Inslee signs assault weapon ban bill into law\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/OKvexC0kWlo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>The Second Amendment Foundation (SAF) has filed a federal lawsuit against the state of Washington, challenging the constitutionality of the recently enacted <a href=\"https:\/\/fastdemocracy.com\/bill-search\/wa\/2023-2024\/bills\/WAB00019237\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">House Bill 1240<\/a>, which bans the manufacture, sale, import, and distribution of many semi-automatic firearms. <\/p>\n\n\n\n<p>SAF claims the new law &#8212; which took effect immediately &#8212; infringes on Second and Fourteenth Amendment rights and is seeking preliminary and permanent injunctions from the court.<\/p>\n\n\n\n<p>The lawsuit, named <em>Hartford v. Ferguson<\/em>, was filed in the U.S. District Court for the Western District of Washington. <\/p>\n\n\n\n<p>SAF is joined by the Firearms Policy Coalition, Hazel Dell retailer Sporting Systems, and three private citizens, Brett Bass, Douglas Mitchell, and Lawrence Hartford. The plaintiffs are represented by Seattle attorney Joel Ard.<\/p>\n\n\n\n<p>Washington Attorney General Bob Ferguson and several county sheriffs and prosecutors are named as defendants in the lawsuit. <\/p>\n\n\n\n<p>SAF founder and Executive Vice President Alan M. Gottlieb criticized the state for putting politics above constitutional rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-viral-video-tuber-almost-blows-out-eye-in-tannerite-accident\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/viral-video-tuber-almost-blows-out-eye-in-tannerite-accident\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">Viral Video: Tuber Almost Blows Out Eye in Tannerite Accident<\/a><\/h2>\n\n\n\n<p>\u201cThe State has enacted a flat prohibition on the manufacture, sale, import and distribution of many types of firearms, inaccurately labeled as \u2018assault weapons,\u2019 which are owned by millions of ordinary citizens across the country,\u201d said Gottlieb in a press release obtained by GunsAmerica. <\/p>\n\n\n\n<p>\u201cIn the process, the state has criminalized a common and important means of self-defense, the modern semiautomatic rifle,&#8221; he continued. &#8220;The state has put politics ahead of constitutional rights, and is penalizing law-abiding citizens while this legislation does nothing to arrest and prosecute criminals who misuse firearms in defiance of all existing gun control laws. It is absurd.\u201d<\/p>\n\n\n\n<p>HB 1240 has exemptions for law enforcement and members of the military.  Existing owners of black rifles are also grandfathered in &#8212; at least for now. <\/p>\n\n\n\n<p>HB 1240 is part of a broader gun reform package signed into law that includes a 10-day waiting period, mandatory firearms training for prospective gun buyers, and a new legal pathway for the attorney general and family members of shooting victims to sue gun makers who market their products to prohibited persons. <\/p>\n\n\n\n<p>These additional provisions take effect this summer.  <\/p>\n\n\n\n<p>Rep. Strom Peterson (D-Edmonds), who sponsored House Bill 1240, stated, \u201cGun violence rips loved ones from their families, devastates our communities, and traumatizes our children again and again.&#8221; <\/p>\n\n\n\n<p>&#8220;Students everywhere have been speaking up, demanding we do something to protect them,&#8221; he continued. &#8220;We\u2019ve stepped up to answer them. With the Governor\u2019s signature today, we\u2019re sending a clear message to our kids: we hear you and we are acting to keep you safe.\u201d<\/p>\n\n\n\n<p>Gottlieb also highlighted two ongoing legal actions challenging Washington gun laws, one addressing the <a href=\"https:\/\/www.gunsamerica.com\/digest\/washington-state-bans-hi-cap-mags\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">magazine ban<\/a> and another contesting the ban on sales of semi-automatic <a href=\"https:\/\/www.gunsamerica.com\/digest\/ninth-circuit-panel-strikes-down-semi-auto-rifle-ban-for-adults-under-21\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">rifles to young adults<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/washington-state-democrats-force-partisan-assault-weapon-ban-through-senate\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">Washington State Democrats Force Partisan \u2018Assault Weapon\u2019 Ban Through Senate<\/a><\/h2>\n\n\n\n<p>SAF Executive Director Adam Kraut called out the authors and supporters of the legislation for their &#8220;hysteria&#8221; and &#8220;false characterization&#8221; of the banned firearms as &#8220;weapons of war.&#8221; <\/p>\n\n\n\n<p>\u201cAs we note in our complaint, the firearms that Washington bans as \u2018assault weapons\u2019 are, in all respects, ordinary semiautomatic rifles. To the extent they are different from other semiautomatic rifles, their distinguishing features make them safer and easier to use,&#8221; observed Kraut.<\/p>\n\n\n\n<p>&#8220;But even if they are considered as a separate group of \u2018assault weapons,\u2019 they cannot be banned because they are not dangerous and unusual,&#8221; he concluded. <\/p>\n\n\n\n<p>Rep. Liz Berry (D-Seattle), who sponsored <a href=\"https:\/\/app.leg.wa.gov\/billsummary?BillNumber=1143&amp;Year=2023&amp;Initiative=false\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">House Bill 1143<\/a>, the waiting period measure, <a href=\"https:\/\/www.kptv.com\/2023\/04\/25\/washington-gov-inslee-sign-comprehensive-gun-reform-package-tuesday\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">commented<\/a>, \u201cGun violence is now the leading cause of death for children in our country. As a mom of two little ones and as a person who has lost someone who I love to gun violence, this is devastating to me. It\u2019s simple: these bills will save lives.\u201d<\/p>\n\n\n\n<p>Rep. Berry is wrong.  Guns <em><strong>ARE NOT <\/strong><\/em>the leading cause of death for children in the U.S., as GunsAmerica recently <a href=\"https:\/\/www.gunsamerica.com\/digest\/obama-newsom-repeat-lie-guns-are-number-one-killer-of-children\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"saf-sues-washington-state-over-black-rifle-ban\" title=\"SAF Sues Washington State Over Black Rifle Ban\">pointed out<\/a>.
