Chris Murphy (CT)  predicted a &#8220;popular revolt&#8221; if the Supreme Court stops &#8220;universal background checks&#8221; and a ban on so-called &#8220;assault weapons&#8221; from becoming the law of the land. <\/p>\n\n\n\n<p>Murphy appeared on <em>NBC&#8217;s<\/em> &#8220;<a href=\"https:\/\/www.nbc.com\/meet-the-press\" target=\"_blank\" class=\"clickTracking\" campaign=\"dem-senator-predicts-popular-revolt-if-scotus-stops-gun-control-from-becoming-law\" title=\"High-Profile Dem Predicts 'Popular Revolt' If SCOTUS Stops Gun Control from Becoming Law\">Meet the Press<\/a>&#8221; over the weekend (see video above). <\/p>\n\n\n\n<p>Host Chuck Todd asked Murphy about his continuing involvement in gun control legislation, a stance that has been met with opposition from certain district courts. <\/p>\n\n\n\n<p>&#8220;It does sound like you have to do it within the construct of look, you will probably not be able to regulate much having to do with access to the gun by anybody over 18,&#8221; Todd noted.<\/p>\n\n\n\n<p>Todd was referencing a recent decision by Judge Robert Payne, of the U.S. District Court for the Eastern District of Virginia.  Judge Payne <a href=\"https:\/\/www.reuters.com\/world\/us\/us-judge-strikes-down-federal-law-barring-handgun-sales-those-under-21-2023-05-12\/#:~:text=US%20judge%20strikes%20down%20federal%20law%20barring%20handgun%20sales%20to%20those%20under%2021,-By%20Brad%20Brooks&amp;text=May%2011%20(Reuters)%20%2D%20A,constitutional%20rights%20to%20possess%20firearms.\" target=\"_blank\" class=\"clickTracking\" campaign=\"dem-senator-predicts-popular-revolt-if-scotus-stops-gun-control-from-becoming-law\" title=\"High-Profile Dem Predicts 'Popular Revolt' If SCOTUS Stops Gun Control from Becoming Law\">struck down<\/a> a federal law that prohibits handgun sales to adults under 21. <\/p>\n\n\n\n<p>&#8220;Because the statutes and regulations in question are not consistent with our nation&#8217;s history and tradition, they, therefore, cannot stand,&#8221; Payne wrote in his decision.<\/p>\n\n\n\n<p>Murphy responded with a stark warning: &#8220;If the Supreme Court eventually says that states or the Congress can\u2019t pass universal background checks or can\u2019t take these assault weapons off the streets, I think there will be a popular revolt over that policy.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-body-cam-footage-police-mistake-leads-to-dead-homeowner\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/body-cam-footage-police-mistake-leads-to-dead-homeowner\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dem-senator-predicts-popular-revolt-if-scotus-stops-gun-control-from-becoming-law\" title=\"High-Profile Dem Predicts 'Popular Revolt' If SCOTUS Stops Gun Control from Becoming Law\">Body Cam Footage: Police Mistake Leads to Dead Homeowner<\/a><\/h2>\n\n\n\n<p>&#8220;A court that\u2019s already pretty illegitimate and is going to be in full crisis mode,&#8221; he added. <\/p>\n\n\n\n<p>Todd pressed further, asking how gun legislation should be approached under the present conditions: &#8220;Do you go for a constitutional amendment, or do you just hope judges\u2019 philosophies change over the next generation?&#8221;<\/p>\n\n\n\n<p>Despite the uphill battle, Murphy expressed optimism that Dems will be able to get the job done.<\/p>\n\n\n\n<p>&#8220;Right now, the Supreme Court has made it clear under the <em>Heller<\/em> decision, which still controls, they say there is a right to private gun ownership, but there\u2019s also an ability for Congress to legislate who owns weapons and what kind of weapons are owned,&#8221; he stated. &#8220;I think we need to operate under that construct, and I really see progress.&#8221;<\/p>\n\n\n\n<p>Murphy acknowledged the concern surrounding the decisions of district <a href=\"https:\/\/www.gunsamerica.com\/digest\/oregon-appellate-court-overturns-2a-sanctuary-ordinance\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"dem-senator-predicts-popular-revolt-if-scotus-stops-gun-control-from-becoming-law\" title=\"High-Profile Dem Predicts 'Popular Revolt' If SCOTUS Stops Gun Control from Becoming Law\">courts<\/a> on this issue but emphasized the importance of focusing on the broader movement. <\/p>\n\n\n\n<p>&#8220;Does it worry me what some of these district courts are doing? Given those numbers, AR-pattern rifles are in common use. <\/p>\n\n\n\n<p>As Stephen Halbrook from the <a href=\"https:\/\/www.independent.org\/news\/article.asp?id=14187#:~:text=Heller%20(2008)%2C%20the%20U.S.,society%2C%E2%80%9D%20not%20the%20government.\" target=\"_blank\" class=\"clickTracking\" campaign=\"dem-senator-predicts-popular-revolt-if-scotus-stops-gun-control-from-becoming-law\" title=\"High-Profile Dem Predicts 'Popular Revolt' If SCOTUS Stops Gun Control from Becoming Law\">Independent Institute<\/a> reminds us: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>In&nbsp;<em>District of Columbia v. Heller<\/em>&nbsp;(2008), the U.S. Supreme Court held that the Second Amendment protects \u201carms \u2018in common use at the time\u2019 for lawful purposes like self-defense\u201d and arms that are \u201ctypically possessed by law-abiding citizens for lawful purposes.\u201d Such arms are \u201cchosen by American society,\u201d not the government.<\/p>\n<\/blockquote>\n\n\n\n<p>A widespread prohibition on this class of firearms would be unconstitutional.  There&#8217;s little doubt that the high court, as currently constructed, would block an &#8220;assault weapon&#8221; ban.  <\/p>\n\n\n\n<p>If a &#8220;popular revolt&#8221; were to occur as a result it&#8217;d be because those who are revolting don&#8217;t understand the Constitution.
