{"id":158377,"date":"2022-01-26T16:26:58","date_gmt":"2022-01-26T21:26:58","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=158377"},"modified":"2022-01-26T16:26:58","modified_gmt":"2023-09-08T02:12:37","slug":"supreme-court-justice-stephen-breyer-to-retire","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/supreme-court-justice-stephen-breyer-to-retire\/","title":{"rendered":"Supreme Court Justice Stephen Breyer To Retire\u00a0"},"content":{"rendered":"\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>News broke this week that Supreme Court Justice Stephen Breyer, 83, will retire at the end of this term. \u00a0<\/p>\n\n\n\n<p>Organizations on both sides of the gun divide spoke out about the type of nominee they\u2019d like to see fill his shoes. &nbsp;<\/p>\n\n\n\n<p>\u201cThroughout his tenure on the Court, Justice Breyer has ruled in favor of reasonable measures to keep Americans safe from gun violence,\u201d said John Feinblatt, president of Everytown for Gun Safety.&nbsp;<\/p>\n\n\n\n<p>\u201cPresident Biden\u2019s nominee to replace Justice Breyer should also understand that the Second Amendment is fully consistent with common sense gun safety laws,\u201d Feinblatt continued.&nbsp;<\/p>\n\n\n\n<p>Justice Breyer has been more than sympathetic to the anti-gun cause.&nbsp; Most notably, Breyer put forth dissenting opinions in two landmark cases, <em>District of Columbia v. Heller<\/em> and <em>McDonald v. City of Chicago<\/em>, which together affirmed one\u2019s individual right to keep and bear arms for traditionally lawful purposes, e.g. self-defense inside the home. &nbsp; &nbsp;<\/p>\n\n\n\n<p>Breyer disagreed with this interpretation, <a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/08-1521.ZD1.html\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-justice-stephen-breyer-to-retire\" title=\"Supreme Court Justice Stephen Breyer To Retire\u00a0\">writing<\/a>, \u201cIn sum, the Framers did not write the Second Amendment in order to protect a private right of armed self defense. There has been, and is, no consensus that the right is, or was, &#8216;fundamental.\u2019\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/switch-gun-shot-show-2022\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-justice-stephen-breyer-to-retire\" title=\"Supreme Court Justice Stephen Breyer To Retire\u00a0\">Bring A Switch Gun To A Knife Fight \u2014 SHOT Show 2022<\/a><\/h2>\n\n\n\n<p>\u201cThe gun violence prevention movement is grateful for Justice Breyer&#8217;s distinguished career and understanding that reasonable gun safety laws are constitutional,\u201d said Shannon Watts, founder of Moms Demand Action.&nbsp;<\/p>\n\n\n\n<p>\u201cWe look forward to President Biden nominating a Black woman to continue this legacy, and we will mobilize our grassroots army of volunteers to ensure the Senate swiftly confirms them,\u201d she continued.\u00a0<\/p>\n\n\n\n<p>The National Shooting Sports Foundation, the firearms industry trade association, told GunsAmerica via email that while Breyer&#8217;s &#8220;service to the United States is worthy of respect,&#8221; it disagreed with him on his jurisprudence of\u00a0the 2A.  <\/p>\n\n\n\n<p>NSSF hopes that Biden will nominate someone who is more gun-friendly, but it isn&#8217;t holding its breath.  <\/p>\n\n\n\n<p>&#8220;President Biden has an opportunity to nominate an individual who is true to the Constitution as it is written. However, given the history of President Biden\u2019s hostile views toward gun rights and his antipathy toward the firearm industry, both of which were proven with his unsuccessful nomination of the gun control lobbyist <a href=\"https:\/\/www.gunsamerica.com\/digest\/nssf-chipman-defeat-isnt-the-end-of-bidens-assault-on-2a-rights\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"supreme-court-justice-stephen-breyer-to-retire\" title=\"Supreme Court Justice Stephen Breyer To Retire\u00a0\">David Chipman<\/a> for ATF Director, it is anticipated he will nominate another who would seek to legislate from the bench,&#8221; said Mark Oliva, NSSF director of public affairs.<\/p>\n\n\n\n<p>Oliva said regardless of who replaces Breyer on the bench, it would not change the high court&#8217;s 6-3 balance, &#8220;which is heavily represented by originalists and Constitutionalists.&#8221;<\/p>\n\n\n\n<p>&#8220;Any pending Supreme Court nomination is a reminder of the importance of mid-term U.S. Senate elections when it comes to gun rights,&#8221; Oliva added. &#8220;Senators have the duty and responsibility to advise and consent the president\u2019s nominees to the U.S. Supreme Court.&#8221;<\/p>\n\n\n\n<p>Stay tuned for updates.
