Within two days of the January 22nd shooting at a Monterey Park, CA dance hall that killed 11, and left 9 injured, President Biden was again calling for an “assault weapon ban”<\/a> in a knee-jerk response to the crime.<\/p>\n\n\n\n

\u201cI urge both chambers of Congress to act quickly and deliver this Assault Weapons Ban to my desk.” – Pres. Biden<\/p>\nWhite House Press Statement – Jan. 23 2023<\/cite><\/blockquote>\n\n\n\n

<\/p>\n\n\n\n

While it is true that this current scheme of firearm classification often lists nearly any firearm with two or more features commonly seen in military-style weapons, it was the simple fact that the Monterey Park shooter’s firearm came with a threaded barrel and 30-round magazine that earned it a designation of “assault weapon,” and doomed it to draw the focus of gun control efforts everywhere.<\/p>\n\n\n\n

But therein lies the catch. The shooter’s gun — a Cobray M11\/9 — was already illegal for him to own under California law<\/a>.<\/p>\n\n\n\n

Despite a cosmetic similarity to the fabled “Mac 10” submachine gun, this cheap cosmetic clone is functionally a 9mm semi-automatic pistol.<\/p>\n\n\n\n

This also means that the shooter would not have legally been able to purchase the firearm in another state where it might have been legal, then cross state lines into California and bring the firearm back with him, as some social media users have suggested<\/a>.<\/p>\n\n\n\n

However, this hasn’t stopped Democrats and gun control activists across the country from parroting repeated calls<\/a> for a renewed “assault weapon ban,” like the one Sen. Dianne Feinstein recently introduced<\/a>.<\/p>\n\n\n\n

However, many people are already beginning to wonder<\/a> how banning a firearm that was already illegal, could make any difference. <\/p>\n\n\n\n

Indeed, it pokes at the underlying question to nearly all gun-control efforts: when someone has already decided to break the most serious of society’s laws and take another person’s life, what could more gun laws possibly hope to accomplish? And what could anyone expect Congress to do at the national level that California hasn’t already tried?<\/p>\n\n\n\n

Perhaps more importantly to the lawful gun owners throughout the country: What instead will be the unintended consequences to those of us who safely and responsibly enjoy our rights?<\/p>\n\n\n\n

With a Republican-controlled House and almost evenly divided Senate, it would seem unlikely that a new “assault weapons” ban would have much of a chance of passing. But in the current political climate and 24-hour news cycle that fixates on tragedies like the recent ones in Monterey Park and Half Moon Bay, gun owners know by now not to take anything for granted. <\/p>\n\n\n\n
