Joe Lombardo made use of his veto <a href=\"https:\/\/www.cnn.com\/2023\/05\/17\/politics\/nevada-gun-control-veto-governor-joe-lombardo\/index.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">power<\/a> for the first time since taking office in January, refusing to sign three gun-control measures that state Democrats had pushed to his desk, arguing they were unconstitutional.<\/p>\n\n\n\n<p>Lombardo defended his decision, <a href=\"https:\/\/gov.nv.gov\/Newsroom\/PRs\/2023\/2023-05-17_Vetos\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">stating<\/a>, \u201cI will not support legislation that infringes on the constitutional rights of Nevadans.\u201d <\/p>\n\n\n\n<p>He continued, \u201cMuch of the legislation I vetoed today is in direct conflict with legal precedent and established constitutional protections. Therefore, I cannot support them.\u201d<\/p>\n\n\n\n<p>Each of the three bills attempted to strip Nevadans of their 2A rights in different ways. Nevada Democrats claimed the infringements would make the state a safer place. <\/p>\n\n\n\n<p>Gov. Lombardo articulated in letters to the legislature why these resolutions may not serve the best interests of their constituents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Goals of the Vetoed Bills<\/h2>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Nevada Gov. Lombardo vetoes trio of gun safety bills\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/JQTaeFouB0Q?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>One portion of<a href=\"https:\/\/gov.nv.gov\/uploadedFiles\/gov2022nvgov\/content\/Newsroom\/PRs\/2023\/AB354_VetoMessage_GovernorLombardo.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\"> AB 354<\/a> would prohibit firearms within proximity to polling stations during elections. Lombardo commented the effort to make elections safer was \u201ccommendable.\u201d <\/p>\n\n\n\n<p>However, he explained the \u201cscope of the bill is too broad.\u201d Further, federal law effectively accomplishes the same task by outlawing intimidation and threat tactics against voters.<\/p>\n\n\n\n<p>The other half of AB 354 covers the prohibition of unfinished firearm frames and receivers. Gov. Lombardo emphasized that the parts trying to be outlawed are protected under the Second Amendment.<\/p>\n\n\n\n<p>The second bill, <a href=\"https:\/\/gov.nv.gov\/uploadedFiles\/gov2022nvgov\/content\/Newsroom\/PRs\/2023\/AB355_VetoMessage_GovernorLombardo.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">AB 355<\/a>, proposed to increase the minimum age for ownership of semi-automatic shotguns and rifles from 18 to 21.<\/p>\n\n\n\n<p>Gov. Lombardo, in response, referenced several recent Supreme Court decisions, arguing that implementing such a measure would be a significant infringement on the Second Amendment rights of Nevada&#8217;s citizens.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">The Nevada Senate Republicans unanimously opposed this legislation and are grateful Governor <a href=\"https:\/\/twitter.com\/JosephMLombardo?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">@JosephMLombardo<\/a> vetoed these bills. We applaud him for protecting our citizens&#39; constitutional rights. <a href=\"https:\/\/twitter.com\/hashtag\/nvleg?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">#nvleg<\/a> <a href=\"https:\/\/t.co\/G9fKFr2GU4\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">pic.twitter.com\/G9fKFr2GU4<\/a><\/p>&mdash; Nevada Senate Republicans (@NVGOPSenate) <a href=\"https:\/\/twitter.com\/NVGOPSenate\/status\/1658912479379091457?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">May 17, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p>The final bill, <a href=\"https:\/\/gov.nv.gov\/uploadedFiles\/gov2022nvgov\/content\/Newsroom\/PRs\/2023\/SB171_VetoMessage_GovernorLombardo.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">SB 171<\/a>, calls for 2A rights to be stripped from persons convicted of a hate crime, regardless of if a firearm was used in the crime. Lombardo pointed out that under existing laws, penalties are usually more stringent when offenses are determined to be motivated by hate, such as those based on race, sex, religion, gender, and so on.<\/p>\n\n\n\n<p>Lombardo stated in his response, \u201c[the connection] between certain misdemeanor offenses and gun violence makes it untenable to pass a law that immediately puts the defendant\u2019s Second Amendment rights in jeopardy.\u201d <\/p>\n\n\n\n<p>\u201cThis would effectively open the door to more laws restricting others convicted of gross misdemeanors from owning firearms to protect their homes and families,&#8221; he continued. <\/p>\n\n\n\n<p>Additionally, the governor suggested,\u201d Many of the more violent and egregious offenses under Nevada law that are commonly associated with hate crimes can and should be prosecuted as felonies in the first place, especially when there is a connection between the underlying crime and the use of guns.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-where-do-the-vetoed-bills-go-from-here\">Where Do the Vetoed Bills Go from Here<\/h2>\n\n\n\n<p>Gov. Lombardo\u2019s actions are an enormous win for the Second Amendment.  Lately, the focus is how most of the country is turning its back on our constitutional rights. DeSantis Signing Law Barring Tracking Codes for Firearm Retail Purchases<\/a><\/h2>\n\n\n\n<p>However, these bills are not done and should not be forgotten. After the veto, the bills will return to the legislature for final votes.  The governor\u2019s veto will be overturned if both the Assembly and Senate approve the bills.  As a result, the legislation will become law regardless of the veto.<\/p>\n\n\n\n<p>Democrats hold a <a href=\"https:\/\/apnews.com\/article\/gun-control-nevada-governor-veto-ca50b9e0641937ce7b27a1d902699606\" target=\"_blank\" class=\"clickTracking\" campaign=\"nevada-governor-vetoes-three-gun-control-bills\" title=\"Nevada Governor Vetoes Three Gun Control Bills\">supermajority<\/a> in the State Assembly. However, they will need all party members on board and one Republican vote to pass through the Senate.
