This initiative comes directly from Senator John Cornyn&#8217;s &#8220;compromise&#8221; <a href=\"https:\/\/oese.ed.gov\/bipartisan-safer-communities-act\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-sounds-alarm-on-bidens-push-for-backdoor-universal-background-checks\" title=\"GOA Sounds Alarm on Biden's Push to Make Private Gun Sellers Obtain a License (FFL)!\">legislation<\/a>, passed last summer.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-implications-for-individual-sellers\"><strong>Implications for Individual Sellers<\/strong><\/h2>\n\n\n\n<p>Under the updated rule, selling even a single firearm for profit, even to relatives, could potentially place individuals under the &#8220;Engaged in the Business&#8221; category of gun sales. <\/p>\n\n\n\n<p>As a result, they&#8217;d be mandated to secure a federal license, conduct background verifications, and fulfill federal gun registration paperwork.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-examples-from-whitehouse-gov\">Examples from <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2023\/08\/31\/fact-sheet-biden-harris-administration-takes-another-life-saving-step-to-keep-guns-out-of-dangerous-hands\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-sounds-alarm-on-bidens-push-for-backdoor-universal-background-checks\" title=\"GOA Sounds Alarm on Biden's Push to Make Private Gun Sellers Obtain a License (FFL)!\">WhiteHouse.gov<\/a>: <\/h2>\n\n\n\n<p><em>For example, under the proposed rule, a person would be presumed to be required to become a licensed dealer and run background checks if they meet one or more of the following criteria:<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><em>Offer for sale any number of firearms and also represents to potential buyers that they are willing and able to purchase and sell them additional firearms;<\/em><\/li>\n\n\n\n<li><em>Repetitively offer for sale firearms within 30 days after they were purchased;<\/em><\/li>\n\n\n\n<li><em>Repetitively offer for sale firearms that are like new in their original packaging;<\/em><\/li>\n\n\n\n<li><em>Repetitively offer for sale multiple firearms of the same make and model; or<\/em><\/li>\n\n\n\n<li><em>As a formerly federally-licensed firearms dealer, sell firearms that were in the business inventory and not transferred to a personal collection at least a year before the sale, addressing the so-called \u201cfire sale loophole.&#8221;<\/em><\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-potential-boost-to-atf-gun-registry\"><strong>Potential Boost to ATF Gun Registry<\/strong><\/h2>\n\n\n\n<p>Gun Owners of America (GOA) emphasizes that this could augment the ATF&#8217;s current gun registry. <\/p>\n\n\n\n<p>Additionally, GOA believes it will impose challenges for private firearm sellers, forcing them to choose between becoming registered gun dealers or undertaking the task of arranging meetings with potential buyers at gun outlets. <\/p>\n\n\n\n<p>Obviously, the latter is not only time-consuming but it is costly due to FFL transfer fees. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-impact-of-the-zero-tolerance-policy\"><strong>Impact of the &#8216;Zero Tolerance&#8217; Policy<\/strong><\/h2>\n\n\n\n<p>Amidst these changes, the ATF&#8217;s recent <a href=\"https:\/\/www.gunsamerica.com\/digest\/pro-2a-groups-challenge-atfs-zero-tolerance-policy-in-federal-lawsuit\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"goa-sounds-alarm-on-bidens-push-for-backdoor-universal-background-checks\" title=\"GOA Sounds Alarm on Biden's Push to Make Private Gun Sellers Obtain a License (FFL)!\">&#8220;Zero Tolerance&#8221; stance <\/a>has reportedly pushed numerous gun dealers to shutter their businesses due to minor clerical errors.  <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-industry-leaders-weigh-in\"><strong>Industry Leaders Weigh In<\/strong><\/h2>\n\n\n\n<p>Erich Pratt, GOA\u2019s Senior Vice President, voiced his apprehension: <\/p>\n\n\n\n<p>\u201cFirst, they said five guns, but now, anyone who sells a single firearm in a given year and makes even a penny of profit will be subject to dealer requirements, including a background check,&#8221; said Pratt.<\/p>\n\n\n\n<p>&#8220;People need to realize this is just the next step in the anti-gunners\u2019 longform playbook to enact backdoor universal registration of firearms, and eventually, to confiscate all firearms.
