{"id":166282,"date":"2022-07-13T13:57:40","date_gmt":"2022-07-13T17:57:40","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=166282"},"modified":"2022-07-13T13:57:40","modified_gmt":"2023-09-08T08:03:53","slug":"watch-police-commissioner-says-he-will-confiscate-guns","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/watch-police-commissioner-says-he-will-confiscate-guns\/","title":{"rendered":"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0"},"content":{"rendered":"\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"&#039;That&#039;s A Yes Or No&#039;: Clay Higgins Grills Police Chief On Red Flag Laws\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/es9Rwxkc_co?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p>Buffalo Police Commissioner Joseph Gramaglia conceded a few months ago that he would confiscate an individual\u2019s firearms based upon an anonymous tip that the individual was a threat to himself or others.<\/p>\n\n\n\n<p>Gramaglia was testifying before the House Committee on Oversight and Reform back in May when he was directly asked by Louisiana Congressman Clay Higgins (R) whether he would enforce confiscatory <a href=\"https:\/\/www.gunsamerica.com\/digest\/doj-publishes-guidance-for-red-flag-confiscation-legislation\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">red flag laws<\/a>, also known as extreme risk protection orders.<\/p>\n\n\n\n<p>\u201cWould you go to your neighbor&#8217;s home and confiscate his legally owned weapons, a man that was not under a criminal investigation nor under arrest?&nbsp; Would you do it?\u201d Higgins asked.&nbsp;<\/p>\n\n\n\n<p>\u201cThe red flag laws\u2026,\u201d Gramaglia began, when Higgins interjected, \u201cThat\u2019s a &#8216;yes&#8217; or &#8216;no,&#8217; brother.\u201d<\/p>\n\n\n\n<p>\u201cIt\u2019s more than a yes or no answer,\u201d said Gramaglia. &nbsp;<\/p>\n\n\n\n<p>Higgins went on to explain how red flag laws operate and how low the evidentiary bar is to trigger enforcement.&nbsp;<\/p>\n\n\n\n<p>\u201c\u2018Determined to be\u2019 is defined by the letter of this law to be an anonymous tip that an American citizen is a threat to themselves or others,\u201d noted Higgins. &nbsp;<\/p>\n\n\n\n<p>\u201cYou\u2019re a police commissioner, a thin-blue-line brother, sworn to uphold the constitution and you\u2019re saying you\u2019d seize those weapons,\u201d he continued. \u201cI see that as a problem.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/connecticut-expanding-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">Connecticut Considers Expanding \u2018Red Flag\u2019 Law, Eliminating Expiration on Gun Confiscation<\/a><\/h2>\n\n\n\n<p>Red flag laws work like so, a citizen &#8220;determined to be a threat&#8221; is disarmed and loses his right to keep and bear arms until he can convince a judge that he is not a danger to himself or others. <\/p>\n\n\n\n<p>Under this system, the accused is guilty until proven innocent or, more accurately, rendered disarmed and defenseless until the state decrees otherwise.<\/p>\n\n\n\n<p>It\u2019s worth noting that it can be weeks before the accused is allowed to go before a judge to respond to the allegations and to tell the other side of the story.\u00a0 As the saying goes, justice delayed is justice denied.\u00a0<\/p>\n\n\n\n<p>The National Shooting Sports Foundation, the firearms industry trade association, spoke to GunsAmerica in the past about the many issues surrounding red flag laws.&nbsp;<\/p>\n\n\n\n<p>\u201cWe are talking about depriving law-abiding citizens of their fundamental civil liberties and if that is to occur, those affected parties have a right to confront witnesses and evidence before a judge renders a decision to enforce an order,\u201d said Mark Oliva, NSSF managing director of public affairs.<\/p>\n\n\n\n<p>\u201cIn exigent circumstances when an individual poses an immediate danger to themselves or others, those individuals still have rights and must be afforded the opportunity to come before a judge within a reasonable timeframe. When an individual is arrested, they are before a judge within 24-72 hours. There\u2019s no reason someone should be deprived of their civil liberties without the same standard of justice,\u201d he added.&nbsp;<\/p>\n\n\n\n<p>There is no hard <a href=\"https:\/\/www.rand.org\/research\/gun-policy\/analysis\/extreme-risk-protection-orders.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">evidence to suggest that red flag laws \u201csave lives\u201d<\/a> to the degree proponents tout, but there is plenty of evidence that they are just the start of a larger confiscation scheme.\u00a0 Case in point, <a href=\"https:\/\/www.gunsamerica.com\/digest\/connecticut-expanding-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">states have been expanding the roster of<\/a> who is allowed to petition a court for a red flag order.\u00a0<\/p>\n\n\n\n<p>Initially, it was only law enforcement and immediate family members who wielded that power.\u00a0 Now, many states have added to that list registered nurses, psychologists, social workers, <a href=\"https:\/\/www.gunsamerica.com\/digest\/teachers-now-have-confiscation-power-under-new-yorks-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">teachers<\/a>, and a wide variety of extended family members and acquaintances.\u00a0 \u00a0<\/p>\n\n\n\n<p>But wait, it gets worse.\u00a0 In at least one state, lawmakers <a href=\"https:\/\/www.gunsamerica.com\/digest\/connecticut-expanding-red-flag-law\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">have discussed eliminating the expiration date<\/a> on red flag orders altogether.\u00a0 In most cases, the revocation of 2A rights is only supposed to last one year.\u00a0 But politicians in Connecticut have talked about imposing it indefinitely. \u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/biden-signs-bipartisan-safer-communities-act-with-help-from-these-15-gop-senators\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">Biden Signs Bipartisan \u2018Safer Communities Act\u2019 with Help from These 15 GOP Senators<\/a><\/h2>\n\n\n\n<p>It also bears mentioning that red flag laws do not provide help or assistance to those deemed a public danger.\u00a0 The government assumes that the immediate seizure of firearms is all that is necessary to render a potentially violent person impotent. \u00a0No follow-up care or mental health treatment is administered.<\/p>\n\n\n\n<p>The sole focus is on taking guns.&nbsp; But sharp objects, blunt instruments, and automobiles kill thousands of people each year.&nbsp; However, under a red flag law, a suspect\u2019s access to these \u201cweapons\u201d remains unrestricted.&nbsp;<\/p>\n\n\n\n<p>Last month, Biden <a href=\"https:\/\/www.gunsamerica.com\/digest\/biden-signs-bipartisan-safer-communities-act-with-help-from-these-15-gop-senators\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">signed the \u201cSafer Communities Act,&#8221;<\/a> the first major federal gun control legislation in 30 years.  While many saw it as a big nothing burger in terms of its immediate effect on 2A rights, contained in that law are incentives for states to adopt these confiscatory red flag schemes.  Nineteen states already have <a href=\"https:\/\/www.everytown.org\/solutions\/extreme-risk-laws\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"watch-police-commissioner-says-he-will-confiscate-guns\" title=\"WATCH: Police Commissioner Says He Will Confiscate Guns\u00a0\">them on the books<\/a>.  Time will tell how many others follow suit now that there&#8217;s federal aid on the table.  <\/p>\n\n\n\n<p>The hard truth about red flag laws is they weren&#8217;t crafted by the state to take guns away from criminals or the mentally deranged.  We have plenty of existing laws to handle those legitimate threats.  No, politicians designed red flag laws to take guns away from <em>you<\/em>.  And unfortunately, it appears they have at least one police commissioner in power that is eager and willing to do their bidding.  <\/p>\n\n\n\n<h2 class=\"has-text-align-center
