It wasn\u2019t entirely unexpected.<\/p>\n\n\n\n<p>The U.S. House Subcommittee on Crime and Federal Government Surveillance\u2019s&nbsp;<strong><a href=\"https:\/\/judiciary.house.gov\/committee-activity\/hearings\/subcommittee-crime-and-federal-government-surveillance-atfs-assault\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">hearing<\/a><\/strong>&nbsp;titled, \u201cATF\u2019s Assault on the Second Amendment: When is Enough Enough?\u201d posed a simple question.<\/p>\n\n\n\n<p>Who writes law in the United States? That begged other questions. Can government agencies go rogue and create sweeping regulations that turn law-abiding citizens into criminals? Or does law-making authority reside with the people through their duly elected representatives in Congress?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Background<\/h2>\n\n\n\n<p>The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) promulgated a&nbsp;<strong><a href=\"https:\/\/www2.nssf.org\/l\/127421\/2023-01-13\/4qhscg\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">new Final Rule<\/a><\/strong>&nbsp;in January with drastic implications for millions of existing law-abiding gun owners. The agency unilaterally decreed that stabilizing arm braces attached to pistols are now defined as short-barreled rifles (SBRs) subject to registration under the National Firearms Act (NFA). That means owners who already legally purchased the firearm accessory must register their purchase, submit photos and fingerprints, pass an additional background check and alert local law enforcement that they possess one. If they don\u2019t, they risk facing felony charges and imprisonment. The Congressional Research Service estimates there could be upwards of 40 million braces in circulation today.<\/p>\n\n\n\n<p>Alex Bosco testified about how we got here today. The former Marine invented the forearm stabilizing brace in 2012 to help disabled veterans more safely participate in recreational pistol shooting.<\/p>\n\n\n\n<p>\u201cSince I began my business, I\u2019ve made every effort to comply with all the rules and regulations set out by ATF. After submitting the original brace to ATF for review, ATF responded in writing stating that attaching a stabilizing brace \u2013 quote \u2013 would not alter the classification of a pistol or other firearm, and that \u2013 quote \u2013 such a firearm would not be subject to National Firearms Act controls,\u201d Bosco explained. He added ATF has \u201crepeatedly held that various pistol brace designs did not convert a pistol to a short-barreled rifle.\u201d<\/p>\n\n\n\n<p>That all changed once ATF reclassified stabilizing arm brace-attached pistols as SBRs, putting Bosco\u2019s livelihood, and millions of other law-abiding Americans, at serious risk.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Whose Authority?<\/h2>\n\n\n\n<p>Subcommittee Chairman Rep. Pat Fallon (R-Texas) asked the central question of who writes law for the United States.<\/p>\n\n\n\n<p>\u201cEver since Mr. Biden took office, his administration has actively sought to infringe on the Second Amendment and I\u2019m deeply concerned about the ATF and their recent actions,\u201d Rep. Fallon said. \u201cThis rule will effectively turn millions of law-abiding gun owners into criminals if they fail to comply even though Congress did not act. We didn\u2019t pass any new criminal laws or penalties related to pistol stabilizing braces. We had unelected bureaucrats do it. That\u2019s not the way this works.\u201d<\/p>\n\n\n\n<p>Rep. Chip Roy (R-Texas) echoed, adding that bureaucratic rulemaking is wrong under Republican and Democratic administrations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">WATCH: <a href=\"https:\/\/www.gunsamerica.com\/digest\/watch-gun-control-witness-admits-communicating-with-atf-director-before-pistol-brace-rule\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">Gun Control Witness Admits Communicating with ATF Director Before Pistol Brace Rule<\/a><\/h2>\n\n\n\n<p>\u201cThis should send shivers done the spine of all members under Article II,\u201d Rep. Roy said. \u201cAnd look, I don\u2019t view this through the lens of being a Democratic administration. I didn\u2019t like it when the Trump administration was doing stuff like this. Whether it was the bump stock ban \u2013 I didn\u2019t like that either.\u201d<\/p>\n\n\n\n<p>Heritage Foundation\u2019s Amy Swearer agreed the ATF rulemaking is Constitutionally problematic.<\/p>\n\n\n\n<p>\u201cOur Constitution is set up with a separation of powers. You have the Executive Branch, whose job it is to enforce the law and you have Congress who passes laws because Congress is held accountable to the people,\u201d Swearer said. \u201cNo official at the ATF\u2026 is elected and held accountable through that process.\u201d<\/p>\n\n\n\n<p>The overreach by ATF may be rectified in due time if recent precedent plays out. The U.S. Court of Appeals for the Fifth Circuit&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/what-the-fifth-circuits-striking-of-bump-stock-rule-portends-for-atf-generated-rules\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\"><strong>overwhelmingly overruled<\/strong><\/a>&nbsp;the Trump administration\u2019s ATF Final Rule, saying it overstepped its authority to classify bump stocks as \u201cmachineguns.\u201d In 2021, the U.S. Supreme Court&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/why-a-supreme-court-epa-ruling-could-doom-recent-atf-rules\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">over<\/a><a href=\"https:\/\/www.nssf.org\/articles\/why-a-supreme-court-epa-ruling-could-doom-recent-atf-rules\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">ruled<\/a><\/strong>&nbsp;the Environmental Protection Agency (EPA) Clean Power Plan in&nbsp;<em>West Virginia v. EPA<\/em>&nbsp;because the agency overstepped its authority with similar rulemaking without clear congressional authorization.<\/p>\n\n\n\n<p>The ATF stabilizing arm brace rule could be&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/firearm-industry-expert-veteran-testifies-against-atf-overreach\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">headed<\/a><\/strong>&nbsp;toward a similar fate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Know What You\u2019re Talking About<\/h2>\n\n\n\n<p>Democratic lawmakers demonstrated they are uninformed about the arm brace accessory.<\/p>\n\n\n\n<p>Democratic lawmakers used terminology like \u201chigh-powered,\u201d \u201cincreasingly lethal,\u201d and \u201cweapons of war.\u201d Rep. Sheila Jackson Lee (D-Texas) praised the ATF for usurping her congressional authority \u201cto prevent\u2026the misuse of stabilizing braces, which convert everyday firearms into killing machines.\u201d<\/p>\n\n\n\n<p>It was similar to when Rep. David Cicilline (D-R.I.)&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/democrats-end-game-revealed-in-assault-weapons-ban-bill\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">misidentified<\/a><\/strong>&nbsp;an arm brace, confusing it for a bump stock, during a previous debate.<\/p>\n\n\n\n<p>Rep. Chuck Edwards (R-N.C), a Federal Firearms Licensee, asked Everytown for Gun Safety Senior Director for Policy Rob Wilcox about the accessory. \u201cWill a pistol brace change the capacity of a firearm? Meaning the number of rounds?\u201d<\/p>\n\n\n\n<p>\u201cNo sir,\u201d Wilcox responded.<\/p>\n\n\n\n<p>\u201cWill a pistol brace change the firing speed of a firearm?\u201d Rep. Edwards continued.<\/p>\n\n\n\n<p>\u201cNo sir.\u201d Wilcox answered.<\/p>\n\n\n\n<p>Rep. Edwards asked Bosco about the confusion.<\/p>\n\n\n\n<p>\u201cI think the problem is that a lot of people aren\u2019t informed about what is and isn\u2019t a pistol and what is and isn\u2019t a rifle. It\u2019s very nuanced,\u201d Bosco replied. \u201cA stabilizing brace is not a force multiplier.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Gun Control Won\u2019t Stop<\/h2>\n\n\n\n<p>The ATF pistol brace rule is yet another example of the Biden administration going beyond its authority to restrict the Second Amendment rights of law-abiding Americans. Gun control groups have grown frustrated that more hasn\u2019t been done, while ignoring the criminals who are the ones committing violent crimes.<\/p>\n\n\n\n<p>Manuel Oliver, whose son was murdered in the 2018 Parkland high school shooting, disrupted the committee hearing, was removed and subsequently&nbsp;<strong><a href=\"https:\/\/nypost.com\/2023\/03\/23\/manuel-oliver-father-of-parkland-victim-arrested-at-gun-hearing\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\">arrested<\/a>.<\/strong>&nbsp;Oliver&nbsp;<a href=\"https:\/\/www.politico.com\/news\/2022\/07\/11\/parkland-father-biden-gun-control-00045120\" target=\"_blank\" class=\"clickTracking\" campaign=\"fireworks-at-congressional-hearing-on-atf-and-who-makes-the-laws\" title=\"Fireworks at Congressional Hearing on ATF and Who Makes the Laws\"><strong>also disrupted and was removed<\/strong><\/a>&nbsp;from a White House ceremony when President Biden announced several gun control executive actions.<\/p>\n\n\n\n<p>The actions by gun control groups, Democratic lawmakers shaming companies for not doing their gun control bidding and the ATF overreaching its authority on the pistol brace Final Rule are a pattern. It shows the goal is not to hold criminals accountable.
