Gavin Newsom might be pining for a bid at the country\u2019s highest political office but he needs a refresher on Civics 101. Specifically, he should get a refresh of how the courts decide the constitutionality of law.<\/p>\n\n\n\n<p>His message to law-abiding Californians and the judge whose recent rulings struck down his previous gun control laws was clear: Shove it.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Gun Restrictions Repeat<\/h4>\n\n\n\n<p>Gov. Newsom held a press conference with Democratic Attorney General Rob Bonta and several Democratic antigun state legislators announcing a new round of strict gun control measures.<\/p>\n\n\n\n<p>At the&nbsp;<a href=\"https:\/\/www.youtube.com\/watch?v=Ny_JkPZRiEw\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\"><strong>media event<\/strong><\/a><strong>,<\/strong>&nbsp;Gov. Newsom announced his support for expanded concealed carry restrictions. There was no mention of cracking down on criminals \u2013 just those who obey the law. His new plan includes banning concealed carry in churches, public libraries, zoos, amusement parks, playgrounds, banks and other privately-owned businesses open to the public.<\/p>\n\n\n\n<p>The U.S. Supreme Court warned that overly inclusive \u201csensitive places\u201d laws would run afoul of the Second Amendment. Justice Clarence Thomas, writing in the majority opinion, stated encompassing broad areas as sensitive places simply because police are present for public protection is casting a net too wide.<\/p>\n\n\n\n<p>\u201cIt is true that people sometimes congregate in \u2018sensitive places,\u2019 and it is likewise true that law enforcement professionals are usually presumptively available in those locations,\u201d Justice Thomas&nbsp;<strong><a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">wrote<\/a>.<\/strong>&nbsp;\u201cBut expanding the category of \u2018sensitive places\u2019 simply to all places of public congregation that are not isolated from law enforcement defines the category of \u2018sensitive places\u2019 far too \u201cbroadly.\u201d<\/p>\n\n\n\n<p>That didn\u2019t matter \u2013 the proposal had the governor\u2019s full-throated support. The proposed legislation would also ban any Californian under the age of 21 from having a permit to carry a concealed gun despite 18-year-olds being fully vested in their Constitutional rights as adults.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Bad History Lesson<\/h4>\n\n\n\n<p>Gov. Newsom has never seen a gun control law he didn\u2019t love. His disdain for the Second Amendment is so deep that he\u2019s even attacked the First Amendment rights of the firearm industry as an end around to further limit the Second Amendment rights of Californians.<\/p>\n\n\n\n<p>Last year, Gov. Newsom signed a law attacking firearm industry businesses for their protected free speech in advertising because he believes youth recreational and target shooting leagues will lead to \u201cmass shooting and mass destruction\u201d events. As a result, the California State High School Clay Target League \u2013 a nationally renowned youth league \u2013 shuttered.<\/p>\n\n\n\n<p>At the time, league president John Nelson&nbsp;<strong><a href=\"https:\/\/www.fieldandstream.com\/guns\/california-gun-law-ends-youth-shooting-league\/?utm_medium=syndication&amp;utm_source=msnarticles\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">wrote<\/a>,<\/strong>&nbsp;\u201cThe League is the safest sport in high school. Over 1,500 schools across the nation have approved our program. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">Pistol Review: Sig Sauer P365-380<\/a><\/h2>\n\n\n\n<p>The governor was forced to walk back portions of the hastily passed bill when it became apparent that hunting safety courses \u2013 required for state hunting licenses \u2013 would be affected.<\/p>\n\n\n\n<p>Also last year Gov. Newsom signed into law AB 1594, a bill that would allow AG Bonta to help public and private parties sue firearm manufacturers and retailers for the criminal misuse of firearms. This law is strikingly similar and modeled on a New Jersey law that a federal judge last week enjoined the state from enforcing because it was a transparent attempt to circumvent the Protection of Lawful Commerce in Arms Act (PLCAA) and therefore unconstitutional. NSSF will soon file a lawsuit against Attorney General Bonta in federal court to challenge the constitutionally of AB 1594. By the way, AG Bonta is the same attorney general whose office&nbsp;<strong>\u201c<a href=\"https:\/\/bearingarms.com\/camedwards\/2022\/06\/28\/crpa-california-data-breach-exposes-personal-details-of-concealed-carry-holders-n59835\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">leaked<\/a>\u201d<\/strong>&nbsp;the personal and confidential information of California pistol permit holders.<\/p>\n\n\n\n<p>A victory for California\u2019s lawful gun owners also came in 2021, when U.S. District Court Judge Roger Benitez&nbsp;<a href=\"https:\/\/thereload.com\/california-assault-weapons-ban-struck-down\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">The Axor Arms PAF12GA \u2013 Folding Pump Action<\/a><\/h2>\n\n\n\n<p>\u201cThis case is not about extraordinary weapons lying at the outer limits of Second Amendment protection,\u201d Judge Benitez wrote. \u201cThe banned \u2018assault weapons\u2019 are not bazookas, howitzers, or machineguns. Instead, the firearms deemed \u2018assault weapons\u2019 are fairly ordinary, popular, modern rifles.\u201d<\/p>\n\n\n\n<p>\u201cThis is an average case about average guns used in average ways for average purposes,\u201d Judge Benitez continued.<\/p>\n\n\n\n<p>There are currently more than&nbsp;<a href=\"https:\/\/www.nssf.org\/articles\/commonly-owned-nssf-announces-over-24-million-msrs-in-circulation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\"><strong>24.4 million<\/strong><\/a>&nbsp;commonly-owned MSRs in circulation today since 1990.<\/p>\n\n\n\n<p>Gov. Newsom called the judge an \u201cidealogue\u201d with a \u201chistory only approach.\u201d It\u2019s the same judge who just two months ago&nbsp;<strong><a href=\"https:\/\/www.breitbart.com\/politics\/2022\/12\/20\/district-judge-blocks-ca-fee-shifting-provision-gun-control-cases\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"gov-newsom-flaunts-antigun-contempt-for-courts-champions-more-gun-control\" title=\"Gov. Newsom Flaunts Antigun Contempt for Courts, Champions More Gun Control\">blocked<\/a><\/strong>&nbsp;another antigun law that would force those bringing lawsuits against California\u2019s restrictive laws to pay the legal fees, therefore causing attorneys to shy away from taking cases against gun control.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Broken Record<\/h4>\n\n\n\n<p>Gov. Newsom\u2019s ire toward gun owners is a sharp contrast to his soft-on-crime approach. In 2021, the police department in California\u2019s largest city had a message to residents:<\/p>\n\n\n\n<p>\u201cIf you are being robbed, do not resist the robbery suspects; cooperate and comply with their demands. Be a good witness,\u201d they said in a press release.<\/p>\n\n\n\n<p>By enacting even more unconstitutional gun restrictions on law-abiding Californians, Gov. Newsom told citizens their rights and safety don\u2019t matter.
