{"id":153094,"date":"2021-10-20T11:29:32","date_gmt":"2021-10-20T15:29:32","guid":{"rendered":"https:\/\/www.gunsamerica.com\/digest\/?p=153094"},"modified":"2021-10-20T11:29:32","modified_gmt":"2023-09-07T20:41:49","slug":"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins","status":"publish","type":"post","link":"https:\/\/gunsamerica.com\/digest\/when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\/","title":{"rendered":"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0"},"content":{"rendered":"\n\n\n\n\n\n\n<p><\/p>\n\n\n\n<p>A suspected rapist on a train just outside Philadelphia victimized a woman for more than 40 minutes last week while fellow passengers did nothing to stop the attack, reports <a href=\"https:\/\/www.clickorlando.com\/news\/national\/2021\/10\/19\/riders-held-up-phones-as-woman-was-raped-on-commuter-train-police-say\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\">local media<\/a>.  <\/p>\n\n\n\n<p>Investigators believe that instead of intervening, some riders recorded the <a href=\"https:\/\/www.clickorlando.com\/news\/national\/2021\/10\/19\/riders-held-up-phones-as-woman-was-raped-on-commuter-train-police-say\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\">alleged rape on their smartphones<\/a>. &nbsp;<\/p>\n\n\n\n<p>It&#8217;s not clear if any even took the time to contact 911 and report the incident.&nbsp; In fact, it didn\u2019t stop until a transportation authority employee called it in. &nbsp;<\/p>\n\n\n\n<p>Again, the assault went on for approximately 40 minutes. &nbsp;<\/p>\n\n\n\n<p>\u201cI can tell you that people were holding their phone up in the direction of this woman being attacked,\u201d Southeastern Pennsylvania Transportation Authority (SEPTA) Police Chief Thomas J. Call the Police\u2019<\/a><\/h2>\n\n\n\n<p>&#8220;What we want everyone to be is angry, disgusted and join us in being resolute to continue to make the system safe. We need help from the public to notify us when they see incidents that are occurring that are unusual,&#8221; Nestel said.<\/p>\n\n\n\n<p>&#8220;We want people to be our partners and to watch out for other riders,&#8221; he continued.<\/p>\n\n\n\n<p>Police identified the perp as Fiston Ngoy, 35, a homeless immigrant on an expired student visa.&nbsp;<\/p>\n\n\n\n<p>Ngoy is claiming that the encounter was \u201c<a href=\"https:\/\/nypost.com\/2021\/10\/18\/homeless-man-charged-with-raping-woman-claims-it-was-consensual\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\">consensual<\/a>.\u201d&nbsp; However, he is now in jail facing charges for rape, involuntary deviate sexual intercourse, sexual assault, and additional related counts. &nbsp;<\/p>\n\n\n\n<p>Bail has been set at $180,000.&nbsp;<\/p>\n\n\n\n<p>Ngoy has had previous run-ins with the law, including \u201cmultiple arrests and two misdemeanor convictions, one for controlled substances and one for sexual abuse,\u201d according to court records obtained by <a href=\"https:\/\/www.foxnews.com\/politics\/congolese-man-accused-rape-train-visa-terminated-deported\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\"><em>Fox News<\/em><\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/cops-after-man-holds-suspect-at-gunpoint-we-need-witnesses-not-heroes\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\">Police, After Man Holds Suspect at Gunpoint: We Need Witnesses, Not Heroes<\/a><\/h2>\n\n\n\n<p>After spending 120 days in prison and serving nine months on probation, he was put in immigration detention in Jan. 2018.&nbsp; Instead of being deported, the Board of Immigration Appeals in March of 2019 determined Ngoy\u2019s sex offense was not a \u201cserious crime\u201d and he was released back out onto the streets.<\/p>\n\n\n\n<p>Ngoy is scheduled to appear in court on Oct. 25.  <\/p>\n\n\n\n<p>Upon reflection, local police Superintendent Timothy Bernhardt was disheartened by the fact that no one came to the woman&#8217;s rescue.  <\/p>\n\n\n\n<p>\u201cThere was a lot of people in my opinion that should have intervened, somebody should have done something,\u201d Bernhardt said <a href=\"https:\/\/nypost.com\/2021\/10\/18\/homeless-man-charged-with-raping-woman-claims-it-was-consensual\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"when-being-a-witness-goes-wrong-passengers-let-train-rapist-victimize-woman-for-40-mins\" title=\"When Being A Witness Goes Wrong: Passengers Let Train Rapist Victimize Woman for 40 Mins\u00a0\">on Saturday<\/a>. \u201cIt speaks to where we are in society and who would allow something like that to take place.
