{"id":165841,"date":"2022-07-04T09:07:00","date_gmt":"2022-07-04T13:07:00","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=165841"},"modified":"2024-08-31T11:33:31","modified_gmt":"2024-08-31T16:33:31","slug":"hunt365-ny-court-rules-happy-the-elephant-isnt-human","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/hunt365-ny-court-rules-happy-the-elephant-isnt-human\/","title":{"rendered":"NY Court Rules Happy the Elephant Isn&#8217;t Human"},"content":{"rendered":"\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Happy the elephant could be the first animal to have human rights | USA TODAY\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/zXc4iJsVIBg?start=1&#038;feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<h1 class=\"wp-block-heading\"><\/h1>\n\n\n\n<p><strong>By Larry Keane<\/strong><\/p>\n\n\n\n<p>New York\u2019s highest court \u2013 the New York Court of Appeals \u2013&nbsp;<strong><a href=\"https:\/\/www.nytimes.com\/2022\/06\/14\/nyregion\/happy-elephant-animal-rights.html?smid=tw-nytimes&amp;smtyp=cur\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">rejected<\/a><\/strong>&nbsp;by a 5-2 decision the anti-hunting group Nonhuman Rights Project\u2019s (NhRP) lawsuit claiming Happy the Elephant isn\u2019t an animal and instead had \u201cpersonhood\u201d rights and is being held by the Bronx Zoo against her will.<\/p>\n\n\n\n<p>\u201cWhile no one disputes the impressive capabilities of elephants, we reject petitioner\u2019s arguments that it is entitled to seek the remedy of habeas corpus on Happy\u2019s behalf,\u201d Chief Judge Janet DiFiore&nbsp;<strong><a href=\"https:\/\/www.nytimes.com\/2022\/06\/14\/nyregion\/happy-elephant-animal-rights.html?smid=tw-nytimes&amp;smtyp=cur\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">wrote<\/a>.<\/strong>&nbsp;\u201cHabeas corpus is a procedural vehicle intended to secure the liberty rights of human beings who are unlawfully restrained, not nonhuman animals.\u201d<\/p>\n\n\n\n<p>The court\u2019s decision was the most recent&nbsp;<strong><a href=\"https:\/\/twitter.com\/nytimes\/status\/1536708817127366656\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">rejection<\/a><\/strong>&nbsp;of the anti-hunting group\u2019s attempt to assign personhood to animals.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Hunting &amp; Conservation<\/h4>\n\n\n\n<p>Judge Rowan Wilson wrote in a dissenting opinion that the court had a duty \u201cto recognize Happy\u2019s right to petition for her liberty,\u201d not just because \u201cshe is a wild animal who is not meant to be caged and displayed, but because the rights we confer on others define who we are as a society.\u201d The court\u2019s majority, of course, disagreed. People uniquely have rights in America. This is why the case mattered for the hunting, conservation, wildlife management and animal agriculture communities.<\/p>\n\n\n\n<p>Judges appeared irritated when they first heard the case last month before rendering their decision. Judge Jenny Rivera questioned the Nonhuman Rights Project, Inc. (NhRP) attorneys, asking, \u201cIf Happy is a person, does that mean that I couldn\u2019t keep a dog? I mean, dogs can memorize words.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/hunt365-ny-judges-antihunting-groups-happy-the-elephant-human\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">NY Judges Irritated Of Antihunting Group\u2019s Claims That \u2018Happy The Elephant\u2019 is a Human<\/a><\/h2>\n\n\n\n<p>If the court decided Happy did indeed possess personhood rights, the floodgate would open for future lawsuits against other zoos. Animal rights groups could&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/n-y-judges-irritated-skeptical-of-antihunting-groups-claims-that-happy-the-elephant-is-a-human\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">sue<\/a><\/strong>&nbsp;dairy cow or meat processing operations, pig farms, or chicken or pheasant preserves. The New York Farm Bureau even submitted an amicus brief in favor of the Bronx Zoo&nbsp;<strong><a href=\"https:\/\/www.nssf.org\/articles\/n-y-judges-irritated-skeptical-of-antihunting-groups-claims-that-happy-the-elephant-is-a-human\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">warning<\/a><\/strong>&nbsp;that a ruling in NhRP\u2019s favor could be disastrous. \u201cWorse, if any of those habeas petitions succeed in securing the release or transfer of livestock\u2026 the downstream effects also would be serious.\u201d<\/p>\n\n\n\n<p>That would also be an obstacle to hunters harvesting wild game for their freezers and wildlife management biologists that rely on hunting as a wildlife conservation&nbsp;<a href=\"https:\/\/www.fws.gov\/story\/why-hunting-allowed-refuges\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\"><strong>management tool<\/strong><\/a><strong>.<\/strong><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Long Road<\/h4>\n\n\n\n<p>Happy came to the Bronx Zoo in 1977. Happy is a 50-year-old elephant in the care of zookeepers, well-fed, bathed and watched over. Happy even has a social life with visitors and other elephants.<\/p>\n\n\n\n<p>That didn\u2019t stop NhRP from bringing Happy\u2019s case to court in 2018. \u201cShe\u2019s a depressed, screwed-up elephant,\u201d said NhRP\u2019s&nbsp;<strong><a href=\"https:\/\/www.nytimes.com\/2022\/06\/14\/nyregion\/happy-elephant-animal-rights.html?smid=tw-nytimes&amp;smtyp=cur\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\">founder<\/a>.<\/strong>&nbsp;The group wasted the court\u2019s time and resources with junk suits in 2018 and 2020, both times the court rejecting their claims. This final stage was set when an appellate court agreed with the ruling of a lower court, which brought the case to the New York Court of Appeals. Happy has remained at the Bronx Zoo this entire time.<\/p>\n\n\n\n<p>NhRP would be wise to take the loss and stop there. The&nbsp;<a href=\"https:\/\/www3.nssf.org\/share\/factsheets\/PDF\/WildlifeConservation2017.pdf\" target=\"_blank\" class=\"clickTracking\" campaign=\"hunt365-ny-court-rules-happy-the-elephant-isnt-human\" title=\"NY Court Rules Happy the Elephant Isn't Human\"><strong>North American Model of Wildlife Conservation<\/strong><\/a>&nbsp;demonstrates that when a society puts intrinsic value on wildlife, those species prosper. NhRP\u2019s goal wasn\u2019t to free Happy. It was to force a radical anti-hunting agenda by judicial precedent that would disenfranchise hunters \u2013 the original conservationists.<\/p>\n\n\n\n<h2 class=\"has-text-align-center
