Or, pistol brace owners have these additional options:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Remove and replace the barrel with 16\u201d or longer barrel<\/li>\n\n\n\n<li>Permanently remove or dispose of the stabilizing brace<\/li>\n\n\n\n<li>Turn in your firearm to the ATF<\/li>\n\n\n\n<li>Destroy your firearm<\/li>\n<\/ul>\n\n\n\n<p>Opponents of the rule cite industry data and the bipartisan Congressional Research Service, which <a href=\"https:\/\/crsreports.congress.gov\/product\/pdf\/LSB\/LSB10592\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\">estimate<\/a> that up to 40 million firearms could be affected by these changes. <\/p>\n\n\n\n<p>However, the ATF\u2019s<a href=\"https:\/\/www.atf.gov\/rules-and-regulations\/docs\/undefined\/atf2021r-08stabilizingbracefrriapdf\/download\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\"> impact analysis<\/a> dismisses that estimate and claims that \u201conly\u201d three million firearms could be impacted.<\/p>\n\n\n\n<p>Upon the rule&#8217;s publication in the Federal Register, 2A groups were ready with their legal challenges.<\/p>\n\n\n\n<p>Both the <a href=\"https:\/\/www.firearmspolicy.org\/fpc-files-new-lawsuit-challenging-atf-pistol-brace-rulemaking\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\">Firearms Policy Coalition<\/a> (FPC) and the <a href=\"https:\/\/www.texaspolicy.com\/press\/tppf-atfs-stabilizing-brace-rule-violates-federal-law-and-the-constitution\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\">Texas Public Policy Foundation<\/a> (TPPF) filed federal lawsuits in the Northern District and Eastern District of Texas, respectively.<\/p>\n\n\n\n<p>Both suits challenge the rule on the basis that the ATF and Dept. of Justice are violating both the Administrative Procedure Act and the U.S. Constitution.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;The Department of Justice cannot rewrite federal statutes by bureaucratic diktat and decide to turn millions of law-abiding Americans into criminals guilty of a felony. The Constitution gives Congress\u2014not executive agencies\u2014the legislative power to amend laws.&#8221;<\/p>\n<cite>TPPF Senior Attorney Autumn Hamit Patterson<\/cite><\/blockquote>\n\n\n\n<p>However, the largest effort against the ATF&#8217;s &#8220;administrative fiat&#8221; is a new federal lawsuit being brought by a coalition of 25 states led by West Virginia Attorney General Patrick Morrisey and North Dakota Attorney General Drew Wrigley, along with the Firearms Regulatory Accountability Coalition (FRAC) as lead plaintiff, firearm and brace manufacturers, and a wounded veteran. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/federal-judge-says-gun-ownership-a-right-for-cannabis-users\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\">Federal Judge Says Gun Ownership a Right for Cannabis Users<\/a><\/h2>\n\n\n\n<p>Filed in the U.S. District Court of North Dakota, the lead plaintiffs are joined by the attorneys general of Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, Virginia, and Wyoming.<\/p>\n\n\n\n<p>&#8220;ATF repeatedly issued letter rulings assuring manufacturers and the public that attaching a stabilizing brace would not alter the statutory or regulatory classification of a pistol or other firearm,&#8221; explains the\u00a0<a href=\"https:\/\/dojmt.gov\/wp-content\/uploads\/Complaint-c1.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\" target=\"_blank\" rel=\"noreferrer noopener\">46-page suit<\/a>. <\/p>\n\n\n\n<p>&#8220;As a result, millions of Americans have for years lawfully purchased stabilizing braces and pistols equipped with stabilizing braces from authorized, legitimate manufacturers with ATF\u2019s full knowledge and express approval,&#8221; it continues.<\/p>\n\n\n\n<p>The government has already received a similar loss when the 5th U.S. Circuit Court of Appeals <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/gdpzqwrjdvw\/01062023cargill.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"clock-ticks-on-atf-final-pistol-brace-rule-while-lawsuits-abound\" title=\"Clock Ticks on ATF Final Pistol Brace Rule, While Lawsuits Abound\">overturned the ATF\u2019s bump stock ban<\/a> based, in part, on the fact that the ATF lacks legislative authority to create new laws.  In short, the ATF is a regulatory agency, not a legislative body.  It cannot prohibit a lawfully-owned product via executive fiat.  <\/p>\n\n\n\n<p>Given that the ATF\u2019s final rule on pistol braces seeks to create a similar situation, the coalition lawsuit, as well as the FPC and TPPF lawsuits, all seem to have a solid legal basis in their challenges going forward.
