<\/p>\n\n\n\n

Video released Thursday shows an off-duty Chicago police officer shouting “I’ll kill you” before fatally shooting a man who allegedly grabbed for her gun during a struggle in Washington Heights on the South Side last month.<\/p>\n\n\n\n

The Civilian Office of Police Accountability released the private surveillance footage<\/a> on Thursday. The video shows Leevon Smith arguing with a group of people just before 1 p.m. on Jan. 18. <\/p>\n\n\n\n

It then shows the off-duty police officer attempting to diffuse the situation while urging everyone to \u201ccalm down.\u201d\u00a0 The officer spoke with Smith for just over a minute before the situation escalated to a physical altercation between the two parties.<\/p>\n\n\n\n

According to an arrest report, the unnamed cop told responding officers she witnessed \u201ca verbal argument,\u201d before the shooting occurred. While trying to handle the situation, she said Smith grabbed her from behind and reached for her gun \u201cin an attempt to disarm her.\u201d<\/p>\n\n\n\n

The report states that the two fell to the ground while struggling for the gun, after which the officer opened fire, hitting Smith in the abdomen and left hand. <\/p>\n\n\n\n

The officer can be heard yelling “I’ll kill you” before firing two shots. <\/p>\n\n\n\n

\u201cI told your dumb\u2014 I\u2019d kill you,\u201d the officer says as she fires a third shot. You tried to steal my f\u2014ing gun. I don\u2019t give no f\u2014 about him. He just tried to rob me.\u201d<\/p>\n\n\n\n

Smith can be heard saying \u201cBaby, I\u2019m sorry. \u2026 I don\u2019t want to die.\u201d<\/p>\n\n\n\n

The officer then yells for someone to call the police while continuing to scream at Smith. The video shows no evidence of the officer offering aid to the wounded man. <\/p>\n\n\n\n

When emergency personnel arrived, the officer is seen walking into the building and then back out while on the phone. When asked where she had hit Smith, she replied, “I don’t know.”<\/p>\n\n\n\n

\u201cF\u2014 it, I can\u2019t believe this just happened to me,\u201d she said while explaining to first responders that she was cop and Smith had tried to steal her \u201coff-duty gun.\u201d<\/p>\n\n\n\n

Smith was taken into custody and later pronounced dead at Christ Medical Center on Jan. 20.<\/p>\n\n\n\n

According to a tactical response report, Leevon Smith posed an “imminent threat of battery” even without a weapon and physically attacked the off-duty Chicago officer. The report states she was ambushed with “no warning” and fired three shots. <\/p>\n\n\n\n

The officer was treated for a laceration above her right eye at Little Company of Mary Hospital in Evergreen Park, according to the arrest report. She joined the police force in June 2022, according to records. The officer has not been formally accused of wrongdoing and her name has been redacted from reports until an investigation is completed. <\/p>\n\n\n\n

The Civilian Office of Police Accountability released a 911 call that appears to capture the initial interaction between Smith and the group of people before the shooting.<\/p>\n\n\n\n

\u201cJust give me my bag back, bro,\u201d someone is heard saying in the background of the call.<\/p>\n\n\n\n

In another call, someone else tells a dispatcher that an attempted robber was being held for police by the victim. The shooting is reported in multiple, separate 911 calls.<\/p>\n\n\n\n

\u201cThere\u2019s a lady outside with a gun and she shot somebody. \u2026 She\u2019s going inside with the gun,\u201d one caller said.<\/p>\n\n\n\n

The officer eventually called 911 herself and reported that she shot Smith as he tried to rob her. \u201cI\u2019m trying to call my bosses, but ain\u2019t no one answering for me,\u201d she said.<\/p>\n\n\n\n

Cook County prosecutors approved felony charges against Smith, according to the arrest report. However, they will not be able to pursue counts of attempted robbery or aggravated battery because Smith passed away the next day. <\/p>\n\n\n\n

Currently, the charges don’t appear in county court records.<\/p>\n\n\n\n

Smith’s estate filed a $10 million lawsuit against the city and the officer on Feb. 3, claiming that the officer used “excessive and violent physical force” and “knew or should have known that such force was not necessary in light of the circumstances.” <\/p>\n\n\n\n

The suit claims that Smith’s “estate was diminished by virtue of the medical and funeral expenses that were incurred,” adding that his family “suffered injuries as a result of his death, including, but not limited to, the loss of companionship and society, grief, sorrow and mental anguish.”<\/p>\n\n\n\n
