The world has known for more than 12 months that Hunter Biden almost definitely violated federal gun law when he lied on his Form 4473<\/a> in 2018. The president\u2019s profligate progeny is an admitted cocaine user, yet denied being \u201can unlawful user of a controlled substance\u201d when he purchased a .38-caliber revolver.<\/p>\n\n\n\n

In a sane world, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) would jump at the opportunity to hold accountable such a high-profile figure. To no one\u2019s surprise, they don\u2019t appear to be doing anything of the sort.<\/p>\n\n\n\n

The ATF is stonewalling a Freedom of Information Act Request for information related to the Hunter Biden incident because, \u201cthe revelation of any such investigation would constitute an unwarranted invasion of Mr. Biden\u2019s privacy.\u201d<\/p>\n\n\n\n

Biden\u2019s \u201csubstantial interest in not having any such investigation disclosed outweighs any public interest in such a disclosure,\u201d federal lawyers write in a response to the suit.<\/p>\n\n\n\n

The suit was filed on behalf of writer David Codrea in the U.S. District Court for the District of Columbia. The ATF argues that he and his legal team failed to demonstrate \u201csubstantial public interest\u201d in revealing the information, and they issued what\u2019s known as a Glomar <\/em>response to the request.<\/p>\n\n\n\n

\u201cWhere, as here, the asserted public interest lies in uncovering government misconduct (here the ATF\u2019s alleged failure to investigate Mr. Biden and refer him for prosecution in connection with the alleged handgun incident), the plaintiff must proffer compelling evidence of misconduct in order to establish a substantial public interest. Plaintiff manifestly failed to do that, and so his challenge to ATF\u2019s Glomar<\/em> response fails,\u201d the ATF writes<\/a>.<\/p>\n\n\n\n

A Glomar <\/em>response is issued to indicate that the agency cannot either confirm or deny the existence of materials related to a Hunter Biden investigation. They argue that confirming or denying the existence of such records would necessarily reveal whether a specific, named individual was the subject of a law enforcement investigation. Such a revelation, the agency says, would violate Hunter Biden\u2019s privacy rights.<\/p>\n\n\n\n

It’s frankly unlikely that this story goes anywhere from here. Joe Biden has every reason in the world to keep this story from seeing daylight, and after the original Politico<\/a> story broke in 2021, the mainstream media hasn\u2019t touched it with a 10-foot pole.<\/p>\n\n\n\n\n\n\n\n
