{"id":169653,"date":"2022-10-19T12:42:52","date_gmt":"2022-10-19T16:42:52","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=169653"},"modified":"2022-10-19T12:42:52","modified_gmt":"2023-09-08T10:46:55","slug":"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\/","title":{"rendered":"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Proposed changes to New Jersey&#039;s gun laws\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/ya3S8BX2psU?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Anti-gun lawmakers in New Jersey are rushing to restrict 2A rights in the wake of the Supreme Court\u2019s landmark <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-843_7j80.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\" title=\"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0\"><em>Bruen<\/em> decision<\/a>, which declared that \u201cmay-issue\u201d concealed carry licensing schemes are unconstitutional.<\/p>\n\n\n\n<p>The measure, known as <a href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2022\/A4769\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\" title=\"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0\">A4769<\/a>, is being fast-tracked in the Legislature. &nbsp;<\/p>\n\n\n\n<p>A4769 would do all of the following, among other provisions:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Establishes a thorough vetting process for those who apply for concealed carry permits by increasing the number of non-family references who must vouch for applicants, and creating new disqualifications from the permit process such as \u201ccharacter of temperament\u201d and past violations of restraining orders and convictions.<\/li><li>Prohibits permit holders from carrying handguns in broad categories including schools, government buildings, polling places, bars and restaurants, theaters, sporting arenas, parks, airports, casinos and childcare facilities.<\/li><li>Requires property owners to opt into allowing permittees to carry on their premises.<\/li><li>Requires concealed-carry permittees to undergo gun safety training, including a gun range qualification.<\/li><li>Imposes new insurance requirements on handgun ownership to ensure victims of an accidental discharge are appropriately compensated and protected.<\/li><li>Increases permitting fees across the board to cover the cost of stepped-up background checks and these new provisions.<\/li><li>Funds the Victims of Crime Compensation Office (VCCO) by channeling revenue from the increased fees.<\/li><\/ul>\n\n\n\n<p>The bill&#8217;s primary sponsor is Assemblyman Joe Danielsen (D-Somerset).&nbsp; Danielsen is an army veteran and gun owner who believes the new measure is \u201ccommonsense.\u201d &nbsp;<\/p>\n\n\n\n<p>\u201cAs a recreational hunter, I know that commonsense gun reform doesn\u2019t stop sportsmen like me from continuing traditions that have been passed down through our families for generations,\u201d said Assemblyman Danielsen in a press release obtained by GunsAmerica.&nbsp;<\/p>\n\n\n\n<p>\u201cAnd, as a father, I know how important it is to keep our communities and schools safe. Since Democrats control both the General Assembly and the Senate, it&#8217;s likely to wind up on the desk of Gov. Phil Murphy, who is also a Democrat. <\/p>\n\n\n\n<p>Murphy has made his intentions clear as to whether he would sign A4769 into law:<\/p>\n\n\n\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">The Supreme Court made a disastrous decision that makes it easier for people to obtain permits to carry firearms in public. This decision will not make us safer.<br \/> <br \/>I look forward to signing a bill into law that protects the public from gun violence.<a href=\"https:\/\/t.co\/4VsEqEnkoQ\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\" title=\"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0\">https:\/\/t.co\/4VsEqEnkoQ<\/a><\/p>\u2014 Governor Phil Murphy (@GovMurphy) <a href=\"https:\/\/twitter.com\/GovMurphy\/status\/1580654014735126530?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\" title=\"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0\">October 13, 2022<\/a><\/blockquote> \n\n\n\n<p>Scott Bach, the head of the Association of New Jersey Rifle &amp; Pistol Clubs, does not believe the measure passes constitutional muster.  <\/p>\n\n\n\n<p>\u201cThis bill is a big middle finger to the United States Supreme Court,\u201d Bach told <a href=\"https:\/\/www.nj.com\/politics\/2022\/10\/fast-tracked-concealed-carry-bill-in-nj-narrowly-moves-closer-to-becoming-law.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"new-jersey-lawmakers-rush-to-restrict-2a-rights-in-wake-of-bruen-decision\" title=\"New Jersey Lawmakers Rush to Restrict 2A Rights in Wake of Bruen Decision\u00a0\"><em>NJ.com<\/em><\/a>. <\/p>\n\n\n\n<p id=\"6XK2ZJU5VVFRBGQ53BUC4KFOCE\">\u201cLike it or not, New Jersey is now a carry state,\u201d Bach said. \u201cRespectfully, that doesn\u2019t mean you get to do an end-run around carry. And that\u2019s what this bill is.\u201d<\/p>\n\n\n\n<p>A similar bill restricting carry rights has already been enacted in New York following <em>Bruen<\/em>.
