{"id":169175,"date":"2022-10-04T10:03:34","date_gmt":"2022-10-04T14:03:34","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=169175"},"modified":"2022-10-04T10:03:34","modified_gmt":"2023-09-08T10:10:47","slug":"court-halts-philly-gun-ban-in-parks-recreational-centers","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/court-halts-philly-gun-ban-in-parks-recreational-centers\/","title":{"rendered":"Court Halts Philly Gun Ban in Parks, Recreational Centers\u00a0"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Mayor Jim Kenney signs executive order banning guns from Philadelphia park facilities\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/8L2ZtrMPQWk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Last week, Philadelphia Mayor Jim Kenney signed an<a href=\"https:\/\/www.phila.gov\/media\/20220927104203\/Executive-Order-2022-04.pdf?mc_cid=5a81c375a9&amp;mc_eid=b91fede77d\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-halts-philly-gun-ban-in-parks-recreational-centers\" title=\"Court Halts Philly Gun Ban in Parks, Recreational Centers\u00a0\"> executive order banning firearms<\/a> in the city\u2019s parks and recreation facilities.\u00a0<\/p>\n\n\n\n<p>This week, the city\u2019s Court of Common Pleas has enjoined Mayor Kenney from enforcing his ban following a lawsuit filed by Gun Owners of America (GOA).&nbsp;<\/p>\n\n\n\n<p>As GunsAmerica previously <a href=\"https:\/\/www.gunsamerica.com\/digest\/philly-mayor-slapped-with-lawsuit-after-banning-guns-in-recreation-areas\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-halts-philly-gun-ban-in-parks-recreational-centers\" title=\"Court Halts Philly Gun Ban in Parks, Recreational Centers\u00a0\">reported<\/a>, GOA filed the suit because Kenney\u2019s executive order violates a state preemption law that prohibits cities and municipalities from regulating firearms.\u00a0<\/p>\n\n\n\n<p>Only the state Legislature has the power to enact laws that affect 2A rights. \u00a0<\/p>\n\n\n\n<p>&#8220;The law in Pennsylvania couldn&#8217;t be clearer. No municipality &#8211; including Philadelphia &#8211; may regulate the lawful possession of firearms in any manner,&#8221; said Andrew Austin, attorney for GOA and the Plaintiffs in a press release. &nbsp;<\/p>\n\n\n\n<p>&#8220;Obviously, the City doesn&#8217;t care about that law or the concrete legal precedent affirming it, and since there are no consequences for them, they will continue to try to ram through illegal rules to the detriment of their own citizens,\u201d he continued. \u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/highland-park-victims-sue-smith-wesson-for-deceptive-ads-that-appeal-to-mass-killers\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"court-halts-philly-gun-ban-in-parks-recreational-centers\" title=\"Court Halts Philly Gun Ban in Parks, Recreational Centers\u00a0\">Highland Park Victims Sue Smith &amp;
