Footage of a deadly shooting in Lubbock, Texas, was released over the weekend sparking debate as to whether the use of force was justified.  <\/p>\n\n\n\n

Video below (GRAPHIC) depicts William \u201cKyle\u201d Carruth fatally shooting 54-year-old Chad Read after a brief confrontation on Nov. 5.  <\/p>\n\n\n\n

This is the Nov. 5 shooting of Chad Read by Kyle Carruth, estranged husband of state judge Ann-Marie Carruth.

No charges have been filed.

David M. Guinn, Carruth\u2019s lawyer, claims that his client acted in self-defense.  <\/p>\n\n\n\n

\u201cAll Texans may lawfully brandish a firearm to protect themselves, their property and their business,\u201d said Guinn, an attorney with Hurley, Guinn & Singh, in a statement to NewsNation<\/a><\/em>.  <\/p>\n\n\n\n

Guinn indicated that his client feared for his safety after Read, allegedly, threatened to take Carruth\u2019s carbine.  <\/p>\n\n\n\n

\u201cAnd instantaneously, he tried to take the gun away from Kyle,\u201d Guinn said. \u201cIn doing so, he was powerful enough to sling Kyle 180 degrees around on Kyle\u2019s patio.<\/p>\n\n\n\n

\u201cRaising his left leg, he was continuing his advance on Kyle, threatening him and posing an immediate threat. Kyle responded,\u201d Guinn continued. \u201cThis is a justifiable homicide.\u201d<\/p>\n\n\n\n

A disagreement or miscommunication over child custody appears to be the cause of the dispute. <\/p>\n\n\n\n

Read’s widow Jennifer is now suing for full custody of the two boys, who are currently living with Read’s ex, Christina Read, and Carruth. <\/p>\n\n\n\n

\u201cI am the stepmother of the children the [sic] subject of this suit,\u201d states Jennifer Read\u2019s affidavit<\/a>. \u201cThe mother of the children, Christina Read, has endangered the physical health and emotional well-being of the children by permitting them to be in the presence of the man that murdered their father, Chad Read.\u201d<\/p>\n\n\n\n

The investigation is ongoing and thus far no charges have been filed in connection with the shooting. Stay tuned for updates. <\/p>\n\n\n\n
