The Second Amendment Foundation (SAF) leveled a lawsuit against California after the fiasco, and the court agreed that the state had dropped the ball.<\/p>\n\n\n\n<p>\u201cLaw-abiding California gun owners were not responsible for the&nbsp;failure of the registration process, and we\u2019re delighted with the outcome of our lawsuit to set things right,\u201d said SAF founder and Executive Vice President Alan M. Gottlieb. \u201cWhen a process that should be user-friendly becomes a fiasco, it\u2019s the government\u2019s responsibility to correct the problem and the affected citizens should not suffer any consequences.<\/p>\n\n\n\n<p>\u201cWe will be closely monitoring the process when it begins in January, to make sure this time around everything works as it is supposed to,\u201d Gottlieb said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/nra-ila-newsom-exposes-the-political-purpose-of-californias-taxpayer-funded-anti-gun-factoid-factory\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-announces-new-dates-for-assault-weapon-registration-again\" title=\"California Announces New Dates for 'Assault Weapon' Registration (Again)\">NRA-ILA: Newsom Exposes the Political Purpose of California\u2019s Taxpayer-funded Anti-gun Factoid Factory<\/a><\/h2>\n\n\n\n<p>Not every California gun owner will be eligible to register their \u201cassault weapon.\u201d The state <a href=\"https:\/\/oag.ca.gov\/firearms\/bullet-button-assault-weapon\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-announces-new-dates-for-assault-weapon-registration-again\" title=\"California Announces New Dates for 'Assault Weapon' Registration (Again)\" target=\"_blank\" rel=\"noreferrer noopener\">laid out<\/a> four requirements that must be met for an individual to use the new registration process:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>The person would have been eligible to register an assault weapon under&nbsp;<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=PEN&amp;sectionNum=30900.#:~:text=(b)%20(1)%20Any,use%20of%20a%20tool%2C%20shall\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-announces-new-dates-for-assault-weapon-registration-again\" title=\"California Announces New Dates for 'Assault Weapon' Registration (Again)\" target=\"_blank\" rel=\"noreferrer noopener\">subdivision (b) of Penal Code \u00a7 30900<\/a>;&nbsp;&nbsp;<\/li><li>The person lawfully possessed each assault weapon they seek to register before January 1, 2017;<\/li><li>The person verifies under penalty of perjury that they attempted to register the assault weapon prior to the original registration deadline of midnight on July 1, 2018, but they were unable to do so because of technical difficulties during the registration process; and<\/li><li>The person timely registers the assault weapon between 9 a.m. on January 13, 2022, and 9 a.m. on April 12, 2022.<\/li><\/ol>\n\n\n\n<p>The California DOJ has not said how or if they plan to verify that a gun owner tried to use the online system but was unable to.<\/p>\n\n\n\n<p>As GunsAmerica <a href=\"https:\/\/www.gunsamerica.com\/digest\/exclusive-public-records-prove-california-gun-registration-was-a-total-disaster\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"california-announces-new-dates-for-assault-weapon-registration-again\" title=\"California Announces New Dates for 'Assault Weapon' Registration (Again)\" target=\"_blank\" rel=\"noreferrer noopener\">reported at the time<\/a>, a vanishingly small group of gun owners registered their firearms the first time around. At the end of the registration period in 2018, 6,213 individuals successfully registered&nbsp;13,519 \u201cassault weapons\u201d before the deadline, according to Deputy Attorney General Robert D. Franklin Armory\u2019s Jay Jacobson told us at the time that he tried unsuccessfully to register his AR-15 three separate times.
