The state is moving away from the FBI handling firearm-related NICS background checks. <\/p>\n\n\n\n<p>Now, the New York State Police (<a href=\"https:\/\/troopers.ny.gov\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">NYSP<\/a>) will manage all these checks.  What could go wrong?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-centralized-system-incoming\">Centralized System Incoming<\/h2>\n\n\n\n<p><a href=\"https:\/\/casetext.com\/statute\/consolidated-laws-of-new-york\/chapter-executive\/article-11-division-of-state-police\/section-228-national-instant-criminal-background-checks\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">NY Exec. Law \u00a7 228<\/a>, enacted last year, drives this transition. It requires the State Police Superintendent to establish a &#8220;centralized&#8221; bureau for checks. <\/p>\n\n\n\n<p>Dealers were required to submit background check requests to this bureau starting last Wednesday, Sept. 13th.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-cost-implications-for-background-checks-on-ammo-purchases\">Cost Implications for Background Checks on Ammo Purchases <\/h2>\n\n\n\n<p>To manage the costs associated with this centralized approach, \u00a7 228(5) permits the state to levy fees on these background checks. <\/p>\n\n\n\n<p><a href=\"https:\/\/spectrumlocalnews.com\/nys\/central-ny\/politics\/2023\/09\/19\/-it-s-not-working---state-police-ammo-database-sees-issues--delays\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">Reports<\/a> by local media indicate the fees will be an additional $9 for firearms and $2.50 for ammunition &#8212; on all purchases and transfers.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-new-requirements-at-a-glance-courtesy-of-the-bradford-era\">New Requirements At a Glance (Courtesy of <a href=\"https:\/\/www.bradfordera.com\/news\/borrello-complaints-pile-up-over-n-y-background-check-for-ammo\/article_622d017e-56f0-11ee-9765-2f320c3b2011.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\"><em>The Bradford Era<\/em><\/a>)<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Shifts New York state from a jurisdiction in which the FBI conducts firearms-related National Instant Criminal Background Check System (NICS) background checks, to one in which the New York State Police are the \u201cpoint of contact\u201d for background checks.<\/li>\n\n\n\n<li>Requires the NYSP to conduct background checks on all firearm and ammunition purchases in the state.<\/li>\n\n\n\n<li>Authorizes NYSP to charge fees for each background check on purchases and transfers. Those fees have been set at $9 for firearms and $2.50 for ammunition.<\/li>\n\n\n\n<li>Requires the NYSP to create and maintain a statewide firearms license and records database to be used for ammunition sales as well as for the certification and recertification of permits and assault weapon registration.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-safe-act-and-ammunition-checks\">The SAFE Act and Ammunition Checks<\/h2>\n\n\n\n<p>The state mandate for background checks on ammo purchases originated from the draconian <a href=\"https:\/\/www.gunsamerica.com\/digest\/gov-cuomos-a-sexual-harasser-investigation-finds\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">2013 SAFE Ac<\/a>t. However, the act faced initial challenges. The needed technology wasn&#8217;t available then.<\/p>\n\n\n\n<p>An <a href=\"https:\/\/www.nysenate.gov\/newsroom\/press-releases\/2015\/joseph-griffo\/griffo-senate-republican-agreement-governor-suspends-ny\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">MOU<\/a> in 2015 further complicated matters. It prevented state spending on the ammunition check database without a ratified cost plan, as the <em>NRA-ILA<\/em> <a href=\"https:\/\/www.nraila.org\/articles\/20230821\/changes-coming-soon-for-new-york-state-gun-owners\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\">reported<\/a>. <\/p>\n\n\n\n<p>But last year, Gov. Kathy Hochul announced a shift in stance. She expressed significant concern in an interview with <a href=\"https:\/\/www.wcax.com\/2023\/09\/18\/new-gun-law-targeting-ammo-stirs-controversy-new-yorks-north-country\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-york-law-mandating-background-checks-for-ammo-brutalizing-gun-shops-gun-owners\" title=\"New York Law Mandating Background Checks for Ammo Brutalizing Gun Shops, Gun Owners\"><em>WCAX3<\/em><\/a>. <\/p>\n\n\n\n<p>\u201cI hope the whole system dies if I am going to be brutally honest,\u201d said Vann.  \u201cIt took eight hours between a computer tech and me to play with their website to get their website working.&#8221;<\/p>\n\n\n\n<p>She said the state&#8217;s treatment of gun owners and dealers is likely to put family-owned FFLs out of business.  <\/p>\n\n\n\n<p>\u201cThere is less and less of them all the time because it is a lot of work&#8230; This, I think, would just kill anybody\u2019s notion of having a family-owned gunshop,\u201d Vann said.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-national-shooting-sports-foundation-nssf-responds\">The National Shooting Sports Foundation (NSSF) Responds <\/h2>\n\n\n\n<p>Mark Oliva, NSSF&#8217;s managing director of public affairs, criticized Gov. Hochul\u2019s initiative. <\/p>\n\n\n\n<p>In an email to GunsAmerica, he explained how it shifts the focus from addressing criminal misuse of firearms to burdening firearm retailers. <\/p>\n\n\n\n<p>&#8220;Governor Hochul\u2019s order is predictable. Instead of addressing the issue of criminal misuse of firearms as a criminal issue and demanding her state attorney general and district attorneys abandon their soft-on-crime policies, she\u2019s shifted focus and attention to creating more burdens for firearm retailers and barriers for law-abiding gun owners,&#8221; said Oliva. <\/p>\n\n\n\n<p>&#8220;Her order punishes those who obey the law and treats them as criminals, yet actual criminals are being turned out on the streets with no accountability,&#8221; he continued.  &#8220;There is no indication that criminals, who already ignore the law, will suddenly stop committing crimes because of this punitive order.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-lawsuit-in-the-works\">Lawsuit In the Works <\/h2>\n\n\n\n<p>State Sen. George Borrello (R-Sunset Bay) has joined a federal lawsuit challenging this new background check mandate for ammo purchases.  <\/p>\n\n\n\n<p>\u201cMy office has been flooded with calls from law-abiding gun owners, sporting goods dealers and gun clubs who are upset about this latest assault on our Second Amendment rights,\u201d Borrello said in a statement. <\/p>\n\n\n\n<p>\u201cRequiring a background check and fees for each ammunition purchase is unconstitutional and has already proven to be a technological and administrative failure,&#8221; he continued. <\/p>\n\n\n\n<p>Clearly, this battle is far from over.
