(<em>Photo: Facebook<\/em>)<\/figcaption><\/figure>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Back in June, the San Jose City Council conditionally approved a raft <a href=\"https:\/\/www.gunsamerica.com\/digest\/pro-2a-group-threatens-lawsuit-to-stop-san-joses-gun-owner-tax-liability-scheme\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"san-jose-city-leaders-disclose-how-they-will-punish-uninsured-gun-owners\" title=\"San Jose City Leaders Disclose How They Will Punish Uninsured Gun Owners\u00a0\">of gun-control measures proposed<\/a> by current mayor Sam Liccardo.<\/p>\n\n\n\n<p>Included was a mandate for gun owners to purchase firearms liability insurance. &nbsp;<\/p>\n\n\n\n<p>Most responsible gun owners already have standard insurance that covers them in the case of a firearm-related accident.&nbsp; But that\u2019s not what this is. &nbsp;<\/p>\n\n\n\n<p>This is forcing law-abiding gun owners to pay premiums to foot the bill for the acts of criminals. &nbsp;<\/p>\n\n\n\n<p>Putting aside the obvious legal issues that such a scheme raises, questions emerged as to how the city would enforce it, especially given the fact that there is no universal state or federal gun registry that includes the names and addresses of every single gun owner living in San Jose. <\/p>\n\n\n\n<p>Well, we\u2019re now getting answers.&nbsp; Sort of.&nbsp;<\/p>\n\n\n\n<p>\u201cWe will rely on reactive enforcement, in the same way that California relies on reactive enforcement for auto insurance mandates, i.e., if you get pulled over for speeding you have to show proof of insurance,\u201d Rachel Davis, a spokesperson for the mayor told <em><a href=\"https:\/\/sanjosespotlight.com\/how-will-san-jose-enforce-its-proposed-gun-laws\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"san-jose-city-leaders-disclose-how-they-will-punish-uninsured-gun-owners\" title=\"San Jose City Leaders Disclose How They Will Punish Uninsured Gun Owners\u00a0\">San Jose Spotlight<\/a>.<\/em> &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/best-pdw-on-the-market-diamondback-dbx57-full-review\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"san-jose-city-leaders-disclose-how-they-will-punish-uninsured-gun-owners\" title=\"San Jose City Leaders Disclose How They Will Punish Uninsured Gun Owners\u00a0\">Best PDW on the Market? Diamondback DBX57 Full Review<\/a><\/h2>\n\n\n\n<p>Being pulled over for speeding on a public road is one thing.&nbsp; But how does law enforcement go about stopping or detaining one for exercising a fundamental right? &nbsp;<\/p>\n\n\n\n<p>Police Chief Anthony Mata provided the following response at a June 30th council meeting. &nbsp;<\/p>\n\n\n\n<p>\u201cDuring our normal course of duty, if we come across a firearm we will ask the owner if they have insurance,\u201d said Chief Mata.<\/p>\n\n\n\n<p>Uninsured gun owners will be punished.\u00a0 Penalties include being charged with a civil offense, a fine, and, possibly, the confiscation of one\u2019s firearms.  <\/p>\n\n\n\n<p>Apart from this \u201creactive enforcement,\u201d the city expects all gun owners to voluntarily upload proof of insurance to a government portal.&nbsp; Fees will also be required as part of the process.&nbsp;<\/p>\n\n\n\n<p>The firearms insurance mandate is not yet law.
