{"id":177843,"date":"2023-04-04T14:06:06","date_gmt":"2023-04-04T18:06:06","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=177843"},"modified":"2023-04-04T14:06:06","modified_gmt":"2023-09-08T18:35:43","slug":"oregons-sb348-sparks-outrage-among-states-firearm-owners","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/oregons-sb348-sparks-outrage-among-states-firearm-owners\/","title":{"rendered":"Oregon&#8217;s SB348 Sparks Outrage Among State&#8217;s Firearm Owners"},"content":{"rendered":"\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Measure 114 - &quot;The Dangerous Truth&quot; - Presented by PDX Arsenal &amp; Happy Hoodlums\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/87RbtKoFYzw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Oregon&#8217;s Senate Judiciary Committee has brought a sense of d\u00e9j\u00e0 vu to the state&#8217;s firearm owners with hearings on the newly amended Senate Bill 348 (SB348). <\/p>\n\n\n\n<p>Originally, SB348 required the State Department of Justice (DOJ) to study ways to address the unlawful possession of firearms and provide the results of the study to lawmakers. <\/p>\n\n\n\n<p>However, Amendment -3 effectively stripped the verbiage of the original bill, replacing it largely with the provisions of <a href=\"https:\/\/www.gunsamerica.com\/digest\/judge-blocks-oregons-measure-114-at-least-for-now\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Measure 114,<\/a> Oregon&#8217;s last gun-control effort, which is currently facing legal challenges in both federal and state courts. <\/p>\n\n\n\n<p>Measure 114 passed by a narrow margin in Oregon\u2019s last election, prompting lawsuits from pro-gun organizations.<\/p>\n\n\n\n<p>Federal Judge Karen Immergut initially <a href=\"https:\/\/www.documentcloud.org\/documents\/23376811-trodenied\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">allowed the law to stand<\/a> at the federal level, but Oregon Circuit Court Judge Robert Raschio issued an <a href=\"https:\/\/www.gunsamerica.com\/digest\/judge-blocks-oregons-measure-114-at-least-for-now\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">injunction<\/a> against its implementation pending a Constitutional challenge at the state level.&nbsp;<\/p>\n\n\n\n<p>\u201cSenate Bill 348 is a disingenuous attempt to usurp the authority of Oregon courts, an attempt to violate the separation of powers,\u201d Oregon NRA Director Aiobheann Cline <a href=\"https:\/\/www.koin.com\/news\/oregon\/sb-348-is-or-democrats-second-attempt-for-gun-control\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">told <em>KOIN News<\/em><\/a>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-see-also-judge-blocks-oregon-s-measure-114-at-least-for-now\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/judge-blocks-oregons-measure-114-at-least-for-now\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Judge Blocks Oregon\u2019s Measure 114 \u2014 At Least for Now<\/a><\/h2>\n\n\n\n<p>During testimonies, other opponents of the bill shared similar concerns as the true nature of the bill was only revealed on Friday when State Sen. Floyd Prozanski, the sponsor of the bill, introduced a 64-page amendment that constituted the substance of the bill.<\/p>\n\n\n\n<p>\u201cIt\u2019s an end-run around our system of checks and balances,\u201d said Bryan Mumford, owner of <a href=\"https:\/\/pdxarsenal.com\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Clackamas-based PDX Arsenal<\/a>, in an interview with GunsAmerica Disgest. \u201c[Measure] 114 is tied up in the courts, so they\u2019re trying this to get around the legal challenges.\u201d&nbsp;<\/p>\n\n\n\n<p>Mumford has a vested interest in both Measure 114 and the newly-rebranded effort in SB348. He says that there was a significant increase in firearms training and licensing during the civil unrest of the riots in downtown Portland and across the country, and this trend continued after the passing of Measure 114.<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">Here is my testimony in Oregon from this past week. It created a lot of uncertainty not only for us as trainers, but for the people as well,\u201d Mumford said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/oregon-democrats-propose-3-new-bills-in-latest-gun-control-efforts\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Oregon Democrats Propose 3 New Bills in Latest Gun Control Push<\/a><\/h2>\n\n\n\n<p>The text of Measure 114 laid out guidelines for training and safety classes, but it lacked any specific standards for the training requirement or information on who was authorized to provide the training. This ambiguity, combined with the absence of a solid framework for the permitting system, led to the court&#8217;s injunction. The law mandated a permit that was impossible for anyone to obtain. The trial for the legal challenge against Measure 114 is set for September.<\/p>\n\n\n\n<p>The progress of SB348 would seem to fly in the face of the court\u2019s effort to address the Constitutional challenge of Measure 114, while doubling-down on the amount of gun control it seeks to impose.&nbsp;<\/p>\n\n\n\n<p>In addition to the implementation of the provisions of Measure 114, SB348 would strip most gun rights from adults aged 18-20, impose a 3-day waiting period after a background check approval, a requirement that any legal challenge \u201cmust be commenced in the Circuit Court for Marion County,\u201d and it would more than double the proposed PTP fee from $65 for a 5-year permit to $150.&nbsp;<\/p>\n\n\n\n<p>\u201cThis can put some people out of the ability to actually buy a firearm and use them,\u201d Candace Yow, the Oregon Director for <a href=\"https:\/\/www.dcproject.info\/team\/oregon\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">DC Project<\/a>, a nonpartisan firearm advocacy group for women, told <em>KOIN News<\/em>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/oregon-appellate-court-overturns-2a-sanctuary-ordinance\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Oregon Appellate Court Overturns 2A Sanctuary Ordinance<\/a><\/h2>\n\n\n\n<p>SB348 faces stiff opposition already, despite the last-minute nature of Prozanki\u2019s amendment. <a href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2023R1\/Measures\/Testimony\/SB348\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">Testimony at a hearing<\/a> in the Senate Judiciary Committee was overwhelmingly in opposition to the bill. The <em>Capital Chronicle<\/em> <a href=\"https:\/\/oregoncapitalchronicle.com\/2023\/03\/28\/dozens-testify-against-firearm-bill-that-critics-say-tries-to-circumvent-the-courts\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"oregons-sb348-sparks-outrage-among-states-firearm-owners\" title=\"Oregon's SB348 Sparks Outrage Among State's Firearm Owners\">noted <\/a>that supporters were outnumbered 5 to 1 by those who opposed to the measure.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;It doesn\u2019t really give you a feeling like you\u2019re really being represented by your government in that situation.&#8221;<\/p>\n<cite>Bryan Mumford of PDX Arsenal, on giving testimony to the Oregon Legislature<\/cite><\/blockquote>\n\n\n\n<p>Mumford, who made the trip to Salem from the Portland area several times during the latest gun-control efforts, said that even in the face of such a large number of people willing to give testimony against the measure, \u201cYou could see that the sponsors of the bill wouldn\u2019t even engage with people. They were looking at papers, or looking around, not really even seeming to pay attention.\u201d <\/p>\n\n\n\n<p>He added, \u201cIt doesn\u2019t really give you a feeling like you\u2019re really being represented by your government in that situation.\u201d<\/p>\n\n\n\n<p>As of the writing of this article, GunsAmerica has not received a response from Prozanski&#8217;s office regarding the likelihood of SB348&#8217;s implementation in light of the legal challenges facing Measure 114.<\/p>\n\n\n\n<p>With another working session scheduled for April 4th, and no floor sessions yet scheduled, updates
