After his conviction three years ago, federal law barred him from owning firearms.  Range argued that this restriction violated his constitutional rights.<\/p>\n\n\n\n<p>Range&#8217;s guilty plea led to a misdemeanor conviction that could have led to a five-year imprisonment sentence.  Federal law can strip 2A rights from an individual if they are convicted of a crime punishable by over a year in prison.<\/p>\n\n\n\n<p>This type of punishment usually encompasses felonies; however, certain misdemeanors can also carry heavy penalties.<\/p>\n\n\n\n<p>Even though Range was only sentenced to three years probation, the law rescinded Range&#8217;s right to keep and bear arms<\/p>\n\n\n\n<p>Range\u2019s attempt to restore his rights was rejected by a federal judge in 2021.<\/p>\n\n\n\n<p>However, a Supreme Court ruling in <a href=\"https:\/\/en.wikipedia.org\/wiki\/New_York_State_Rifle_%26_Pistol_Association,_Inc._v._Bruen#:~:text=violence%20in%20public.-,Opinion%20of%20the%20Court,the%20case%20for%20further%20review.\" target=\"_blank\" class=\"clickTracking\" campaign=\"appeals-court-rules-u-s-cannot-strip-2a-rights-for-non-violent-crimes\" title=\"Appeals Court Rules U.S. Cannot Strip 2A Rights for Non-violent Crimes\">June 2022<\/a> affirmed that the Constitution guarantees an individual\u2019s right to keep and bear arms, implying that any restrictions on 2A rights must be in line with the nation\u2019s tradition of gun regulation.<\/p>\n\n\n\n<p><strong>SEE MORE: <a href=\"BREAKING: Supreme Court Rules NY\u2019s Restrictive Concealed Carry Scheme is Unconstitutional!\" target=\"_blank\" class=\"clickTracking\" campaign=\"appeals-court-rules-u-s-cannot-strip-2a-rights-for-non-violent-crimes\" title=\"Appeals Court Rules U.S. Cannot Strip 2A Rights for Non-violent Crimes\">BREAKING: Supreme Court Rules NY\u2019s Restrictive Concealed Carry Scheme is Unconstitutional!<\/a><\/strong><\/p>\n\n\n\n<p>&#8220;We are very pleased that the 3rd Circuit has vindicated the rights of our client by faithfully applying the Supreme Court&#8217;s decision,&#8221; Range&#8217;s lawyer, Peter Patterson, said in an email to <em>Reuters<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-court-s-ruling\">The Court\u2019s Ruling<\/h2>\n\n\n\n<p>The appeal was heard by the Philadelphia-based 3rd U.S. Circuit Court of Appeals.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/jnvwyngadvw\/CA3-firearms-2023-06-06.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"appeals-court-rules-u-s-cannot-strip-2a-rights-for-non-violent-crimes\" title=\"Appeals Court Rules U.S. Cannot Strip 2A Rights for Non-violent Crimes\">majority opinion<\/a>, released Tuesday, states, \u201cthe government had failed to point to any laws from the United States&#8217; founding establishing a tradition of disarming non-violent criminals.\u201d<\/p>\n\n\n\n<p>The Court concluded that Range is considered one of \u201cthe people\u201d protected under the Second Amendment.<\/p>\n\n\n\n<p>Additionally, they agreed that the Government failed to provide a reason why he specifically should have his rights stripped.
