Alba defended himself, and Simon died. DA Alvin Bragg has charged him with murder. <a href=\"https:\/\/t.co\/FIfL1O1q7X\" target=\"_blank\" class=\"clickTracking\" campaign=\"graphic-video-bodega-worker-being-charged-w-murder-for-stabbing-ex-con\" title=\"Graphic Video: NYC Bodega Worker Being Charged w\/ Murder for Stabbing Ex-Con\">pic.twitter.com\/FIfL1O1q7X<\/a><\/p>&mdash; Ian Miles Cheong (@stillgray) <a href=\"https:\/\/twitter.com\/stillgray\/status\/1545074624127729665?ref_src=twsrc%5Etfw\" target=\"_blank\" class=\"clickTracking\" campaign=\"graphic-video-bodega-worker-being-charged-w-murder-for-stabbing-ex-con\" title=\"Graphic Video: NYC Bodega Worker Being Charged w\/ Murder for Stabbing Ex-Con\">July 7, 2022<\/a><\/blockquote> \n\n\n\n<p>&#8220;Informant observed the defendant reach over the counter, grab her daughter\u2019s hand, and seize the item from her daughter&#8217;s hand after the transaction was declined,&#8221; the complaint read.&nbsp; &#8220;Informant then left the store and informed her boyfriend, Austin Simon, of the clerk\u2019s actions, and returned to the store with Mr. Simon, who went behind the counter of the store to confront the clerk.&#8221;<\/p>\n\n\n\n<p>The complaint also notes that Simon\u2019s girlfriend tried to push Alba off and failed to do so.\u00a0 She then retrieved her own knife and stabbed Alba in the arm.\u00a0<\/p>\n\n\n\n<p>&#8220;We are continuing to review the evidence and the investigation is ongoing,&#8221; a spokesperson for the Manhattan District Attorney\u2019s Office told <em>Fox News Digital<\/em>.\u00a0<\/p>\n\n\n\n<p>If found guilty, Alba could face up to 25 years behind bars.&nbsp;<\/p>\n\n\n\n<p>Alba\u2019s daughter Yulissa told the <a href=\"https:\/\/nypost.com\/2022\/07\/05\/video-shows-nyc-bodega-worker-allegedly-stabbing-man-to-death\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"graphic-video-bodega-worker-being-charged-w-murder-for-stabbing-ex-con\" title=\"Graphic Video: NYC Bodega Worker Being Charged w\/ Murder for Stabbing Ex-Con\"><em>New York Post<\/em> <\/a>that her father acted in self-defense. \u00a0<\/p>\n\n\n\n<p>&#8220;He\u2019s never hurt anybody.
