(Photo: Public Domain)<\/em><\/figcaption><\/figure>\n\n\n\n<p>A group of 20 Republican U.S. senators sent a letter to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) demanding information on the \u201csecret internal guidance documents\u201d the agency has been using to go after solvent trap kits and forced reset triggers.<\/p>\n\n\n\n<p>\u201cIt has recently come to our attention that ATF has formulated secret internal guidance documents \u2018to assist ATF personnel tasked with differentiating so-called \u2018solvent-traps\u2019 from firearm silencers\u2019 and to assist \u2018with identifying certain machinegun conversion devices commonly referred to as\u2019 FRTs,\u201d the senators <a href=\"https:\/\/www.lee.senate.gov\/services\/files\/3300BB66-21A2-47AA-A914-B4E3D1D29A9C\" target=\"_blank\" class=\"clickTracking\" campaign=\"republican-senators-go-after-atf-for-secret-internal-guidance-on-solvent-traps-triggers\" title=\"Republican Senators Go After ATF for \u201cSecret Internal Guidance\u201d on Solvent Traps, Triggers\" target=\"_blank\" rel=\"noreferrer noopener\">write<\/a>.<\/p>\n\n\n\n<p>The group of lawmakers demand that the ATF hand over any internal documents related to these two issues along with explanations for how these documents are used by law enforcement and why these documents have not been made available to the public.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/atf-chief-laments-innovations-in-firearms-have-gone-wild\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"republican-senators-go-after-atf-for-secret-internal-guidance-on-solvent-traps-triggers\" title=\"Republican Senators Go After ATF for \u201cSecret Internal Guidance\u201d on Solvent Traps, Triggers\">ATF Chief Laments: \u2018Innovations in firearms have gone wild\u2019<\/a><\/h2>\n\n\n\n<p>Solvent trap kits <a href=\"https:\/\/www.gunsamerica.com\/digest\/atf-cracking-down-on-homemade-suppressors-asking-for-self-incriminating-photos\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"republican-senators-go-after-atf-for-secret-internal-guidance-on-solvent-traps-triggers\" title=\"Republican Senators Go After ATF for \u201cSecret Internal Guidance\u201d on Solvent Traps, Triggers\" target=\"_blank\" rel=\"noreferrer noopener\">were in the news last week<\/a> when Form 1 applicants began receiving threatening notices from the ATF asking for images of the \u201cparts you will use to make the silencer.\u201d The ATF had never before asked for such images, and the American Suppressor Association slammed the agency for \u201cunilaterally deciding that the National Firearms Act (NFA) applies to these kits.\u201d<\/p>\n\n\n\n<p>Now, it looks like these senators have obtained documents demonstrating that the ATF has its own set of rules for determining whether these kits, along with forced reset triggers, count as highly regulated NFA items. Running afoul of these federal laws can land gun owners in federal prison for up to 10 years.<\/p>\n\n\n\n<p>\u201cOur government, including the ATF, has a duty to inform Americans what they must do to comply with federal law, especially when the conduct involves the exercise of an enumerated constitutional right and violations could result in a penalty of up to ten years in prison,\u201d the senators write. \u201cThe use of \u2018secret\u2019 law is anathema to our system of government.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/republican-congressman-introduces-bill-to-block-atfs-backdoor-gun-registry\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"republican-senators-go-after-atf-for-secret-internal-guidance-on-solvent-traps-triggers\" title=\"Republican Senators Go After ATF for \u201cSecret Internal Guidance\u201d on Solvent Traps, Triggers\">Republican Congressman Introduces Bill to Block ATF\u2019s Backdoor Gun Registry&nbsp;<\/a><\/h2>\n\n\n\n<p>Federal courts have ruled on numerous occasions that citizens must be able to see and read all laws under which they live, and the courts must have an opportunity to rule on their constitutionality. Laws that are \u201cput in a desk drawer, taken out only for use at a criminal trial, and immune from any evaluation by the judiciary, is the sort of tactic usually associated with totalitarian r\u00e9gimes,\u201d wrote the Seventh Circuit U.S. Court of Appeals.<\/p>\n\n\n\n<p>\u201cWith this attempted secret regulation, the ATF shows an abject disregard for the fundamental principles of due process and accountable governance.
