(Photo: GunsAmerica.com) <\/em><\/figcaption><\/figure>\n\n\n\n<p>A federal appeals court affirmed this week that a law prohibiting illegal immigrants from possessing firearms is constitutional.<\/p>\n\n\n\n<p>The ruling, handed down by a unanimous three-judge panel of the&nbsp;U.S. 2nd Circuit Court of Appeals, upheld a lower court decision convicting an illegal alien named Javier Perez for violating 18 U.S.C. \u00a7 922(g)(5). The law prohibits \u201can alien . . . illegally or unlawfully in the United States\u201d from \u201cpossess[ing] . . . any firearm or ammunition\u201d in or affecting commerce.<\/p>\n\n\n\n<p>Perez and his lawyers argued that the statute is unconstitutional because it violates Second Amendment rights, which Perez believes should be applied to lawful and unlawful immigrants alike. The court disagreed.<\/p>\n\n\n\n<p>\u201cHis interest in simply possessing firearms,\u201d the panel wrote, \u201cis not at the core of the Second Amendment right identified in Heller. As noted above, Heller identified the core interest of the right as self-defense in the home. Here, Perez\u2019s possession was neither in self-defense nor in the home.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/the-subway-vigilante-who-birthed-the-modern-concealed-carry-movement\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-court-affirms-that-illegal-immigrants-cannot-possess-firearms\" title=\"Federal Court Affirms that Illegal Immigrants Cannot Possess Firearms\">The Subway Vigilante Who Birthed the Modern Concealed Carry Movement<\/a><\/h2>\n\n\n\n<p>The decision stems from a 2016 incident during which Perez fired a <a href=\"https:\/\/www.youtube.com\/watch?v=yIDN98FQXRY\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-court-affirms-that-illegal-immigrants-cannot-possess-firearms\" title=\"Federal Court Affirms that Illegal Immigrants Cannot Possess Firearms\" target=\"_blank\" rel=\"noreferrer noopener\">.380 caliber Davis<\/a> into the air. He was attending a party in Brooklyn when he saw a group of young men with bats and machetes attacking a member of a rival gang. He asked an acquaintance to borrow his gun, ran towards the fight, and fired the Davis into the air. He returned the gun to his friend, but admitted later to firing the weapon after being arrested for a separate offense.<\/p>\n\n\n\n<p>The court did not decide whether the Second Amendment applies to undocumented immigrants. Instead, they upheld the constitutionality of 18 U.S.C. \u00a7 922(g)(5) because it does not violate \u201ccore Second Amendment rights\u201d in this case, and it passes the intermediate scrutiny test.<\/p>\n\n\n\n<p>In <em>District of Columbia v.<\/em> <em>Heller, <\/em>the Supreme Court defined as the core of the Second Amendment \u201cthe right of law-abiding, responsible citizens to use arms\u201d in self-defense in the home.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">SEE ALSO: <a href=\"https:\/\/www.gunsamerica.com\/digest\/everytown-law-announces-3m-war-chest-to-eliminate-2a-rights-via-the-courts\/\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-court-affirms-that-illegal-immigrants-cannot-possess-firearms\" title=\"Federal Court Affirms that Illegal Immigrants Cannot Possess Firearms\">Everytown Law Announces $3M War Chest to Eliminate 2A Rights Via the Courts&nbsp;<\/a><\/h2>\n\n\n\n<p>Along with not being \u201cin the home,\u201d the court argued that Perez cannot qualify as law-abiding because \u201chowever he may choose to live his life in the United States, his presence here is unlawful.\u201d Since he was also not using his firearm \u201cin the home,\u201d the law banning illegal immigrants from owning firearms does not impact core Second Amendment rights in this case, the court ruled.<\/p>\n\n\n\n<p>The law survives intermediate scrutiny because it achieves the important government interests of (1) preventing individuals who live outside the law from possessing guns, (2) assisting the government in regulating firearm trafficking, and (3) preventing those who have demonstrated disrespect for our laws from possessing firearms.<\/p>\n\n\n\n<p>According to the <a href=\"https:\/\/www.fbi.gov\/file-repository\/federal_denials.pdf\/view\" target=\"_blank\" class=\"clickTracking\" campaign=\"federal-court-affirms-that-illegal-immigrants-cannot-possess-firearms\" title=\"Federal Court Affirms that Illegal Immigrants Cannot Possess Firearms\" target=\"_blank\" rel=\"noreferrer noopener\">FBI<\/a>, the National Instant Criminal Background check system has denied a firearm transfer 37,713 times to illegal or unlawful aliens.<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong>***<a href=\"https:\/\/gunsamerica.com\/\" campaign=\"BuySellGA_Register\" target=\"_blank\" class=\"clickTracking\">Buy and Sell on GunsAmerica!<\/a>***<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal appeals court affirmed this week that a law prohibiting illegal immigrants from possessing firearms is constitutional.<\/p>\n","protected":false},"author":54,"featured_media":148798,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_specdata_upc":"","_specdata_placement":"","footnotes":""},"categories":[244,7,593,240],"tags":[132,607],"featured":[],"hunt365":[],"class_list":{"0":"post-148797","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-2nd-amendment-r2kba","8":"category-gunsamerica-authors","9":"category-jordan-michaels","10":"category-this-week","11":"tag-buzz","12":"tag-news"},"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.1 (Yoast SEO v27.3) -
