws to respect the Second Amendment rights of their citizens, this is doubtful.<\/p>\n\n\n\n<p>The other option is to convince Congress this 28<sup>th<\/sup>&nbsp;Amendment should be adopted. That only requires two-thirds of both the U.S. House of Representatives and the U.S. Senate to agree to it. Given the legislative gymnastics it takes to even agree on how to spend tax dollars, this isn\u2019t likely either. Of course, even if two-thirds of the state legislatures or Congress would agree, it would still take 38 states to ratify the amendment.<\/p>\n\n\n\n<p>I propose any such Convention of the States be held in Gov.
